Attorney, wala pa kaming titulo, Tax Declaration lang under the name of my late father. Ang kalahati ng lupa is napamana na sa kapatid ng father ko a very long time ago at namatay na din. Ang nakatira is mga pinsan na lang namin and their children. Gusto na namin ipangalan sa amin yung lupa lalot may Estate Tax Amnesty ngayon but how?
Con't. Subdivided in the 60s and started selling the lots. The owner who is an IP remarry to an IP also when her first husband died in the 60s . Its only the second husband had it titled in 1974 , eventually some buyers had their lots titled but mostly didnt process their title even until the death of the couple owner. Its only in 2016 that children of the second husband filed for heirship when one buyer approached them that he want his lot titled. He financed the EJS nd other fees but when they submit their papers for titling to ROD they were rejected coz they wanted that the 20 lots in that approved survey plan should also be processed. So the heirs approach us other buyers to process but since we have to change the deed of sale nd the heirs now as the sellers. But our problem arise when the heirs charge us signing fee per square meter. We buyers had some problems like lost of original deed of sale signed by the dead owners. Some also who were 3rd buyers or bought from 2nd owners and were not able to get the original copy of the DOS from the 1st buyer. Since we didnt agree to their demand of 1k persqmtr for those no original DOS and 1850 per sqmtr for those with no documents like DOS and payment reciepts. Since we didnt agree for their high demand we try to settle at barangay then we were endorsed to the Lupon. Now we are waiting for 2 meetings at Lupon after that these heirs will file cases . We dont know what case they will against us. We referred to some lawyers who said that they dont have the right to demand skyrocketed amount as signing fee. We can pay any amount as thank you fee .if they sue us can they eject us, coz they said they will process the title in their names. Can they do that when we live in the area from late 60s nd we are paying the realty taxes?
