      @@drantil That's because promotions no longer happen based upon merit. Promotions are now actively encouraged strictly upon ideology and gender, and skin color (not whyte mail, you get the promotion). You can see the result for yourself. You can be near absolute certainty, that detective never earned the rank.

    I was in a horrible car wreck with my cousin a while back and when I woke up from being unconscious there was a firefighter trying really hard to save our lives and a cop just standing there questioning us with 0 attempts to help us. Firefighters are heroes police are gang members looking for a reason to kidnap someone.

      Police officers are, as far as i know, not required to give medical aid... even in life threatening situations. they just need to call emergency services. I think that is their legal requirements only.

      Absolutely and he also had to retire due to a diagnosis of PTSD. Everything they did will escalate that and would cause damage to his health for years to come - that’s even if you ignore the physical damage he did that required surgery to fix.

    The firefighter was probably affected by a HUGE rush of adrenaline and experiencing an emotional reaction to the situation. Finding a man bleeding to then beginning to perform CPR and to then have law enforcement officers treat him like this…yeah, that’s all bound to have profound effect on him. He was trying to save a life…these officers were more concerned with protecting their egos. Disgusting.

      People who become cops almost always have the same reasons for it.
      1. They were bullied as kids and want to get even.
      2. They were bullies as kids and want to keep doing it.
      3. Georgie and Dim
      4. They want to 'make a difference in their community'.
      The last one is the reason most of them give, but it rarely seems to hold up to scrutiny. If they really wanted to make a difference, they would join internal affairs and weed out all the cops that joined for the first three reasons.
      I will prefer private security over public security 999 times out of 1000.

      And that's going to show up in court, if the city doesn't settle. It's *very* clear who the aggressor is here, the situation was calm and being handled professionally. The retired firefighter of course knows how this has to go, so he's giving a statement where he's been asked to stand and then this detective asshole rolls up and starts yelling about "his" crime scene. There was no reason for the detective to act like that...none. It's certainly not the firefighters fault, he's doing what he's asked. And it's completely over the top that this detective asshole actually leaves the crime scene. further escalates the situation, goes hands on and injures THE WITNESS. At the very least the detective needs some retraining and probably some anger management counseling, or really probably should not be packing a badge and gun.

What the detective did where to dehumanize the witness, escalate the situation towards a person witness something traumatic, and potentially cause the witness to not give any statements. I have been in lecture for psychological first aid, and you simply cannot dehumanize someone who is in distress

    Everyone who’s done CPR knows how tiring it is and how one person can’t continue to do it effectively for more than a couple minutes. It stops being life-saving. So the fact that the other cops just left the one person to keep doing CPR on his own while they questioned the bystander is disgusting.

    I was a career firefighter. Two problems exist here: 1) Heightened stress due to a severe traumatic incident occurring. 2) Accidental but potentially serious interference with a major crime scene.
    Now I’ve had LEO’s trample through my Arson Investigation scene ruining evidence even though they were trying to help. I wanted to yell at them……BUT……when anyone (in this case the OIC of the crime scene) begins to ADD stress to a situation where everyone is on the same team simply trying to help….stuff goes sideways.
    The detective should have kept his mouth shut, pulled an initially responding cop on scene to the side and then asked “what” occurred and why a civilian is in the middle of the crime scene….period.
    In turn the firefighter should have tried his best to maintain his composure and calmly responded or totally ignore the detective and only spoken to the officer that was interviewing him.
    But the key here is that the retired FF is a civilian…and the expectation is for the police detective to maintain a professional demeanor not only out of courtesy but also based on his department’s policy & procedures. Detective deserves an F. The firefighter deserves an A simply for trying to do the right thing.

    As a nurse, I will also say that administering CPR is a traumatizing event for the person giving it. Adrenaline runs high! This detective just escalated things for no reason.

