Any way you look at it he pointed and fired a live round at her killing her and injuring the director. I did as an armourer Most actor don't care what you have to say, they play candy crush, talk on phone, doing Instagram, I once even have an actress pick up a glock and take selfie while I was giving a safety briefing. it's always the Armourer job to maintain safety in the set w.r.t the firearms on set. If things like this happen, you told the production company and tell them you are going to quit if this is ongoing. And you never, EVER leave your firearms out of sight, all those are the armourer fault. Producer don't keep a tight set, you did.

Most actors are not firearm experts...their job is to act...they hire pros to make sure the guns are safe and not with live rounds.....this is the fault of the prop managers.
Not true. Hes not the director and the assistant producer plead guilty. The actor isnt allowed to unload the weapon. They have an armorer for that. Its his responsibility to make sure its a proper cold weapon.

That gun can't be fired unless the trigger is depressed, pulled, held down when the hammer is released, etc. They need to ask him why he pointed the gun directly at her when that is not normal practice while filming movies.
I am a nurse and if doctor prescribes fatal dosage of medication and the pharmacy dispenses it, then I administer it, I am actually more guilty than all of them. My behind is on the line. I can't say it is the doctor's fault.

Brandon Lee's case was an actual accident. The prop gun malfunction, a piece broke off, and that's what killed Brandon Lee. The actor that had the weapon, was devastated. I don't thi k he acted for a very long time.

Candy Stripers deliver mail and flowers, not meds. Nurses are required to check meds. Actors are safety trained and they have a duty to observe the armorer checking the gun. Baldwin, as producer, is responsible for not managing safety. He knew the gun was supposed to be handed to him by the armorer. Baldwin is liable.
No one mentions the fact that not only did Baldwin pull the trigger, he was also the producer of the movie. He was responsible for everything that happened on that set. That doesn't change the fact that the producer bears responsibility for what's happening on his movie set, there were multiple, prior incidents of guns being shot on the set, and several crew walked off the day prior due to safety concerns. Baldwin was aware of all of these incidents and issues and did not address them, but kept on filming. A jury will decide if he bears responsibility for his failures that led to her death.

Hannah Gutierrez was responsible for the bullets, and there's testimony that Hannah sent an email requesting to use the guns for target practice with live bullets on her time off! She was denied, but I believe she did it anyway, which is how live bullets got mixed in with prop ones.

Bottom line, it's the armorer's fault. Her whole job was to oversee the firearms on set. That was her job! They trusted her and she claimed it was a cold gun. I mean, just by looking at her, I would never trust her.
She didn't shoot anybody and wasn't even there. Doing a job poorly is a reason to be dismissed, not prosecuted. Someone else, Assistant Director Halls, was acting in place of the armorer in handing the revolver to Baldwin. He pleaded to a misdemeanor.
The job of an armorer is to inventory and maintain firearms, and she did that just fine- Baldwin's gun didn't get lost, and it functioned exactly as designed. Armorers are not RSOs (Range Safety Officers). And even RSOs are not responsible for crimes committed by someone else. The armorer wasn't even present when Baldwin killed his victim- he kicked her off the set beforehand. Baldwin chose to violate every single basic rule of firearms safety, pointed a loaded gun at innocent people, manually cocked the hammer all the way back, put his finger on the trigger, and pulled it, killing his victim through his own negligence, in violation of New Mexico's Involuntary Manslaughter statute 30-2-3.

Since the guy giving Baldwin the gun has previously been found guilty, the above question is already decided. The prop man loading a live round is legally responsible either way. Edit: for Baldwin, being an actor, a gun he is handed on set is merely a prop, not a weapon. I think it's perfectly alright then to apply laxer standards than you would to a policeman. My personal suggestion is that the movie industry fire anyone on the spot who brings dangerous unmodified ammunition to a set.
Baldwin is gun-proficient. You can assume that much. But how about actors and actresses who in private wouldn't touch a firearm with a ten-foot pole? Would they know how to check and where to look? But they would be just as liable! I don't think it works that way. Something you can't do yourself you should be able to delegate, which is what Baldwin did. Prudent actors will outright refuse to play parts involving guns under these circumstances.
Isn't there a system of checks and balances when weapons are used on a set? I seem to remember an actor being interviewed about this shooting very soon after. I think he said there are three people who are supposed to check a weapon---the armorer, the actor, and someone else?? Maybe the director or assistant director? Is there a props director on a movie set? It seems like that's a good system that wasn't followed that day.

Im a firefighter , even though I send people to check on stuff I always check it before I use it because if stuff doesn't work or I kill or let someone die cause of it , its my fault not the people I sent to check on things

After hearing the lady guest say that there had already been a few incidents of actual discharges, Alec should have made sure he asked the directors to check the gun for ammo, even though they said it was cold. There should have also been better safety protocols after what had already happened before the shooting. I find this case to be a tough call between guilty and not guilty due to the facts that the directors told Alec the gun was cold, but accidental actual discharges had already happened before this. And many actors who hold guns during filming don't have much knowledge about guns and firearms. Directors and producers are supposed to be more responsible about safety than the actors.

I think most people would believe an armourer paid to check the weapons are not loaded and safe for filming use prior to them using it. Unfortunately as the producer and user of the weapon he has responsibilities should things go wrong on a set with real weapons. However, I feel that this is more of a work related injury and fatal accident than involuntary manslaughter.
In fact, Actor’s Guild policy states that actors are responsible for safety, along with everyone else. from the SAG Safety Bulletins: “As an actor you are ultimately responsible for your own safety and the safety of your fellow cast members. Production management and crew are responsible for creating and maintaining safe conditions, but it is your right and responsibility to double check the set up to ensure your own safety.” But even apart from SAG rules, if state law defines certain conduct as criminal, mere work rules cannot negate law.

