    "In #JohnnyDepp v. #AmberHeard, judgement entered. Judge Azcarate was no nonsense as usual. No request for an injunction by JD team (I didn't expect that at all). Also, AH will have to post settlement plus 6% interest / year bond to appeal. More soon."

    This judge was so gracious and patient with Elaine, at one point during the trial even helping her formulate a question because she was choking on objections. Then went on the news and implied that both the judge and the jury were incompetent. I am surprised she has the nerve to ask for anything, and the fact that she wasn't sanctioned during the trial was a miracle. Unbelievable how blissfully unaware she is of herself ruining her own name. But it's exactly the type of lawyer AH deserved, so I guess we should thank her for her incompetence and unprofessionalism.

      Amber and Elaine deserve each other. And in Elaine's defense, an unruly client can make even the best lawyer look bad. I don't think that's exactly the case, but I do think it contributed to her own incompetence. My guess is she'd have never taken on Amber if it weren't for that $6 mil ... She screwed herself going on the talk shows though and continuing to embarrass herself. The contrast between her and Camille was startling, and IMO the most interesting thing about this whole trial.

    1:45 The way the judge responded to the AH team's "requests" shows that the legal system (at least in Virginia) has exhausted its patience and now is preparing to go into punitive mode. During the trial, the mountain of objections and caveats that they were tossing around (I think "hearsay" became one of the top 3 most used words on Twitter, right after "the" and "and") convinced me that the judge was deliberately offering the AH team 100% of their claims, just to ensure that they would have nothing whatsoever on which to base an appeal. I pointed this out several times to people asking why the judge let Elaine and Rottenbottom object so much. It wasnt that she necessarily agreed with all the objections; it was because she wanted to leave NO basis whatsoever on which to support an appeal. You cant just appeal a decision you dont like. You have to point to some decision that the judge made, which you think was unfair. You cant do that if the judge allowed you to have every single decision go your way.
    Now that the trial is over, we see that AH is STILL trying to find something to appeal ... to the point of offering up evidence that even a TEN YEAR OLD can see is hearsay evidence (the so-called psychiatrist notes). By enforcing the bond, the judge is letting the AH team know that any further action will quickly turn into a money pit, deep enough to swallow even the Elon Musk fortune. Although it is a bit like closing the barn door after the horse is gone (because AH did get the Dateline interview out there), the upshot is that any further public outbursts are going to start costing her some serious coin.

So that was their own choice not to use them regardless of it being hearsay or not

    • @prettyacct
      @prettyacct 2 ปีที่แล้ว

      Most judges operate on the premise they don't want their rulings to be overturned on appeal. This judge was highly sensitive of this and gave all parties great latitude in the court room for this very reason. They would have to show an error of law for appeal. The main deal is the bond and I don't see an insurance company writing this bond for her and she doesn't have the liquidity to do otherwise.

      If Depp had 'softened' any hope of her coming down to reality would have been forever lost. If she doesn't wake up now and people don't stop 'helping' her get out of trouble, she doesn't have a hope of being made face what she's done and caused. We are all responsible for our own decisions and actions - paying money to 'keep her happy' hasn't worked thus far and NEVER will. It only makes things worse.

      @@fxsaf. Johnny's ex-wife has been ordered by the judge to put up the bond for payment of the definitive $8.3 million. The legal reasoning is entirely logical: the trial courts do not want the losing party in a civil action to stall payment of a jury award to the winning party in said civil action just because the losing party intends or has already filed an appeal to a higher court. The initial jury award to Johnny must be paid. An appellate proceeding may not be used as a delaying tactic by Johnny's ex-wife to get out of paying the jury award of $8.3 million to Johnny. Elaine pled before the judge to consider suspending Johnny's ex-wife to put up the bond for now, but the judge refused. The judge is just following the law. That’s true. That was the mistake that Michael Jackson made. When those first accusations were made, he knew that they were false and that they were just after money, so he gave them the money just to make them go away and leave him alone. BIG mistake, because then other people twisted that as being that he paid them off to silence them. He never fully recovered from that, and it only fed the evil tabloids and the rumour mill. And even when he didn’t make the same mistake again, went to court and was vindicated and cleared of any wrong-doing, there are still people out there who believe that he hurt kids. I think a lot of celebrities learnt from Michael’s tragedy. Moral of the story: never be too nice.

If she does cause him more trouble with it, I don't think he'll have any problem with legal redress, but I am concerned that her narc revenge could lead to personal harm to him. Back in the “olden days” when I practiced law in Louisiana, appeal delays began to run on the day the notice of the final judgment was mailed to the parties. This was usually very close in time to the day the final judgment was signed.
    There were two kinds of appeals (with different appeal delays). A DEVOLUTIVE appeal could be taken within 60 days. In this type of appeal the party cast in judgment had to make payment of the judgment before appealing. A SUSPENSIVE appeal could be taken within 30 days. However, in a suspensive appeal the party cast in judgment had to furnish a bond equal to the amount of the judgment, plus some interest.
    There are certain post trial proceedings that can interrupt these appeal delays, such as a motion for new trial, a motion to amend the judgment, etc. etc. You may expect Elaine B to file anything and everything that will buy time for her client. After all, Amber Heard has to scrape together money for the bond and for attorney fees. How many interviews do you think it will take to raise $8 million?
    You can also expect the judge to deny most of any such motions out right because they are without basis.
    Here is an interesting question. Do you think anyone in that courthouse, including the judge, is in a mood to cut Amber Heard some slack considering the interviews following the verdict?

    Elaine went on an interview the day after the verdict speaking badly abot the Judge, the jury and the justice system. I'm not surprised the Judge was done with her, I just wonder why of all the lawyers she was the one adressing the Judge. She should have been to emberassed to even look at her after what she has done. Add to that the disrespect from Amber and her inner circle who keep defaming Johnny as if Amber wasn't just found to be a malicious lier.
    Also lets not forget how Ambers people went after the court reporter, somone the Judge praised and called a rock star and how they attacked Camille with incredibly hateful statements about female lawyers.

From that moment on the bank is liable for it. The amount you need to deposit to the bank for this note depends on how much the bank trusts you.
