section 6 of the hindu minority and Guardianship act provides that a natural gaurdian of a minor is his father and then the mother , so ordinarily the custody shall be with the father , however if the child is less than 5 years old as in this case the custody would be ordinarily with the mother. This is the general rule but the court at the time of granting custody, takes the welfare of the child as the paramount consideration u/s 13 of the said act , ie even if the child is below 5 years old and the court believes that the mother wont be able to maintain the child properly , it can grant thr custody to the father
