What is the creamy layer?
It is a concept that sets a threshold within which OBC reservation benefits are applicable. While there is a 27% quota for OBCs in government jobs and higher educational institutions, those falling within the “creamy layer” cannot get the benefits of this quota.
Based on the recommendation of the Second Backward Classes Commission (Mandal Commission), the government on August 13, 1990 had notified 27% reservation for Socially and Educationally Backward Classes (SEBCs) in vacancies in civil posts and services that are to be filled on direct recruitment. After this was challenged, the Supreme Court on November 16, 1992 (Indira Sawhney case) upheld 27% reservation for OBCs, subject to exclusion of the creamy layer.

Sir, क्या खुद किसी govt job में कार्यरत व्यक्ति Obc non creamy layer का सर्टिफिकेट प्राप्त कर सकता है? जबकि व्यक्ति खुद सरकारी नौकरी से 8 लाख से ज्यादा सालाना कमाई कर रहा हो मगर उसके माता पिता की इनकम 8 लाख से ज्यादा की नहीं हो।

If your parents are not now. Definitely your parential income is not more than 8 lac... You deserve NCL category definitely with out any Income certificate. Issued by govt..

@@digitalknowledge1122सर please answer. हमारे फादर और ग्रैंड फादर दोनों ग्रुप-सी में थे लेकिन OBC नहीं बनवाया था और सामान्य वर्ग से ही चयनित हो गए थे। लेकिन अब हमारी तीसरी पीढ़ी को OBC-NCL बनाने की जरूरत पड़ रही है आजतक में पहली बार।
हमारे फादर ग्रुप-सी सेंट्रल Govt. में सिलेक्टेड थे और अब 50 साल बाद ग्रुप-बी में प्रमोट हो गए हैं और उनकी सैलरी 8लाख से ज्यादा है।
लेकिन govt. employee होने के बाद भी ऑफिस में उनसे 8 लाख से कम का इनकम certificate मांगा जा रहा है। ऐसे में क्या करना चाहिए?
मेरा सेलरी से आय 14 लाख है , जवाहर नवोदय विद्यालय में पी जी टी पद पर है,क्या मेरे बच्चे को NCL का फायदा मिल सकता है या नहीं।

Sir income from other sources jo ITR mein aaya hai wo 8 lacs se jyada hai iss saal ka, pichle do saal ka 8 lac se kam tha, bank mein gpf ke paise ka interest se income from other sources iss saal ka 8.5 lacs ho gaya.
