This was done near where I live and the subsequent flooding caused the rock in the stream bed to move to the low water bridge below my house to clog up and keep the bridge flooded. Very inconvenient for the kids riding the school bus and their parents. When you change the stream bed it changes the waterway in ways you wouldn't expect.
About the same thing happened to us many years ago. There was a shallow berm building up and it did make a nice swimming hole. We were set to remove the berm that had formed but people got all uppity and stood between it and the machines. The mayor showed and told us to git. Three months later the river changed path and funneled into Main Street and took out city hall and some other business. The mayor got recalled.
Back in the early 80's......we had a couple men running a good dredge for a few weeks in a river here in oregon......they may be moved a 100 yards of rock......few yrs later the river changes its course and people down the river lost acres of land..
Very unlikely the dredging had anything to do with downstream flooding. Most commonly you will see an UPSTREAM erosion issue due to headcutting. Unless something like a large log being dislodged and jamming a culvert happens permitted dredging or bankwork is rarely an issue.
Well the Wardens were very helpful, they didn't give you a ticket and they told you who to get a permit from, so I think they were pretty nice about it.
ignorance of the law is no excuse, or at least that what a judge told me when i got a ticket for doing 55 in a 35 and i tried to say i didnt know it wasnt a 55 !! LOL
@warren michael , Judges can apply the law whichever way they want if it makes more money for the government. I watched a Judge make a statement to a defendant and then with the very next defendant , completely reverse himself . Yes , the Judge did fine both defendants ! It was a case of guilty if you do and guilty if you don't . I got a speeding ticket one time for doing 50 in a 35 zone. I was following right behind four other cars that had also just gone pass the deputy ! Being car number five I could not possibly have been going 15 miles an hour faster than they were . The situation was that we had just crossed the county line. The deputy was at the end of his patrol route. I was his last chance to issue a ticket. I explained all of that to the Judge. He did not want to hear any of it ! Yes, of course I had to pay the $130.00 fine. But , I'll tell you what . If I were to come upon that deputy and see him laying gutshot at the side of the road. I would simply turn my head so that I could not see him and just drive on by. Maybe the Democrat deputy could call his Democrat Judge to come and help him. As if the Judge would do that . lol
For all those who don't know Fish Wildlife have absolute Authority given to them by higher courts which does overrule the lower Court's decision in anything they decide with waterways
She even said it that judge does not have the authority to issue a permit it's very simple may not be right and your eyes or mine but it is what it is until legislation changes that so if you don't like legislation then call your legislator two or three times a day for months on end and maybe we can get that changed

"The head game warden was extremely friendly about the situation and just happened to be related to the owner of the dozer crew." Maybe that's how the game warden got the tip of the work in the river? Seems fishy to me that the game warden shows up 30 minutes after the work starts claiming that land owners had called and complained, yet had already spoke to the judge about the permit. How did she know to talk to the judge? I wonder if the dozer crew was being paid by the hour? that would explain a lot.
Most places the EPA will fine you heavily for putting that machinery in a creek or stream of any kind with out proper permits and netting that you have to use down stream.

Ben B but it won’t happen. Where I live many people overfish, catch undersized fish that never got a chance to breed and they get away with it. The game warden catches like 1/10 but like a cop catching a speeder, it slows down everything for a while
Wouldn't this be under the EPA or whatever Texas calls the Department of natural Recourses (In Michigan we call it the DNR)? What does a game warden have to do with this?
ed trine Well we got Trump to mess it up even more now. Many Republicans have been aiming to weaken environmental policies, the EPA, and the Endangered species act.

Try calling in on spotlighting road hunters and they'll come to your house and say " fuck you " to your face. Honest..it happened to me. Don't bother reporting them to Austin because they won't do shit. Peace out and happy hunting.
They're not "cleaning out" the river for flood control... where I come from that us referred to as gravel mining. Anyone notice the empty red dump truck parked up the hill? That will be loaded to sell the rock. As sediments, including coarse gravels/rocks migrate towards the ocean, the "holes" they dig will just fill in quickly., and do nothing for flood control or native fish. This technique is good for one thing... making cash by selling river rock for gravel and black top.
