Your being able to prosecute the police later on, often requires that you have money available to pay for that. Many people do not have this money and whilst there are public defenders, they address the criminal charge, not necessarily the lawsuit later on. That doesn’t justify resisting in this scenario though.
The legal system extends such courtesy to a police officer's honest mistakes, but they can't extend the same to a citizen whose only error was panicking for being falsely arrested.

It was a lawful arrest. He committed a traffic offence and was pulled over. They thought he was a felon, we’re concerned for safety (proved right as he had a gun) and it is well established police can order you out of the car. Basically, uniform cops are not taught the techniques of an investigation. They throw around the words "my investigation" without having any idea about the methods of an investigation. I trained officers in the techniques of investigation and an arrest should not enter the equation until facts are learned and there is probable cause to make an arrest. Most calls and complaints can be resolved without making an arrest by knowing how to investigate instead of puffing up and end up to make unnecessary arrests, usually false. Bad cops become the adversary before they ever arrive on the scene and find out the problem. Unless the responding cop requests backup, other cops should not arrive at the scene. If and when backup arrives, the backup keeps his moth shut and listens. All too often the backup escalates the situation. Watch the videos for what I have pointed out.

Once you talked about him losing his job, place to live, and possibly his children, I could not help but cry. This happens all the time. Whether real or not, often an individual will lose everything dear to them this way. It is disheartening to know that due just one individual's use/missus of our legal system can destroy everything you love and need to survive. Yes, it also happens due to poor choices made by a person as well. However, that is not what I am referring to here. (Or not completely so)

The problem with fighting an unlawful arrest in court, is that it costs, money, time, and effort. In the meantime you might be out of a job for months, while he cops still have theirs, while you wait for the court sessions date to come around.

You are never at more risk that when the police have screwed up, they will do everything in their power, they will go all out, to charge you with something, the courts, police, prosecutors (and so on) will all be aware of what's on the line, and will put enormous effort into your prosecution.
They always go chips all in because of egos, and reputation in department with peers, similar to military platoons. Only time you can change things usually is when a cop is alone, then sometimes you can get reasonable with them.

The City is the one pushing it though, they are the ones losing money in the court cases after all. If the police can find something, anything, to make the issue 'muddy' then the following civil court against the local government is a lot harder for people to win. As a Norwegian I am appalled by the lack of communication and de-escalation skills I see in the American police force again and again. Had they just told him why they wanted him out of the car when they first asked, he'd likely be more understanding of the cops' situation. I mean, are they afraid that he's going to just act out? If that's what they're afraid of, they obviously got that from him, by not communicating to the guy why he's being detained.

That cop went in his window opening his door demanding he get out & detaining hilm from the start. All he asked was “for what” &cop went hands on. Your being able to prosecute the police later on, often requires that you have money available to pay for that. Many people do not have this money and whilst there are public defenders, they address the criminal charge, not necessarily the lawsuit later on. That doesn’t justify resisting in this scenario though.
The legal system extends such courtesy to a police officer's honest mistakes, but they can't extend the same to a citizen whose only error was panicking for being falsely arrested.

Basically, uniform cops are not taught the techniques of an investigation. They throw around the words "my investigation" without having any idea about the methods of an investigation. I trained officers in the techniques of investigation and an arrest should not enter the equation until facts are learned and there is probable cause to make an arrest. Most calls and complaints can be resolved without making an arrest by knowing how to investigate instead of puffing up and end up to make unnecessary arrests, usually false. Bad cops become the adversary before they ever arrive on the scene and find out the problem. Unless the responding cop requests backup, other cops should not arrive at the scene. If and when backup arrives, the backup keeps his moth shut and listens. All too often the backup escalates the situation. Watch the videos for what I have pointed out.

The problem with fighting an unlawful arrest in court, is that it costs, money, time, and effort. In the meantime you might be out of a job for months, while he cops still have theirs, while you wait for the court sessions date to come around.

You are never at more risk that when the police have screwed up, they will do everything in their power, they will go all out, to charge you with something, the courts, police, prosecutors (and so on) will all be aware of what's on the line, and will put enormous effort into your prosecution.
They always go chips all in because of egos, and reputation in department with peers, similar to military platoons. Only time you can change things usually is when a cop is alone, then sometimes you can get reasonable with them.

What DavyLordy is pointing out is very much part of the system. The City is the one pushing it though, they are the ones losing money in the court cases after all. If the police can find something, anything, to make the issue 'muddy' then the following civil court against the local government is a lot harder for people to win. If the cop accepted responsibility, which dismissing could be considered a sign of, then the civil case would be a lot easier for the innocent parties to win.

The reality is that even if the charges are bogus, most people will lose their jobs, they will ruin careers and it will take YEARS to get justice. Two years after the incident just to initially file civil rights violations, who knows how many more years it will be delayed. This man deserves MILLIONS in backpay.

He wasn't resisting an unlawful arrest. He hadn't been arrested. He was resisting a lawful order to step out of the vehicle. He should have exited the vehicle (for his own legal protection). The thing the cops did wrong was get the wrong name, and then escalate ridiculously fast out of fear that he was dangerous.

As a Norwegian I am appalled by the lack of communication and de-escalation skills I see in the American police force again and again. Had they just told him why they wanted him out of the car when they first asked, he'd likely be more understanding of the cops' situation. I mean, are they afraid that he's going to just act out? If that's what they're afraid of, they obviously got that from him, by not communicating to the guy why he's being detained.
All they had to do was talk to him, run his ID properly, and they could have just let him go.

If the arrest is unlawful you're only resisting a kidnapping.

When I worked as a loss prevention officer, you were fired if you did one bad stop. Police should be held to the same standard.
That cop went in his window opening his door demanding he get out & detaining hilm from the start. All he asked was “for what” &cop went hands on. Cops think by going at a citizen at 10 max and not explaining things is just ok and not going to get push back. If a cop slung my door open demanding me to get out and detaining me id ask the same thing but i was arrested on a old traffic warrant couple years ago and i asked her to please reconsider(she treated me like some criminal over a traffic ticket) and she took that as i was resisting when all i did was stop n ask that question. She pushes me onto the cop car on my chest then conducted her search of me but you could tell she was pissed bc she “thought” i resisted all bc i asked a question🙄. Cops are so ego driven the second you question there authority they flip to max! Just like this cop did to this man. Which escalate the situation

What I think is crazier is how much of this could be avoided if they cops actually did their job right and conducted an actual investigation from the beginning.
