    Should you buy a tax Lien or feed with an llc?

      It's a good idea to protect yourself by using an LLC. The LLC must be in the state in which the property is located, or it will be useless, however, the LLC that owns the property can be owned by another LLC. For example if you want a Nevada LLC for anonymity, the Nevada LLC can own a Tennessee LLC which owns property in Tennessee.

      Hello, LasVegasGames is right about wanting to protect yourself by setting up an LLC. And if you plan to invest very much money it will be worth it for just the protection. If you are just buying some cheaper liens to test the process, you can try putting them you name. For example when I first started 20-years ago I bought my first 2 tax liens in my own name. The tax liens we only $127 and $292 dollars - so I was not a large investment. Because its just a lien, you are not responsible or own the property. So you don't have the liability as if you owned the property. But if you plan on really investing then it will be important to get an LLC set up. Thanks, SJ Swenson

    I lived in Florida and won an auction bid, I purchased it for 2,600 and the value is 8,000. I was advised I can't sell it until 4yrs. Is there a way I can go around that? How can I sell my property before the 4yrs waiting period?

      Hello Davon, well in some ways that is true but let me explain a bit first. When you buy the property at a tax deed sale you are buying the property with a clouded title. That does not mean you do not own the property, or even that there is liens or judgments attached to it. But it does mean that you will receive a non warranted deed like a tax deed, quit claim deed or sheriffs deed. Most property is sold with what is called a Warranty Deed that is warranted by the county the title is clear. When the county sells a tax deed, it does not want the liability so they offer the property as a tax deed. The tax deed give you full ownership rights but you do not get a warranty deed. So you have 3 options. The 1st option is waiting the 4 years in Florida until the property is eligible for a Warranty Deed. The second option is hiring an attorney to go through was is called "Quiet Title" so you can get a warranty deed. Going through Quiet Title is an expense so you will need to evaluate if the cost is worth it, depending on the properties value. And the 3rd way is selling the property "as is' using a quit claim deed. You could try contacting the surrounding property owners and see if they are interested in buying it. One thing about this 3rd strategy is you will need to offer the property at a big discount because you are selling it without the warranty deed. For example, I would contact the neighboring properties by mail and let them know you are selling the property. I would let them know how you bought it and you are offering it to them at a highly discounted price. So if the property is worth $8,000 and you paid $2,600 then you could offer it to them for double what you paid and still make a good profit. So if you sold it to them for $5200 you would double your profit but still give it to the owners for a highly discounted price. But other then getting quiet title your best option is selling it wholesale. Thanks for your questions and let us know if we can do anything else. Thanks again, SJ Swenson
