  • Daniel Barnett is LBC's resident lawyer and he takes an hour of calls each week on legal issues, offering advice and counsel. But he was not prepared for caller Sam, who came up with every excuse in the book to justify faking a doctor's note to get a company car.
It's an instant classic on the Legal Hour. Do you think Sam's employer was in the right?

I have ADHD. I can’t sit still either, so I get up every now and again, have a quick wander round the office and answer a few emails on my phone while I’m standing somewhere else. I listen to music on my AirPods to block out background noise & I have a million phone reminders set to remind me to do boring life admin tasks. He speaks about it like it’s on a level with really serious disabilities. I know it’s a spectrum and others are more severely affected than I am but this guy just sounds like a nightmare. His employers sound really nice, they’ve given him a chance & tried to be accommodating and now they’ll never hire anyone with ADHD again thanks to this guy.

But if the child experiences the trauma at a young age then their emotional growth is extremely stunted

Let's say I take my ipods with me to bed, and for some reason I would have to take them out suddenly and put them somewhere, and then briefly do something else, I won't remember where I put them the moment I'm looking for them. ADHD is all about building habbits. In this case I always place them in the exact same spot. Same with keys (which I have found in my fridge a couple of times) But I won't forget that I own ipods. VERY simplified example.

The only thing about this I disagree with is that a standing desk can make a massive difference to someone with adhd's productivity. My colleague sits down and really struggles to stay focused in any way, but when standing he is an exemplary engaged member of the team. He broke his leg a few months ago in a bike accident and yet still chooses to stand at times to help his focus. Having the ability to stand and sit gives him the ability to control his own focus levels and do his job to the best of his ability.

The caller needs help that is not just legal. He needs help to realise that while employers should make reasonable adjustments we (I am Aspi) also need to try and adjust. It is difficult for us, and sometimes we need a mediator to help us see how we might be problems. Sam has obviously not understood this.
In the past (I am 68, so I have had a lot of that) the onus was on us to adapt. No adjustments unless somebody liked us and our weird ways, which has happened in my life, and then they realised how dedicated we can be. Today, both sides must make adjustments, and that is fair. ADHD, Aspis etc, we cannot expect all the adjustments to be coming from the neuroconforms. So, coming back to the beginning: this guy needs some counselling sessions, and then to start afresh in another job.

Sounds like he was being serious, a lot of people in the uk act like this.
Likely not a troll, too many people are taught since they have adhd they can do whatever they want especially with how education system is engraving this point into them now.
I worked with a guy who got sacked since he was allowed a few short break due to his adhd and then went on them every 10minutes and did no work. He also said about the music thing (something a lot of schools teach them) but he wanted to listen to mumble rap and stuff no one else liked.
      Sorry for the essay.

Lol Daniel has no idea how serious ADHD actually is and the way he treats this guy is unacceptable. ADHD is literally genetic brain damage/defects. If someone had a car crash, they could literally end up having ADHD like symptoms if the damage is in the same area.
LBC needs to do better than being straight up ableist live on national radio and you can bet I’ve complained to ofcom. Not that it will change anything but still, you’re ridiculous for doing this

But the caller needs help that is not just legal. He needs help to realise that while employers should make reasonable adjustments we (I am Aspi) also need to try and adjust. It is difficult for us, and sometimes we need a mediator to help us see how we might be problems.

The Equality Act needs to do a LOT more to protect disabled and neurodivergent people at work and throughout the job application process. It puts us in awkward positions around declaration all the time and makes us responsible for all the justification and legwork. He shouldn't have faked a doctor's letter but the rest I totally get.

People that fall under the ADHD Autistic umbrella, Do not know what is wrong with them
all other conditions have a root, where the doctors says that's gone bad we will treat that part and because we know what that part is and what it does we can determine the consequence's of that part being wrong
Medical profession tell me what ADHD is , "we dont know"
Medical profession tell me what Autism is "we dont know"
Which means there no definable aspect's to both difference's , The Doctors don't even know if its actually something that's gone wrong
And because the Doctors are all taught to be cortices worshippers and worship the left PFC , then discovering what something is that's nothing to do with the cortices is going to be an issue isnt it ?
Cant break the LEFT PFC delusions

This dude might not be explaining himself well, nor is it reasonable to fake having another disability to not disclose your own, but my word this host knows nothing about ADHD. One of the most frequent recommendations for ADHD workers is a non-restrictive workspace, like a standing desk. This guy might not be doing things right, but that doesn't excuse the host, or any of these awful comments, from demonising ADHD as a "lazy" disorder.
