Actually the European Court of Justice ruled that OEM licences are completely legal no matter what Microsofts user agreement says. So you may be right about NA, but not the EU.
In general most courts if most countries have struck down EULAs repeatably. License terms has to be specified at or before purchase, license terms that are told later or you are asked to to agree to later are not legally binding. The OEM deals are different in that they are terms the OEM agrees to, depending on the size of the company asking OEMs to agree to terms that might be illegal due to anti-trust or completely legal. But one thing that is completely legal in any case, is using one of those licenses if you get it, the OEM that sold you it, may or may not be guilty of contract violation, but that isn't your problem. And these days you get the windows OEM licenses from normal retailers, not from OEM breaking contracts like we did 15 years ago.
Linus: We don't activate Windows, because it's gonna be broken after hardware changes again *replaces literally every part of it and the system continues to be activated* Linus: ANYWAY
I recent faced this issue, due to swapping my NVME multiple times and also changing the mobo, it doesn't instantly deactivate, it takes sometimes hours, sometimes days!
I have done 4 complete rebuilds since I bought my win 8 pro key on sale for 35$ from windows. I have never bought another license, it always lets me enter my old license and never has been deactivated.
They wouldn't require an audit or anything like that. What Linus does it not allowed, but if Microsoft were to take action it would lose them a lot of money in legal costs and negative PR.

