  • A Fulton County judge is hearing a motion to quash a subpoena for Gov. Brian Kemp to testify in the 2020 election interference special grand jury investigation.
    Lawyers for the Georgia governor are claiming executive privilege and sovereign immunity exemptions from the subpoena, and a filing argues his testimony before the special grand jury is "being pursued at this time for improper political purposes."

    No person is above the law. Not a governor, not a lawyer, not a senator etc. A grand jury must be allowed to hear literally ANYONE, regardless of rank or status. That is equality under the law.

      If Kemp doesn't testify, he will loose a whole lot of votes. He is following the rest of the Republicans right off the cliff. It all boils down to presumption of guilt.     The judge is being incredibly patient with Kemp's counsel. "Look, I see where you're going, but you haven't shown that you've done your due diligence." You can't just walk into a courtroom and make a bunch of allegations without backing them up with law, facts, and evidence.

    No one should be above the law. ESPECIALLY those in political office. There should be a REQUIREMENT for any politician to testify under oath when called to do so, with not exemptions. Refusal should result in immediate removal from office.

    Michigan had a Speaker of the House that tried to use that argument in regards to a state legislature that was caught asking money for votes. He said he was immune, but the federal courts threatened him with jail time unless he came in and testified as a witness to a crime.

      @@bostonjackson9384 If you are subpoenaed and just refuse to show up, you can be imprisoned and/or fined. It’s considered contempt. There are certain circumstances when you can ask the court to be excused from showing up, but a criminal case where you are a material witness is not one of them.
      That’s the bottom line here. You must show up in court if you are subpoenaed. A subpoena is a court order.

    Sovereign immunity. That's for monarchs. But even for former monarchs (example in Spain) such immunity did no longer work. Kemp is a governor, not for a few people but áll people of his state. The People wish to hear him on a specific case. He has to obey.
    His refusal is an affront. It makes him suspicious.

    I love seeing judges who smell BS when they see it. Passing the bar does not allow you to make laws as you go. Well, sometimes it does, BUT that's beyond the point.
