As at the time this gentleman came into UK, laws are not as stringent as the are now. I think there is more to this story.

He should go to a Citizens Advice Bureau, and explain himself. He needs to be honest so that they can advise him accordingly! If he is being honest then his first wife would not be in the UK, she must remember that.
I have seen many in similar situations due to complexities of their immigration status but not as bad in that they could still carry on working while the matter was being resolved.
From the brief info I heard, whatever happened between him and his ex-wife, it seems he is trying to maintain contact hoping he would be able to use the daughter’s birth to help process his application. The problem is although daughter was born in the UK and may be 10yrs or older, she still has to go through immigration process which mum would need to go through on her behalf to get her citizenship and if this has not been resolved then he would need to try getting on good terms with the wife to get this resolved to benefit all of them.