Hospital workers aren't granted qualified immunity, firefighters aren't, what about Garbage collectors? Would it not be reasonable to extend that to Garbage Collectors, they are more than 50x more likely to be killed by a civilian than an officer so is it not reasonable to extend the whole "cops have a reason to react harsher because they have a dangerous job" to a Garbage Collector who shoots a man dead after seeing him reach into his pocket and shouting at him? Because Immunity protects that for officers. No all people should be held to the same civil and criminal standards as anyone else. Anything other than that and you risk abuse of that Immunity which is what modern day policing is.

    This is a good example of why I became a firefighter and a paramedic. It was not in my nature to want to use force against others. The longer I served, the less respect I had for police. I doubt half the police could certify in the training necessary to being a firefighter paramedic. Most police officers were bully types that got off on using force and authority on other people simply because they could. I got my satisfaction on seeing the difference I made in people's lives.

      I’ve been realizing exactly what you just said… good guys that want help go into EMS or fire, bullies that want to flex go into LE. I’m sure it’s a generalization and not always true, it seems to be mostly true and it seems to become more true every year.
      Cops in my county just voted AGAINST bodycams… again….
      I’m not sure why they’re the ones that get to vote on it, im going to have to start going to council meetings I guess… these same cops approached me a total of 28 times in 18 months of playing Pokémon on my phone a few years back… kicked me off public sidewalks, public university campus which my wife is alumni and my personal fav was looking up to see a black and white suv with lights flashing, no siren tho, as it dipped off road and drove thru 2 different soccer practice fields that were in use by kids, in front of literally hundreds of parents and kids… I knew he was headed straight towards me… he claimed they received calls of “a homeless man wondering the fields”, “a crazy man talking to trees” and “ a man hiding in the bushes looking at kids”…
      Thankfully other parents came over and defended me, I was just stretching and walking around, when I asked him to repeat what the he accused me of he was too embarrassed to even try and said “we had multiple calls about you!” As he was backing away and trying to get in his suv to bug out.
      I was so embarrassed, my daughter was 8 and she couldn’t stop laughing when I filled her and the rest of the team/parents in about what had happened, she finally caught her breath and explained to everyone how much they like to mess with me, she thought the “crazy man talking to trees” part was just too funny to her. She’s been witness to like 10 of their attempts to bully me and knows I’ve not been arrested once out of all that mess… now she has no respect for them and I worry she’s drawing the attention of the school resource officers, there’s 5 at her school… 5 cops at a middle school all day everyday…wtf…

What a terrible, misanthrope with ZERO concept of how to approach a scene and investigate what's going on prior to making decisions. It's mind boggling how we just can't seem to get rid of these kind of people from public safety. It's so frustrating for both citizens and good officers alike to have to deal with the consequences of this type of garbage behavior.

      I was more pushed up after giving cpr BEFORE my PTSD. I became a tyrannical monster if someone fucked up during that. I reduced a charge nurse to nothing because she took the succion apperatus from the crash cart. Nothing that I am proud of.
      I learned a lot of lessons due to my PTSD. Mistakes can be made and are something that I can use as a productive teaching lesson.
      But we are not talking about mistakes here. We are talking about misconduct and behaviour that makes you unfit for your profession.
      Pretty sure I would snap in his situation.
      Thankfully I dont live in a counrty where Police officers know less about CPR than our 12 year olds and behave like 9 year olds with guns.

    As someone with cPTSD I recognised that the retired firefighter was in a trauma reaction state before he said he had PTSD. He did well, and it's so sad he had to endure physical damage to his body from the police. I suspect the other layers of damage done to him from this encounter will have been harder to rectify. I hope he is doing well. x

      I don't buy that he's a firefighter, at least not one that wasn't fired. He walked it back with the PTSD excuse. Firefighters are generally respectful and professional with cops. This guy was all adrenaline and belligerence from the get-go. Very unlike any firefighter I know or have met. In fact most departments carefully screen out hot-heads. If he was helping at first; he quickly became as much a part of the problem some of those cops.

      The *FIRST* thing a cop should do is *FIND OUT* what is going on.
      This may involve the DIFFICULT job of asking questions and then STFU while LISTENING TO PEOPLE who are already there, and who may have IMPORTANT INFORMATION which the cops need to know. A cop should never *REFUSE TO LISTEN* to people.