It's good to make some holes in the river and make some Eddies. It give the fish a place to hide and recoup there energy. It's pretty simple stream or river management but some how the DNR knows how to mess it up and make it more complicated then it needs to be.
old greg NO ITS NOT GOOD MANAGEMENT. IT destroys all the other river life. Here in Washington, they have mutilated the river and its estuaries leading to many anadromous Salmon, Trout Steelhead, Dollyvardon and others. they dredge up the eggs and move logs that provide protection.
There is nothing that a person can do, ala bulldozers and excavators, that will 'make a river better'. The 'ecosystem' is not just fish swimming in the silt filled water stirred up by the machinery,,,, the machinery just scraped away all the bugs and algae the fish need to eat. Rocks are places eggs are laid, bugs hide under and behind, newts, salamanders, worms, flat worms all hide behind rocks and logs on the bottom. And flood control? I have never seen any flood control, TVA included, that was effective and not damaging of something else. Nature does a better job.
Sailor376also I agree. Here in Washington, Tribes have battled for years to stop all the damage done for decades by the non tribal entities with clear cutting and other actions that cause siltation, low oxygen and other problems like diking.
looks like the sand company just south of sh 242 on the san jacinto river near conroe but they actually push sand into the river to reroute it..for years i figured it was illegal but no one does anything...ride an atv though and you smacked in every direction financially..
Yeah. Like here in OH, you can only own property up to within 3 feet of a public waterway. So many trouble makin' fools trying to say you can't fish on their lake property. Can't own a public waterway. Period. Even modifying it is like they say in this video.
It's complicated! "To complicate matters, some Texas land titles originated with Spanish or Mexican land grants, and the law of Spain and Mexico did not distinguish public and private streams on the basis of navigability." tpwd.texas.gov/publications/nonpwdpubs/water_issues/rivers/navigation/kennedy/kennedy_faq.phtml "If, on the other hand, the private landowner owns the streambed (meaning that the stream is classified as non-navigable), the public has no right to use the bed and banks and the landowner may erect barriers to prevent the public from doing so." agrilife.org/texasaglaw/2014/05/13/public-right-of-use-for-texas-waterways/ "I’ve tested this in many different counties in Texas, and property owners get pissed off for hunting the river bottoms, and the local law enforcement and TP&W, are largely ignorant to the publics right of use." Ken Lukasik says: January 24, 2016 at 1:02 pm
captainvideojw no sir, Texas is different than other states in the union when it comes to property rights when they entered into the union. Texas did not give up its property rights as part of the deal as becoming a member of the United States. With that being said though, the only time the bed under a stream or navigable body if water can be privately owned is if the propertys chain of title comes from a Spanish Land Grant. If your property is Spanish Land Grant you own it and can do whatever you want to the bottom. The things you cannot do is block its navigability off by fencing and you cannot stop people from fishing or boating through it.
The biggest mistake they ever made was trading in their f150s for Silverado’s my dads a game warden and he couldn’t kill his f150 but since they got the Silverado’s they only last a 70,000 miles 😂
What the hell does geology have to do with Hydrology? While where we are at i, what does game wardens have to do with a small river except for fishermen.
because Hydrology effect geology through erosion and how it effects plants and animals. because all water ways are public property unless completely surrounded by private property and everything in the ecosystem relies on rivers cause water is the source of all life on earth not just fish.so their job is to make sure the river is healthy so both human and animals don't suffer from one idiots mistake.
Did you have the machines running on vegetable oil without any petroleum products, not to mention silt protection down stream and so on blah blah , your crazy if you think people let you run a dozer with in 200 ft. Of a river here in PA lol, I wish it was that easy here , My swamp would be a nice spring fed bass pond
Why dont they mine for gravel in the river banks up higher away from harming any Flora and Fauna? I would check for gold nuggets with a good metal detector. You never know?
Game wardens are the ultimate cops they preside over everything. They can come right in your house without a warrant all they need is presumption of illegal game. They can give you tickets for anything.
In Texas the initial contact would be TCEQ I believe, depending on scope and METHOD it may require a nationwide permit. Which depending on scope and METHOD is a straight forward application. Regarding METHOD, as a rule backing a dozer into the creek is not an acceptable method in a running waterway anywhere in North America. That significant time was spent filming the dozer in the water and posting it on TH-cam shows a complete disregard for the process. Before I get a bunch of negative comments, ask those in and Houston if sediment transport and flooding is a concern.
I did not see any hydraulic fluid leaking out of the earth moving equipment. I seen no oily film on the water to give me an indication there was oil leaking from the equipment. If equipment is properly maintained, like you car for example. It will not leak oil, transmission fluid on.
