If he'd had an ounce of sense and honestly wanted to put a foot in the gaming business, he should've investigated his home State's tax incentives and tried to find out how feasible it would've been for him to start his own games studio. It very briefly worked for 50 Cent (who wasn't exactly smarter in his handling of his likeness), so it could've worked for someone with enough capital and a few advisers on board.

Emulation has been around for a long time and people like him ruin it by trying to profit on it. These people preying on the ignorant that can just do some research and get all this themselves on a low powered pc or even a raspberry pi. I actually like Nintendo doing this to scatter the roaches like him. Either way emulation is not going anywhere. While i'm not saying piracy is ok, there are plenty rom/iso sites that still exist and will continue too with the increasing popularity of VPNs. One goes down, another goes up, it has always been that way.