Windows answers the philosophical question... If you keep repairing a boat and over the years every single piece has been replaced - is it the same boat? So, when does it become a new computer? Windows decides xD
That's an interesting point. You could okie-doke Windows by replacing every single component in a PC, even copying the hard drive bit-for-bit on a new disk.... at the same time, I don't feel like Microsoft should have any say at that point. As long as the license isn't in use in more than one PC, why should they care? You're paying for an instance of Windows, it shouldn't matter what hardware it runs on.
Bad Chemist Absolutely you could, but what concern is that to Microsoft? I think as long as the original owner wipes their hard drive before selling it (as to ensure that instance of Windows can't be re-used by the new owner, and is best practice anyway to make sure your personal data isn't stolen), then Microsoft isn't losing out on any sales.
@@justinbrewer9326 : I understand the frustration, been there done that, but you should take a look at Manjaro. It's a very slick distribution based on Arch, without the cold sweat. 15 minutes per week of updating keeps it working forever, most proprietary video cards are recognized out of the box with the proper drivers installed. My oldest installation dates back from 2015, and it's still up and running, updated to the latest level without having been reinstalled at any point. Cherry on the cake, regular people can use the KDE variant without feeling lost. LibreOffice does a good job at connecting to the outside world of windows documents. I've converted many reluctant users with this one, something I never really managed before. And I go way back to the slackware 3 era, kernel 1.2. Manjaro is the best that happened to Linux since Linus himself. Of course, it stands on the shoulders of Arch, so a lot of the credit goes to them in the first place, but Manjaro really brought the power of Arch to the unwashed masses.
It is obviously just not intended to be used this way. I wonder why they not using linux, but previius time I tried to migrate ti linux it was very unvelcoming. Linux became better but it still has tonns of minor and not minor issues that can be solved with intence googling, and not everyone wants to do this.
Have you actually saw the video? He basically explains why do we see the watermark and that it is just not how the OS was intended to be used, but it still works just fine. Windows is far from perfect, but in practice it is still the most both user friendly and flexible. Unfortunately it seems linux has long way to go to fight windows properly. I wish this happen soon but according to my experiance linux is very far from what it fans tell about it and needs too much time investment what actually repels most people.
Proton is indeed a thing for regular gaming, but it can't be used for hardware overview because of the way it works (using Wine and DXVK to execute Windows programs). Performance depends greatly upon optimization, and software differences shouldn't get in the way while hardware is the focus. But otherwise, yeah, Proton really makes Linux gaming far more available.
I think you should frame an unopened Windows 10 Pro, and place it in a frame on the wall behind your test bench, so everyone knows you have a key dedicated just for that machine.
wait, what actually physically STOPS YOU from reusing the same license? i've got like 5 computers using the same key, and none of them are havign any issues
Closer to fact than people think. I upgraded my data drive...DEACTIVATED. I changed my Primary SSD...DEACTIVATED. Both times had to call. Both times I had to jump through hoops. They "claimed" that I had a new computer. No...I had a new data drive the first time, and 6 months later I updated the SSDs when I re-installed Windows. I'm dreading my memory increase because my neighbor got "DEACTIVATED" when he went from 16Gb to 32Gb in his machine...
GTA player: _gets their car repainted_ Microsoft Police Dept: "Freeze right there, crim... oh sorry sir, have a nice day" It makes _SOOOO_ much sense now.
What nobody apparently seems to realise (at least none that are commenting here) is that running windows this way is completely legal and endorsed by microsoft. MS wants everybody on W10, so they do not care that you run an un-activated version. In fact the only thing it will ever do is: a: give you a watermark telling you to activate b: limit your aero and desktop customisation options. Nothing more. It is completely legitimate. I mean the watermark is annoying as hell as it also starts to overlay games and such but it is still not illegal to run it this way. So Linus, no worries and keep on trucking. :)
Diablo do you expect irrational emotional people who's only goal in life is to attempt to prove how smart they are on social media to do RESEARCH??? haha. This is nothing more than Linus responding to the peanut gallery.
Makes sense I guess, but I wouldn't know - I'm not on farcebook or any of those other stupid social media platforms. Even for youtube I only log in to make the occasional comment. I do know, however that farcebook don't allow kids under 13 to use it, yet you won't find many kids that are not on it, so I guess they don't read the T&C either :) As for Windows, so far, I've only ever seen one system running Windows 10 - most of the stuff that lands on my workbench are still single-core 32-bit XP systems, though Windows 7 is starting to show up a bit more often these days - hardware is a hell of a lot more expensive here in the UK than it is in the US, so people don't upgrade until something breaks SO badly that even I can't fix it). Personally I ditched Windoze almost ten years ago - Linux FTW!
It's against US federal law for kids under 13 to have accounts on social media, forums, etc. They can use it, but the account technically has to be created by the parent and used with adult supervision, or something. AFAIK it's not really enforced, but it does mean TH-cam can't get sued by a negligent parent if their 9 year old gets an account and watches restricted content.
Apparently Microsoft EULA even stipulates that you can't openly criticise their products. So, whenever you're bashing on Windows you're probably violating their EULA terms.
When the EULA is non-negotiable and your only choices are either accept and use the thing or reject and don't use the thing, most people will not even consider the latter. I bet reading the EULA feels like a waste of time when you think like that.
It's not pirating if you're officially downloading the ISO from their website which is free, and installing it, and having an option to not install a product key and still works as fine, just with a watermark and locked wallpaper options.
I know this is a bit of an old comment but you can actually change your wallpaper on a locked os by going into the registry and swapping out the default background with whatever image you want. Only caveat is you have to restart your pc for it to take effect.
You can use Windows 10 indefinitely without activating, I believe that's fine and allowed, you just don't get all features, perfectly fine for hardware testing. If the activate message is in the way of what ever you're doing, reboot and it will disappear for an hour or so.
Only feature is that wallpaper for life lol, thast all, theres really no missing features from what I found. I hate win10 even if its for free, have the dam thing on my high end gaming laptop tho, prefer win7 on gamedesktop.