Washing that much sediment down the river is super sketch, man. Super sketch. We all see the good intentions I am sure- ya seem like nice folks. But it's just that kind of stuff that'll kill flora and fauna all down the river. I give credit to all parties for the good attitudes, but, bro... don't mess up the Frio!!!! 97% private land in Texas and I like swimming in that river!!!!!!!! All the best :)
hudsontoo1212 pardon my French but, horse muffins. You will get THOUSANDS of TONS of sediment washed down stream EVERY time is rains. What does guys are doing is a drop in the bucket compared to that.
When ever a game warden comes on my property first thing they hear is "get the hell of my land" followed by the slamming of the gate. No authority on private land in TN.
Standard game wardens, they rule over all land and animal, according to them. The game wardens have been given way too much power. In NC they can come on your property unannounced without any form of warrant if you have a fishing pole leaning up against a barn. I understand we live in a nation of laws but law abiding working folks should have refuge from this type of "police work". The sentiment argument has no weight, those 2 tractors couldn't produce the amount of sentiment in a month that a 15 min TX thunderstorm could.
Can't here what is said. Can't judge one way or the other. Good for the Game Warden for doing what they think is right. What is the need to clean out the river? Does look dirty to me. Looks like someone wanted more rocks on the land.
I don't believe the game warden can unilaterally overrule a County judge. The proper course of action would have been for the Department of Wildlife to appeal the judge's ruling to a higher or federal court. I find it very interesting.
The judge is in the legal branch of government. The warden is in the administrative branch of government that is tasked with implementing the (clean streams) laws passed by the legislative branch of government. If a lawsuit resulted form this, then the judge would get a shot at deciding whether or not the permit or issues arising from the permit are constitutional, or not. Judges do not do administrative stuff. This is USA Government 101 folks. Separation of powers. Rule of law.
They clean it out so people can float down the river. Simple as that. All the garbage about fish and flooding and beautification is just that. Garbage. Businesses along the river in this area make a lot of money off of tourists who come out and stay in cabins and buy food and ice and beer. As long as the river stays navigable by inner tubes/floats the money comes in. I lived here and I know what I'm talking about.
I will agree with him if the creeks were cleaned out there would b less flooding the creeks are so full the water has no choice but to leave the banks and flood every thing
All rivers in Texas belong to the state. No, your property line doesn't run into the river. The only folks that have a problem with the law are law breakers. I grew up next to our local game warden that has since died. I road with him for years and he was always treated folks with respect until they became belligerent. I have the upmost respect for game wardens. The man having the river dredged knew he was wrong and so did the judge. I wonder if he got a permit from the boys in Austin. Does anyone know?
That's a river? I'll give you a creek, but not a river. When I was young I could have pissed over that creek. Hence it does not qualify as a river. As person should not be able to through a rock over a proper river.
John Maxwell the the river beds in the state of Texas are property of the state in almost all areas. There is good reason for that too. In this specific region of Tx there are multiple rare plant and water species that are a part of the Frio river that are crucial to that river.
My company I work for in NY.in order for us to do a stream job we have to pump the water around where we are working in the stream.one big ass pump.with a big ass pipe that divert the water.(this is nothing new).been doing stream work for year's.you can't just dig in the water and dirty it up.or you face heavy Fine's.30,000 and up to 100,000.you have only 2 Chance's too dirty the water and that is to dig a hole and set your pump.and at the end of the job to pull the pump.and ya the pump run 24hrs around the clock till the job is done.i am surprised they let you go without the proper paperwork.as a contractor they should know this.so some of theses comments are retarded.i have been doing this for 30 year's and the law has never changed.do the job right and you make good money!! just have to go through a long process and get the right paperwork 😉

This technique is good for one thing... making cash by selling river rock for gravel and black top.
The judge's actions we're illegal and it is our duty to let him know!
I say your all players in the game.
In New York State we have Enviromental Conservation officers..( ENCON).. They have more authority than a State Trooper..
What about the living stuff in the river
Those were some nice game wardens
In the meantime, the expense of the crew and the equipment rental, continues.
I'm not against people cleaning up. But, some folks go way overboard and do all kind of "improvements".
