      No, the government still has to let you know they are going to do it before they do it. They have to notify you first. Them just tresspassing on your land is illegal.

      If nothing else they should have notified the local fire department incase it got away. I lived in an apartment yrs ago and the maintenance department decided to do a sewage repair outside my window about 8 am without having the utilities marked and started digging about 2 feet from my window. They broke a 3 inch gas line and ran away without even turning off the backhoe. I woke up and smelled the gas and ran out the front of the building. My friend and I walked 3 blocks down the street to a convenience store and on the way back about 1/2 hour later I walked across from the store to the firehouse where the people were sitting on benches and asked if it was safe to return home. Nobody had reported the gas leak and they rushed down there and evacuated the entire development until the utilities were cut off. They told me that gas leak was big enough that if it blew after leaking so long and the buildings were made of red brick it would have destroyed 90% of the homes within 2 miles from fallout. When the fire department got there most of the people were still sleeping in their apartments.
      It's always important that these people inform someone before they do something, even controlled fires incase it gets out of control.

      If nothing else, I would demand they inform at least the fire department weeks ahead to be prepared, get a lawyer and force them to give notice in advance from now on.

    I would 100% pursue it. The government will just do whatever they want if you dont stand up for your rights. It's your right to not have them tearing up your private property.

    So many comments here that you may never see this. I am a Registered Professional Forester in California. I have lived, worked, and went to college in Michigan, Indiana, Ohio, Wisconsin, and Oregon. I have not worked in Oklahoma and do not claim to know the laws and customs there. You don't seem to know what governmental agency did this or what agency controls the land. You need to know that. It makes a difference.
    It appears that the burn got away from them and they ran a dozer land at a flat area that just turned out to be an existing road. From that line, they tried to backfire with varying amounts of success. It does not appear that they ran vehicles to the creek for water.
    If it was a client of mine (or on my land), I would write a formal letter to the agency. It would specify that there was concern that there was no post fire notification or attempt to remediate damage. It also might be noticed that the dozer work opened up unwanted access to your parcel.
    For you, I make the following recommendation. Contact a forestry supplier such as Nelson Paint Co, or Forestry Suppliers and obtain PURPLE boundary paint. Mark trees on your line such that there is no doubt that there is a property line. This will reinforce your postings and make sure all comers know they are entering restricted property.
    On a final note, had positions been reversed and a fire on your land gone on to "public land", there would be hell to pay.

    If anyone came on my 54 wooded acres that I live on and did anything, I would be mad as heck and would be pursuing charges and restitution for any damage, including damage to trees! Furthermore, you fought in the Marine Corps, Dutch, for our freedom and rights under the constitution, and they shouldn't get away with doing whatever they want on private property!       @@quebecpatriot1874I guess you are the one person who would advocate for the fire services to notify you before they go onto your property and pour water on your house as it burns. Maybe your kids are left at home while you’re out grocery shopping and you forgot and left your phone at home. The house is on fire and one of your kids is missing and presumed to be trapped inside. Using your train of thought the firefighters have to get your permission to enter your property to put out the fire and to cause property damage to break down your door and go in to rescue your trapped family member. I don’t care if a fire is planned or not if it gets out of control I’m not going to fuss about the fire crews in a rush tearing down my fence to plow a fire break. It’s just not reasonable to delay entry onto a property to fight a fire to wait to do so until you can contact the land owner.

    They work for us and they have NO right to trespass in your property for ANY reason. Sue them for everything you can get. They tried to destroy it. No!     There have been multiple cases where failing to contest a trespass resulted in a decision that the property owner had voluntarily granted a public easement. It's sort of the flip side of "adverse possession", if you don't defend it you eventually discover it is no longer yours.

      Exactly. The police are a government agency, but they can't violate your rights while doing their job. It looked like initially you were upset. Now you're easing up on them. If someone did something wrong, they should be disciplined. Maybe next time they won't do that.

You may not like it but you would be the first to sue if your house was on fire and the fire department delayed fighting the fire until you give them permission to do so. The way Dutch showed us it appeared as a controlled burn that got out of control. It happens. I guess you would want to be notified every time your neighbor did some yard cleanup and was burning their refuse. It’s not feasible to delay fighting a fire until the land owner is notified. And any damage done should be covered by homeowners insurance. That’s why everyone should have a HO policy.

    When a controlled burn starts to burn into areas which were not planned to burn, it creates an exigent circumstance. That exigency creates a situation where they are allowed to not only come onto your property, they may perform any tasks necessary in order to control the exigent circumstance, in this case the controlled burn fire which likely began off your property.

    Suggestion: find a retired Stop sign at the scrap yard or talk to the local public works (they are constantly replacing & scraping damaged signs). Mount it to a tree next to where the fire break crosses your property line, 6-8 feet high and put no trespassing and private land signs below it

    You never let a government agency on your property because they will make up any reason to take it from you or not let you use it. All they have to say is they saw a spotted owl without proof of anything, and then you can't log or build.

    I live in Montana and when they do controlled burns here it is on Forest Service land not on private property. Now during a forest fire emergency they will go on to private property and cut a fire break but they do their best to notify property owners.

    I have a feeling that it was possibly a controlled burn that went out of bounds. That they had to get control of.. I am a former wild land firefighter with cal- fire formerly known as California department of forestry and fire protection. I have a degree in prescribed burn. I'm not 100% familiar. With your area of the country. But I know that usfs (US Forest service) does partner with land owners to do prescription burns. It's actually good for the environment. It eliminates invasive plant species and helps other plants germinate because their seeds cannot germinate without fire. And the carbon is good for the land . But what do I know. I only have 3 masters degrees one in para medicine. Masters of fire science. Forestry management and prescribed burn.

