    I'm only about 3 mins in, so please forgive me if you already covered this later in the video. As a friendly FYI to everyone doing RE Options, when you get the seller to sign your Option Agreements and you pay the consideration etc, make sure to also send 'Option Memorandums' (mutually signed and notarized) to the applicable County Records. Doing so will cloud the title thus preventing the seller from selling the deal from out under you without your expressed consent. Having an Option Memorandum in County Records protects your best interests, because it solidifies that the Agreements in place have to be honored while those agreements are in effect.
    PS: The actual 'Option Agreement' and 'Purchase & Sales Agreement' do not need to be recorded at the County Records. You simply need to record that those Agreements exist via 'Memorandum' documents --- Example: A document stating that pertaining to this particular property (with this address and legal description of the property), there exists an Option Agreement and Purchase Agreement whereby one party has the right to purchase the property from the seller by this date 01/01/20xx'. The exercise price and other terms of the Agreements do not need to be on the simple memorandum. Simply stating on the memorandum that those documents exist, is enough to cloud the title, thus protecting your best interests.

    Such an honest and transparent way to "lock up" a property without misleading someone ... Question: When you wholesale the option, what document does the end buyer sign? Do they have to create a new Purchase and Sale Agreement with the seller since there isn't one yet? How does that work exactly? ... Thank you Jerry for the continuous masterclasses you and Pace are giving all of us! :)

    Hey Pace & Jerry, when going through the sales process with a motivated seller would you only pitch an option after they’ve already disagreed to subto/seller financing ? In a previous video in this series you two talked about pitching creative finance as a solution to a seller wanting a high purchase price. In what order/situation are you talking about these things?     Hey Jerry quick question I downloaded your free wholesale contract package but I’m using the one tomorrow to get a buyer for my deal but In the assignment of purchase and sale agreement it doesn’t say no where how much I supposed to be making so the buyer knows, it just says “which is to include assignor’s assignment fee.” Could you please clear this up for me? Will the attorney just know the assignment based off the contract between me and the seller or do I just tell him just need this cleared up Thanks!

    How would we protect the deal and prevent someone from going around us?

    WHAT DO YOU DO IF WHILE SHOPPING THE DEAL THE SELLER TRIES TO SELL TO SOMEONE ELSE? THEY SIGNED A CONTRACT WITH YOU, SO IS IT JUST HOW YOU STRUCTURE THE CONTRACT FOR FINANCIAL CONSEQUENCE OF THE SELLER BREAKING THE CONTRACT? AND THEN DO YOU HAVE TO GET ATTORNEY'S INVOLVED?
