    Thankfully we don't have these where I live. It sounds like a mafia with extra steps. You should be able to freely choose to engage with them reguardless of where you live. Afterall you are either free and own your property or you don't. Further community isn't something artifically created by threats of regulation and fines, it either exists or doesn't. Finally all this talk of communities and property values sounds a lot like the racism of the 50's ie not in my neighbourhood. Truely sad.

    Soo what exactly is the penalty for ignoring an HOAs bylaws. They are not a government entity. Its not as though they can press legislation.

    • @chocolateccm
      @chocolateccm 3 ปีที่แล้ว

      They can fine & sue you! It sucks, but there are severe penalties for breaking those rules.

    • @NAT-di9xw
      @NAT-di9xw 3 ปีที่แล้ว +2

      @@chocolateccm Ah. Ok. But sue you based on what grounds exactly? What government mandated laws can they sue you over for violations of their local arbitrary rules?

    • @chocolateccm
      @chocolateccm 3 ปีที่แล้ว +1

      @@NAT-di9xw Just like any legally binding agreement, homeowners and HOAs legally enter a legal agreement that state and local laws recognize upon signature of both parties. I read that HOAs brought a lawsuit against a homeowner for failing to adhere to vehicle regulations.
      The homeowner did an oil change on her property (which is forbidden) as a result it seeps down the water supply-- contaminating water in the community. The CC&Rs which stands for Covenants, Conditions, and Restrictions outline rules and expectations that both parties must abide by. If you do a google search, you will find cases of HOAs suing homeowners for planting flowers, oil change, evicting or foreclosing people's homes for unpaid dues, or for not following the CC&Rs. It should be avoided to prevent these unpleasant outcomes.

    • @NAT-di9xw
      @NAT-di9xw 3 ปีที่แล้ว

      @@chocolateccm So does one enter into a agreement with an HOA simply by buying property in a location with one? Or is there some type of official paperwork you have to sign to join one? Sounds like you would want to avoid joining one at all cost. And is there anyway to beat HOAs in court?

    • @chocolateccm
      @chocolateccm 3 ปีที่แล้ว

      @@NAT-di9xw There are some cases where people have bought homes in an HOAs community, and signed the CC&Rs without reading or fully understanding the overly restrictive community they’ve joined. However, to enter into an HOAs one has to sign the CC&Rs paperwork, but some communities have an automatic membership once you purchase the home.
      Buying a property wherever does not always mean you are entering into HOAs. The HOA is usually very noticeable: as they are typically a gated community, with very limited access points, the houses and layout are similar if not almost identical, and the name of the community is at the entrances. I ran into one yesterday as I was trying to get a contract, but it was a senior community where the homeowners are 55 and older.
      Simply put, if you see a beautifully coordinated community that’s clean where the homes are very similar-it might be an HOAs community. It’s best to ask the realtor before making a decision or simply let them know you are not interested in any HOAs communities. I find them to be ideal for rental properties and public outdoor facilities such as parks, pools, athletic fields, and the like. Some homeowners like it has it keep or increase the value of their properties. It’s good for sustainability and safety within a community, but it’s not for every homeowner.