    Yeah but they need to be put on notice for not asking or telling you it was happening. It is yours, they busted thru fences, uncool. If you did it to public or private land that's not yours, they'd sue or charge you with a crime....

    I'm 1/6, owner of 320 acres . ( hunting club). It's fully fenced and posted. We let the person we bought the land from run a maple syrup operation on the property. He keeps the trails open and keeps a close eye out for trespassers. I would call and have them replace the fences .

    The State/Federal Government CANNOT take your land under the Constitution's Taking Clause without proper compensation. 'Taking' is not just using your land for Public Use, but also accounts for the taking of your Use of the land.
    Not only did they trespass they damaged the land affecting how you can use the land. Reach out to the Institute of Justice as they just won a very similar case against the state of TX

    I 100% agree with you. Your ownership should be respected! You should have been notified. The destruction of your fence should absolutely be their responsibility to fix. You know if the table was turned things would most likely be a whole different thing.

    Just my opinion…… it was not a controlled burn. On a controlled burn , they advise the landowner and if they do a controlled burn, a lot more of it would have been burnt. Dutch, I don’t believe they just leave a note! I believe they have to contact you in case the burn gets out of control! It is a huge deal! I agree with you! Protect your family. If you don’t, no one else will! I could go on and on.

    You have to be advised when they are wanting to burn so you can make sure you have your homestead prepared if that controlled burn turns into a wildfire because it is known to happen. That is a pretty poor firebreak. I can see branches and brush able to easily cross the gap.

    They would at the Very Least be Fixing my fences after all Good fences make for Good Neighbors. The Government is Seriously Overstepping Their Authority when it comes to land owners rights and the ability to grow our own food. GET A LAWYER.

    Was it a State Agency? County? Forest Service? It is all different. The only way a fire should be on your land is if a burn get out of control, they were sloppy about this or it was a mistake. This was a mistake because there is way too much liability starting a fire on your property without permission. When you find out who exactly did this, be sure to at least send a registered letter , them follow up in person and meet with the head of the agency. They need to at least reimburse for fence damage or if access needed for fire fighting Federal land, they should put in gates, that can be locked with a combination lock. They can contact you for access or by agreement so no one who shouldnt have combination won't. Id worry about creek access from the clearing . That is going to give you issues.

    Here in Texas, the weather conditions (temperature, humidity, wind speed, amount of rain fall, etc.) are so difficult to meet that controlled burns are darn near impossible to do! We had a government biologist work with us for several years, and at NO TIME did we meet the criteria to do a controlled burn.

    I would first check to see if they made any public announcements like a newspaper ad, road signs, PSA on the radio, etc. if they didn’t, I’d be pretty angry. Private property rights are fundamental to our freedoms as Americans! Good luck!

      YES, they should have contacted him. It was a big no-no to go on his land without prior notification and a pencil necked geek needs to be reprimanded. I would never buy abandoned land that backs up to a government property without having a long polite conversation about any plans and expectations. The USDA plans these burns up to a year in advance and knowing how they work, either it was probably still listed as an abandoned property and a notice would have been sent to the previous owner's address. That being said, the USDA has a website showing all of it's scheduled burns.

      I would sue them for infringements of our Bill of Rights and Constitution. This is illegal search and seizure of private property. They need a warrant. He needs a good lawyer.

    In Canada, the only leased land that the government can do a controlled burn, May be done on Provincial or Federal land. Being a lease tenant, I would appreciate a notification, beforehand...

    I use to work for forestry & we had to have paperwork & look at property map before doing any controlled live burn & no they can't come on your properties without a emergency, they can't burn on u.

    Unless the main forester was there then I'd say someone gave the ground crew the address or told them where to go into the property at,but there's no excuse for tearing down fence or going past 'no trespassing' signs without permission or it being an emergency.

    I agree with you on knowing who is coming onto your property. I have had vehicles with out of state tags (mostly from CA) coming onto my property when it is posted with several signs saying it is a "DEAD END ROAD, PRIVATE DRIVEWAY, NO TRESPASSING, NO SOLICITING". I dislike looky leures.

      @@Tetelestai.John19.30 I know. But the folks who took down the fence should not have assumed that is the case. If it was a single wire fence, the maybe they assumed that. If it was a 3 or 4 wire fence, making the assumption that there are no animals is risky.

    Great having the controlled burn, but I agree, they 100% need to be in communication with private landowners in preparation for the field work to be done. This is a pencil-pusher problem, not the folks in the field doing the work. At a minimum they need to make it right for the destruction of your fencing/gates/signs along with a promise to do a better job of communicating.

    My dad in Eastern Oklahoma had it happen to him. Mail notification was mail to his separate property not where he lived so he didn’t get it. He was mad too but found out it was for fire control. Government has rights to create fire breaks and roads.

    Just a suggestion... it ought to be fairly easy to install wire insulated fencing which triggers an alarm which could alert you, if it is severed, that us if you are in cell or range of maybe a neighbor's wifi

    Look into purple paint laws. You can paint some trees and mark them as private property. You now have a road anyone can use to access your property

    Nope, I would have been at their office the next day. It's not okay for them to bull doze through your fence that is obviously marked private property. 😡 Give an inch they take a mile. What if you had plans to build a house on the property and they totally just trashed your plans. Or they're doing a controlled burn and it gets out of hand? We just had this happen a couple weeks ago here. My friend's house burned down due to their negligence. To add to the insult they were sound asleep and woke to banging on the door. It was the police department telling them they had to evacuate immediately. No chance to get anything. The winds were blowing 30-45 miles hour with gusts to 60 miles hour. This is not okay at all.     Having anyone show up unannounced, especially when you aren't there, is an incredible legal issue for the land owner/tenant because you are liable if something happens to them!! Destroying your fences or any other property is definitely a problem!!
