What happens on the ground outside of certain sites isn't within their remit legally. The CAA are quite clear about the responsibility to check local bylaws etc. being on the pilot.

Having been in deep military intelligence, I wouldn't use a drone to collect footage for terrorism purposes, they're far too conspicuous. I'd much rather be a drunk looking vagrant or someone who acts strange and you wouldn't even see my camera, it would be hidden in a button and controlled from my pocket. I would also be in communication with a handler.

The Council has indeed implemented a number of PSPO rules, including a drone ban: “Any person(s)* who fly/flies a drone without the written consent of the landowner and/or London Borough of Brent, whether licensed or not.” It’s a fine line between protecting the public from potentially harmful acts and breaching on civil liberties and lawful activities such as filming. It seems that the anti-social behavior act is commonly misused to restrict lawful acts.

The council have zero authority over the airspace. Only the CAA. The DJI drones do have a feature though called geofencing which can be set to not let the drone even take off in certain areas.
A PSPO is nothing to do with airspace, it means drone operators are unable to TOAL on any of the land that the PSPO covers; which is what has occurred here. So yes the council down own the airspace but you still can’t ignore a PSPO.
Surely that PSPO thing is not entirely legal - certainly open for a legal challenge by someone brave enough. That doesn’t feel ethical, and is an infringement on freedoms. I suppose in the UK, we can’t be surprised.
And rich enough… costs money to fight something in court - although I’d definitely contribute to a go fund me for someone willing to do it At the very least for them to be forced to pass the data to DJI etc. be easy enough to create an API for them to see the data and update so we actually know these things The random PSPOs are definitely immoral if not illegal 🙄
A lot of council bylaws are unlawful. They rely on the fact that nobody has the funds to challenge them, because the council themselves would willingly go bankrupt to fight anything however trivial.
One could argue even if you did fly the Drone Assist app doesn't show that is a banned area. Therefore if you did fly you can show you've done your due diligence. Meaning a court of law will likely rescind the fine, or ticket they have given you.

It’s funny because a friend of mine has his phone stolen in town and the police couldn’t be arsed to check cctv. But when someone “might” have flown a drone they’re straight onto control to try and prove someone guilty.

GREAT video mate. These PSPOs are crazy and someone needs to challenge them in a court - they’d likely be upheld BUT we may be able to get them to publish the data so that DJI etc can access. Fully unethical the current setup and will punish lawful flyers because there’s no way for us to know - EVERY security guard tells us not allowed… how are we meant to know when it’s actually not allowed 🤦♂️ Well done for persevering and getting those amazing shots!!

I bets it’s like this. The police being around the corner were doing something that had a natural pause. Like expecting someone to arrive somewhere but they’d been spotted 50 miles away and were heading their way. Or similar. They could attend but didn’t want to get involved with an arrest, prisoner handling and paperwork. Saying that, the dog guy was taking a big chance and I bet all the officers were running the calculation and really wanted to deal with him.
Pity they don't show up in force like this when the illegal immigrants arrive at the shores. I also thought you can't fly a drone from their property but you can fly over it, as they don't control the airspace above like the CAA does. Hell I can understand flying over Wembley stadium when there's a game on or something, and it's nothing the do with Health and safety, it's because TV broadcaster have paid tens of thousand for the right to do so. Sounds like security at Wembley don't like tourist either, basically anyone with a camera. Need to put that in the adverts, "No Cameras Allowed".

More likely it doesn't cover every bylaw, regulation & PSPO in place. There's nothing wrong with flying in that area, you are only banned from TOAL in publicly accessible areas.
@@mjbrown1603 The problem with Drone Assist is it gets its data from Altitude Angel, which in turn gets automated feeds like NOTAMS from the CAA etc. It won't pickup on stuff like bylaws, ATEX zone restrictions etc. The CAA are pretty open about them not having the responsibility, nor the data for these. The PSPO is pretty irrelevant really, the airspace has no restrictions - it's just a council using a PSPO which I'm 99% certain is to protect commercial aspects around events at Wembley.

Yep, Brent has a PSPO and you have to get written consent by the land owner and/or the London Borough of Brent, whether you're licensed or not. But following the PSPO map of Brent, drones are listed as number 18. Borough wide is 1-9, which does not include drones (18) - Yes you can fly drones Wembley Park is 1-18 which includes drones - No you can't fly drones Parks and open spaces 1-6 and 19-31, drones not included (18) - Yes you can fly drones Cemeteries and graveyards 1-6 and 19-31, drones not included (18) - Yes you can fly drones So the only place the PSPO is for no flying of drones is Wembley Park. Regarding filming or taking pictures in Wembley Park, small personal phones and cameras are allowed. Cameras with interchangeable lenses or professional equipment, are not allowed though. The security guy made it seem like he can go around banning people with their iPhones taking pictures or filming, NO, he can't and that's according to Brent's own website.

I have never been keen on the new Wembley stadium as I find it soulless! The old one with its twin towers was iconic

I also thought you can't fly a drone from their property but you can fly over it, as they don't control the airspace above like the CAA does. Hell I can understand flying over Wembley stadium when there's a game on or something, and it's nothing the do with Health and safety, it's because TV broadcaster have paid tens of thousand for the right to do so. Sounds like security at Wembley don't like tourist either, basically anyone with a camera. Need to put that in the adverts, "No Cameras Allowed".

It’s only restricting him taking off from there. Go outside the pspo area and you can do it and fly over the pspo area. It only relates to the ground

More likely it doesn't cover every bylaw, regulation & PSPO in place.
There's nothing wrong with flying in that area, you are only banned from TOAL in publicly accessible areas.

@@mjbrown1603 The problem with Drone Assist is it gets its data from Altitude Angel, which in turn gets automated feeds like NOTAMS from the CAA etc.
It won't pickup on stuff like bylaws, ATEX zone restrictions etc. The CAA are pretty open about them not having the responsibility, nor the data for these.
The PSPO is pretty irrelevant really, the airspace has no restrictions - it's just a council using a PSPO which I'm 99% certain is to protect commercial aspects around events at Wembley.

Yep, Brent has a PSPO and you have to get written consent by the land owner and/or the London Borough of Brent, whether you're licensed or not.
But following the PSPO map of Brent, drones are listed as number 18.
Borough wide is 1-9, which does not include drones (18) - Yes you can fly drones
Wembley Park is 1-18 which includes drones - No you can't fly drones
Parks and open spaces 1-6 and 19-31, drones not included (18) - Yes you can fly drones
Cemeteries and graveyards 1-6 and 19-31, drones not included (18) - Yes you can fly drones
So the only place the PSPO is for no flying of drones is Wembley Park.
Regarding filming or taking pictures in Wembley Park, small personal phones and cameras are allowed. Cameras with interchangeable lenses or professional equipment, are not allowed though.
The security guy made it seem like he can go around banning people with their iPhones taking pictures or filming, NO, he can't and that's according to Brent's own website.