    I'm an ICU nurse and have called and preformed and responded to innumerous codes and preformed manual CPR countless times. It is something that puts your adrenaline through the roof for even a trained professional, especially after when the immediate crisis his stabilized. It is mandatory that we leave the floor for at minimum 15 minutes before we return to treat patients due to being in a cortisol dump. The firefighter responded much better than I would have being confronted so aggressively after just being in a life and death situation. Instead of having the situational awareness to realize a fellow first responder in this situation this cop let his ego and emotions dictate his actions. Exactly the opposite of what this retired firefighter did. This is the difference in being a professional and being a clock puncher. Hopefully this "hero" cop learned a valuable lesson as the next time it may result in serious bodily n harm to himself, a victim or another first responder.

      Video is highly misleading. Nobody got “arrested” here, the firefighter got detained for having an explosive outburst with a detective at a crime scene. Firefighter says at 9:25 that he’s struggling with PTSD, so I think that’s why his behavior was pretty aggressive. With that, I think the cop had reasonable cause to detain him due to his aggressive behavior and knowing the victim was lying in a pool of blood on the ground. You have to understand that they’re all unaware of who shot the victim, so even if the firefighter isn’t making any direct threats; his aggressive demeanor got him rightly placed in cuffs for further examination. Cop gets an “F” but the firefighter also gets an “F”. This was two hot heads popping off at each other when both should have been working together to focus on the victim

    For people wondering in August of 2023 the city of Santa Paula settled the lawsuit and agreed to pay $325,000 to Garces. Detective Rivera left the Santa Paula Police Department in June of 2023 and is now an officer with the Baldwin Park Police Department.

    I’m a retired cop and the detective is the only one who is escalating the situation. Detective Rivera is an embarrassment to law enforcement. He should lose his job and be potentially charged with an unlawful seizure. I hate watching these videos because most officers I know never acted like this. This detective doesn’t deserve to have the authority given to him by the city. He should be stripped of that authority due to his out of control actions. Shameful behavior by the detective.

      My mom's a nurse and she doesn't stop for car crashes anymore for this reason. Twice she's had issues with the cops or EMTs while trying to administer aid as a first response. The minute anyone with government issued authority shows up they treat you like a criminal or an idiot.

    I don’t understand how the officer was awarded qualified immunity… I would understand if the retired firefighter was just lingering around after and all over the crime scene; but he was actively being questioned by another officer. The officer was trying to take his statement and ID him… Literally would have been in the wrong had he “left the crime scene”… Then the other officer comes up being aggressive and demanding he leave because he was contaminating the crime scene… Then he proceeds to physically assault him and dislocated his shoulder… That is well outside the realm of what qualified immunity can cover. He used excessive force against someone who was compliant and not resisting. There should have been NO force used… absolutely ridiculous.

      I dunno about that. Anyone who can post bail will be right out from jail, and it takes years for the trial process before any individual is imprisoned. And that's prison, not jail, that I believe you mean. Because after an initial arrest and bail hearing, just getting an indictment or conviction can be several appointments in the court, each a different step in the process, and each having several months between steps.

      @@bolt8148 I think it depends on where you live, and no not everyone can just post bail. Even if you have one, you either have to have the means, or family that would be willing to put it up for you. Other than that, you're screwed. Where I live, these crooked ass politicians always look out for each other. We have several cases of ex detectives and officers getting charged with evidence tampering, and get off with slaps on the wrist. We even have a case where a detective was selling the weed that was confiscated from criminals, but was only given a sentence of probation. Shoot now and question later situations by cops are almost always justifiable homicide, so yeah, the cops are in a club that the public is not in. And at the end of the day, they look out for each other rather than the public; even though it's the publics taxes that pay their salaries.

      He was never even told one way or the other until he was already in the car. He was assaulted from the start and then as usual they tried to run interference and build a narrative after the fact. Basically every cop on scene was involved in a direct civil rights violation, and under title 18 U.S. code 241-242 it could be construed as conspiring/gang activity considering the amount of cops on scene and how none of them made attempt to end the violations, which by default makes them complicit.