All the thousands of Acres you guys have in the backwoods ,they Panic about clearing out a river with a machine -It can only happen in America LOL
Im old greg it's a control thing
Im old greg Logs an debris provide safe harbor to the young as well as the older fish.
looks like the sand company just south of sh 242 on the san jacinto river near conroe but they actually push sand into the river to reroute it..for years i figured it was illegal but no one does anything...ride an atv though and you smacked in every direction financially..
Isn't that the COPOA park?
River belonging to the State of Texas? I thought property rights went to the center of the river?
Property rights go to high water area river is not personal property.
Yeah. Like here in OH, you can only own property up to within 3 feet of a public waterway. So many trouble makin' fools trying to say you can't fish on their lake property. Can't own a public waterway. Period. Even modifying it is like they say in this video.
It's complicated!
"To complicate matters, some Texas land titles originated with Spanish or Mexican land grants, and the law of Spain and Mexico did not distinguish public and private streams on the basis of navigability."
tpwd.texas.gov/publications/nonpwdpubs/water_issues/rivers/navigation/kennedy/kennedy_faq.phtml
"If, on the other hand, the private landowner owns the streambed (meaning that the stream is classified as non-navigable), the public has no right to use the bed and banks and the landowner may erect barriers to prevent the public from doing so."
agrilife.org/texasaglaw/2014/05/13/public-right-of-use-for-texas-waterways/
"I’ve tested this in many different counties in Texas, and property owners get pissed off for hunting the river bottoms, and the local law enforcement and TP&W, are largely ignorant to the publics right of use." Ken Lukasik says:

captainvideojw no sir, Texas is different than other states in the union when it comes to property rights when they entered into the union. The things you cannot do is block its navigability off by fencing and you cannot stop people from fishing or boating through it.
usually stop on the highwater mark on each side riverbed is the states
The biggest mistake they ever made was trading in their f150s for Silverado’s my dads a game warden and he couldn’t kill his f150 but since they got the Silverado’s they only last a 70,000 miles 😂
You need a permit because as US citizens you only reside in the land, you cannot live there as your legally a dead entity.
Nice trees.
Ask the judge if he can issue a hunting license. Or maybe a driver's license. Good grief.
I wouldn't call that sediment. It looks like beautiful gravel.
And just how much do you think a flood wood wash down stream.
+komer west they will be complaining to Mother Nature then.
As much as he sounds like a hippie he is right. Running the equipment in the river is bad enough.
When ever a game warden comes on my property first thing they hear is "get the hell of my land" followed by the slamming of the gate. No authority on private land in TN.
This is also disturbing artifacts, arrowhead hunters know what i mean
TexasSmoking come on man... Really??
Standard game wardens, they rule over all land and animal, according to them. The game wardens have been given way too much power. In NC they can come on your property unannounced without any form of warrant if you have a fishing pole leaning up against a barn. I understand we live in a nation of laws but law abiding working folks should have refuge from this type of "police work". The sentiment argument has no weight, those 2 tractors couldn't produce the amount of sentiment in a month that a 15 min TX thunderstorm could.
We have become a nation of Lawyers not laws!
They are one of the most powerful law enforcement agencies in the state of Texas
nope this river is start to end in side of texas
Shit thats a Texas game warden. They can do whatever they feel like.they do seem too nice though.
Rule of law.
odeis5 Wow....profanity. If that's all you've got ,then you're out of ammo. No-one is impressed or intimidated by you.
Wow good job gov.
Bureauquacks?
red tape.... making America stupid.
Wealthy people doing whatever they want damn the impact on others downstream or the environment...making America dumber again!
I lived here and I know what I'm talking about.
lol clean it out doesn't mean dredge it out
the fish can lay there eggs if the top is cover with larger stones and fish die out.
Yep, there must be millions of people tubing down that river. Look at them all. And the business. As far as the eye can see.
Werewolf Alpha just cause your ikm
Nevermind
That's a river? I'll give you a creek, but not a river. When I was young I could have pissed over that creek. Hence it does not qualify as a river. As person should not be able to through a rock over a proper river.
YOU upset the fish police , the stupido fish police!!!
John Maxwell the the river beds in the state of Texas are property of the state in almost all areas. There is good reason for that too. In this specific region of Tx there are multiple rare plant and water species that are a part of the Frio river that are crucial to that river.
Here in WI most people refer to our DNR as Dam Near Russia.
Who give the rights of water ways to the government. The people is the government so why they get total control?
I'm confused, did high water fill in someone's fishing hole or something?
Game wardens were cool as shit...