The fun thing is that those people complaining Linus pirated Windows are actually those who did it because at some point it connected to Microsoft servers, they received such watermark and from now on they think everyone with this watermark is pirating Windows. While Linus is the one who actually applies more effort than they could've imagined to make everything work legally.
Linus is correct but the word he was looking for was SLP = System Lock Per installation. Windows sets a specific ID for each hardware and when you change a specific one it triggers that WINDOWS ACTIVATION crap thing... most of the time this triggers when you changed Motherboard since Microsoft considers that as a NEW SYSTEM, therefore, requiring a NEW LICENSE I worked with Microsoft before... yes there is a limit... Windows have the different type of VERSIONS (not talking about Pro, home etc..) Windows 10 FPP = Full Package retail this have 10 install or prompt limit you can call MS and they will ask for your PID, Product Code and the disc... there are security codes there that we put in PID PLUS (Yeah the tool that we generate Product keys!) once the representative identified that it's the first time and you have a legit software we generate a new Key FOR FREE! and you have another 10 install limit.. Windows 10 OEM = Original equipment manufacturer
Your post needs more upvotes. The full package retail licence is ironically sold by many stores as an OEM version as well, so it gets even more complicated. Basically the license type is FPP, while the actual package is an simple OEM one, just like those that Linus showed us. Those seem to ideal version to buy (about half the price of actual full package retails in a full package box), unless you can get get a corpo one.
Uh, no. An OEM license costs at least US$150. I paid about RM700 for one. Which I think is already quite cheap, since the Microsoft online store wanted RM1200 for a retail license.
We literally have an ENTIRE PILE of Microsoft licences and discs bought through the Big Tech resellers (i.e ingram micro tech date, the old microsoft reseller program, etc) so many we can barely count them all. I would hate to see how much we spent on them.....and good thing it's the company Visa card that's paying for them! To think we've probably spend a few hundred thousand dollars CAN on software for such a small company.....it boggles the mind! No wonder Gates got so rich even WITH free Linux being around...IT departments just STILL keep on buying Windows Server, Windows Desktop and MS-Office left, right and centre without regard to costs!

Actually the European Court of Justice ruled that OEM licences are completely legal no matter what Microsofts user agreement says. So you may be right about NA, but not the EU.
Never knew that, nice to read and know it!
Indeed, license agreements can't override local law.

Windows answers the philosophical question...
If you keep repairing a boat and over the years every single piece has been replaced - is it the same boat?
So, when does it become a new computer? Windows decides xD
You should be paying for an instance of software regardless of the hardware you run it on.
@@RedTopProductions but couldn't you use the parts that you took away and sell them and or build a new PC?
Bad Chemist Absolutely you could, but what concern is that to Microsoft? I think as long as the original owner wipes their hard drive before selling it (as to ensure that instance of Windows can't be re-used by the new owner, and is best practice anyway to make sure your personal data isn't stolen), then Microsoft isn't losing out on any sales.

MS wants everybody on W10, so they do not care that you run an un-activated version.

a: give you a watermark telling you to activate
b: limit your aero and desktop customisation options.

I've been working in IT and related fields for over 25 years and I've yet to meet ANYONE who's ever read a EULA.
I did for a few things at uni. they have some strange stuff. did you know facebook doesn't allow registered sex offenders in their terms of service?
Makes sense I guess, but I wouldn't know - I'm not on farcebook or any of those other stupid social media platforms. Even for youtube I only log in to make the occasional comment. I do know, however that farcebook don't allow kids under 13 to use it, yet you won't find many kids that are not on it, so I guess they don't read the T&C either :)
As for Windows, so far, I've only ever seen one system running Windows 10 - most of the stuff that lands on my workbench are still single-core 32-bit XP systems, though Windows 7 is starting to show up a bit more often these days - hardware is a hell of a lot more expensive here in the UK than it is in the US, so people don't upgrade until something breaks SO badly that even I can't fix it).

We could create a meme with Linus intro
The fun thing is that those people complaining Linus pirated Windows are actually those who did it because at some point it connected to Microsoft servers, they received such watermark and from now on they think everyone with this watermark is pirating Windows. While Linus is the one who actually applies more effort than they could've imagined to make everything work legally.
Linus is correct but the word he was looking for was SLP = System Lock Per installation. Windows sets a specific ID for each hardware and when you change a specific one it triggers that WINDOWS ACTIVATION crap thing... most of the time this triggers when you changed Motherboard since Microsoft considers that as a NEW SYSTEM, therefore, requiring a NEW LICENSE
I worked with Microsoft before... yes there is a limit...
Windows have the different type of VERSIONS (not talking about Pro, home etc..)
Windows 10 FPP = Full Package retail this have 10 install or prompt limit you can call MS and they will ask for your PID, Product Code and the disc... there are security codes there that we put in PID PLUS (Yeah the tool that we generate Product keys!) once the representative identified that it's the first time and you have a legit software we generate a new Key FOR FREE! and you have another 10 install limit..
