Truly enjoyed the lecture. However, I have one observation:
I believe Plaintiff may propound discovery 10 days after service of the complaint and NOT 10 days after filing the complaint.
    CCP Section 2030.020.
    (a) A defendant may propound interrogatories to a party to the action without leave of court at any time.
    (b) A plaintiff may propound interrogatories to a party without leave of court at any time that is 10 days after the service of the summons on, or appearance by, that party, whichever occurs first.
    (c) Notwithstanding subdivision (b), in an unlawful detainer action or other proceeding under Chapter 4 (commencing with Section 1159) of Title 3 of Part 3, a plaintiff may propound interrogatories to a party without leave of court at any time that is five days after service of the summons on, or appearance by, that party, whichever occurs first.
    (d) Notwithstanding subdivisions (b) and (c), on motion with or without notice, the court, for good cause shown, may grant leave to a plaintiff to propound interrogatories at an earlier time.

Hey Steve thanks for everything. I have a person im suing who stays with her mother. I had the sheriff go to the house to serve her and the girls mother says she doesn't live their, and hasn't seen or talked to her in over a year. The sheriff sent the lawsuit papers back to me saying that they can't serve her since her mom says she doesn't live there. I havw proof on Facebook that her mom does indeed talk to her and is lying about not speaking or knowing where's she is. Its been 30 days already and I'm running out of time to serve her, what can I do ?

I really appreciate this video I have a commercial building I rent it I applied for this commercial building a year ago and was turned down the owner chose someone else over the month I have seen this commercial building with a couple of different signage but no one never opening
Surprisingly approximately a year-and-a-half later I receive a call from that owner of that building apparently he kept my number and asked me if I still was interested in the building and I replied of course
Thinking that this was a blessing I came with my deposit first and last as he requested
I did notice some damage in the building and which he said he was going on vacation and a few days upon his return he would jump on it right away
Later he did not jump on this right away and I noticed when I got the utilities on that the lights did not operate or work so I had no lights in the building
A month later the owner finally repairs most of the lights
But I still have no lights operating front and back of the building so it's very dangerous
The other repairs went ignored and so no one can use the bathroom because of it
Because of this the city would not approve me
I decide to hold back one month rent and he files an eviction on me
Truthfully I should have had a credit even though I held back a month a few of the month I paid extra on my rent

At what point can a plaintiff request an injunction against the defendant? Is it difficult, in your experience, to convince a judge to sign it?

    • @attorneysteve
      @attorneysteve  4 ปีที่แล้ว +1

Henz, check out this video I did many years back. Will show you the process. Will a judge sign - depends upon the strenght of the case. th-cam.com/video/CIrbAqq7__M/w-d-xo.html

4:40 *“... You can only send 35 interrogatories ...”* Does that mean a total of 35 individual questions? Or 35 sets of questions? Do Request for Admissions count against this 35? Sets? Or individual questions?

I'm representing myself in a 8103(f)(1) hearing. I haven't file with the court yet because I would like to have the records before filing (Hearing shall be heard within 30 days per law) as I know it would be a battle. I've attempted to obtain records claiming discovery self rep from the detaining Sheriff's Department, the CA DOJ, and the facility. Both law enforcement agencies are refusing release. The facility is still pending.
What sections of law do I need to be referencing?
The hearing is not worth the representation ($10,000+). The Sheriff's are citing LE confidentiality (they don't want to give me the evidence to sue), DOJ is citing I need to do a live scam and PFEC per 11120 through 11127 PC... I only have a year till it expires anyways.

5:50 I know EXACTLY where you would use it, because I am doing that right now...in a child molestation case, where the plaintiff alleges a violation of Cal Pen 647.(7?). This statute in interpreted by the courts as requiring an abnormal sexual interest in children, so an examination of def through a penile would determine whether or not the def has that.

The lawyer tried to use the procedure cheat in the police intentional false arrest and imprisonment without due process. I filed without lawyer and did not go aggressive but keep low profile what ever it comes. Finally in November 2018, the lawyer is going to have to deal with disciplinary actions. The lawyers play game but did not check his actions so going to have to see his issue for defamation and unprofessional conducts.
