    Perfect video for my research!! Just one thing- the explorers asked Whetmore right before they tossed the dice to see if he agreed to the toss & Whetmore agreed...
    So in my point of view, I’d say Whetmore’s agreement can be taken as a final “Ok” to the original plan.... Do you agree? In a project, I based my argument off that but I received a few opposing opinions that seemed set that Whetmore never agreed.

      Hey, glad you liked the video! I made this as a grade 12 law project over a year ago so I'm probably not the best person to ask about this but I can give it a shot. My take is that Whetmore came up with the plan at first, but just before they did the roll, he backed out. So technically by the time the dice hit the ground, Whetmore wasn't participating anymore. In my opinion that means that the guys who ate him were in the wrong. Then again, their whole situation just complicates the whole right vs. wrong thing.

      Hi, I'm actually looking at this 'case' because of my criminology studies but I am also studying law. This could be all irrelevant depending on whether or not you are only looking at the facts of the case or whether you are researching with the assistance of reality... but...
      Something that you could consider is whether or not Whetmore could have been considered to consent to the killing at all. As far as I know, a person cannot consent to their own murder [however legal euthanasia would be an exception to this depending on the jurisdiction]. There is actually a case which involves the 'consensual' murder and human cannibalism by Armin Meiwes (Germany) - of course, this case is materially different as it does not involve a situation of life and death. My point is, arguably, Whetmore could not have given his consent at all to be killed and eaten if we were looking at it from a positive law standpoint. Of course, there are arguments that can be made regarding survival etc. In terms of the law and consent, Whetmore's so-called 'consent' or agreement, would be legally withdrawn (and the other 4 would not have been able to argue that there was consent).

      Caitlin Bourke Very enlightening and very true!! For my assignment, I had to pretend I was a judge and write an opinion, so I wanted to make sure I was understanding the facts correctly. But, now that I think about it, you are absolutely right.

      He never agreed, he never consented. They had asked him whether the throw was fair, to which he agreed. But he had said no to participating.

      Hey I just used a tablet to write and draw in Photoshop then recorded the screen and put together the footage in After Effects. I'm sure there are easier ways to do this though, I'm just used to these programs.
