mam....I filed visitation rights under Sec 9 case but i still not get visitation rights due to wife not present till date after expiry of 7 dates (11 months). What action be taken further...?

My mother died and father done second marriage iñ district court....the prof of marriage is agreement of marriage in court and nothing done is that legal marriage please reply father also died

Kindly refer the following case *Shanti Nigam v. Ramesh Chandra*, where it was held that a refusal to quit the job at the instance of husband cannot be ground for passing degree of RCR. In case wife allows free access of herself and there is no reluctance on her part to perform her conjugal duties, then it is very clear that she has no intention to desert the husband and it will not be a case of 'withdrawn from the society of the other'.

then there shall be divorce, and the party shall not get maintenance
If spouse proof that other is in adultery.. As u have said... But now adultery is not a crime.. Than how it would be a reasonable cause under article 13?
Adultery is not a crime as far as criminal law is concerned. But adultery will remain a ground for civil issues including divorce.