If things like this happen, you told the production company and tell them you are going to quit if this is ongoing. That doesn't change the fact that the producer bears responsibility for what's happening on his movie set, there were multiple, prior incidents of guns being shot on the set, and several crew walked off the day prior due to safety concerns. Baldwin was aware of all of these incidents and issues and did not address them, but kept on filming. A jury will decide if he bears responsibility for his failures that led to her death.

Bottom line, it's the armorer's fault. Her whole job was to oversee the firearms on set. That was her job! They trusted her and she claimed it was a cold gun. I mean, just by looking at her, I would never trust her.
She didn't shoot anybody and wasn't even there. Doing a job poorly is a reason to be dismissed, not prosecuted. Someone else, Assistant Director Halls, was acting in place of the armorer in handing the revolver to Baldwin. He pleaded to a misdemeanor.
The job of an armorer is to inventory and maintain firearms, and she did that just fine- Baldwin's gun didn't get lost, and it functioned exactly as designed.
Armorers are not RSOs (Range Safety Officers). And even RSOs are not responsible for crimes committed by someone else.
The armorer wasn't even present when Baldwin killed his victim- he kicked her off the set beforehand.
Baldwin chose to violate every single basic rule of firearms safety, pointed a loaded gun at innocent people, manually cocked the hammer all the way back, put his finger on the trigger, and pulled it, killing his victim through his own negligence, in violation of New Mexico's Involuntary Manslaughter statute 30-2-3.

Baldwin is gun-proficient. You can assume that much. But how about actors and actresses who in private wouldn't touch a firearm with a ten-foot pole? Would they know how to check and where to look?

They are so desperate to charge Baldwin but then again Who put the bullets in the gun..its not like Alec 'intentionally, loaded the gun to kill someone'...its just a mess! Have to see whats going to happen next. Sad for everyone involved and especially the family and the Victim.

The comparison to the cop is a bit unreasonable. She had extensive training and should be held to a higher standard than civilians. Alec is definitely responsible for killing that woman as well but they are not the same situation at all.

Crew members quit because of safety issues before the shooting happened. Baldwin was the producer and was responsible for everything on the set.

Baldwin was not handed the gun by the armorer. Instead, he was handed the gun by an assistant director. That is against SAG safety protocol, and one of the things which was done wrong on this film set.

I think there is something to be said for him being a producer and using safety measures. The facts are: The gun was improperly loaded with live bullets by NOT Alec Baldwin PERIOD. He had no clue. So definitely no mal intent. Negligence perhaps.
Negligence + inherently dangerous items (firearms, whether or not you think they are loaded) is enough for the elements of this criminal charge.

There IS an Involuntary Manslaughter crime in New Mexico, a crime that Baldwin committed by choosing to violate every single basic rule of firearms safety, pointing a loaded firearm at innocent people, manually cocking the hammer all the way back, putting his finger on the trigger, and pulling it, killing his victim through his own negligence, in violation of New Mexico's Involuntary Manslaughter statute 30-2-3.

After hearing the lady guest say that there had already been a few incidents of actual discharges, Alec should have made sure he asked the directors to check the gun for ammo, even though they said it was cold. There should have also been better safety protocols after what had already happened before the shooting.
I find this case to be a tough call between guilty and not guilty due to the facts that the directors told Alec the gun was cold, but accidental actual discharges had already happened before this. And many actors who hold guns during filming don't have much knowledge about guns and firearms. Directors and producers are supposed to be more responsible about safety than the actors.
Quit calling it a prop gun. It was a real gun not a prop gun.

The problem with the Defense Attorney's argument is that Baldwin wasn't an "actor on the set," he was a producer & director on the set who helped hire the people he's claiming are culpable. This is open & shut. GUILTY.
Its only 18 months what a wimp. Bill Cosby did more time and he did not kill anyone let alone shoot two.
Alec is not guilty. the person who prepared the gun for him did not prepare it properly by checking to see if there were bullets in the gun. This is so clear.
He is responsible in my opinion. They should not have been using live ammunition in the break. There should have been any live ammunition anywhere near the set. As director, he was obviously aware of the safety issues. Alec knew others had walked off because they were not happy, he should have checked the gun himself.
It took them all the way to the end to get the expert opinion that mattered. He was a producer and responsible for the overall conditions on set that led to the tragedy.

I think most people would believe an armourer paid to check the weapons are not loaded and safe for filming use prior to them using it. Unfortunately as the producer and user of the weapon he has responsibilities should things go wrong on a set with real weapons. However, I feel that this is more of a work related injury and fatal accident than involuntary manslaughter.

In fact, Actor’s Guild policy states that actors are responsible for safety, along with everyone else.
from the SAG Safety Bulletins:
“As an actor you are ultimately responsible for your own safety and the safety of your fellow cast members.
Production management and crew are responsible for creating and maintaining safe conditions, but it is your right and responsibility to double check the set up to ensure your own safety.”
But even apart from SAG rules, if state law defines certain conduct as criminal, mere work rules cannot negate law.
From the moment this story broke I thought someone connected to this movie production hated Baldwin and planted live ammunition on this set.
Some people including actors themselves, think that laws don’t apply to them. Just because they’re famous.. doesn’t mean they’re infallible.
If anyone else would have been charged for the same reason then he should be but if he was given a gun that he was told was safe and had no odea it would have a real.bullet.then the person that gave him the gun should be charged.the perwon tgat loaded tge gun and held it and handed the gun is responsible!
