    What if you have a Bona Fide Determination from a U visa application and you’re not immediate family, but also filed a i130 can you wait?

    For the sibling category… does my country of birth or nationality hold a significant advantage? I ask because I hold an Indian passport, but my place of birth is Greece. Would really appreciate your response. Thank you.

    My brother just file a petition to sponsor me under f4 catogery.
    My question is, What are my chances to get visit visa while waiting for the petition to be approved? ??
    I am regular visitor to the UK, since I studied there and do return to my home country after a month in the UK. 😊

      Once you apply for an immigrant visa, it makes it harder to get a visitor visa. And living in a third country also makes it harder. Good luck, Jim

    I have an ETA Visa Waiver passport to come and chill in the US, 3 months at a time. Can my US Citizen bro sponsor me, and me, while hanging out in the US, file for an EAD to work in the US and pay taxes until F4 is current? Straightforward question.

    Hello , Posting comment first time and requesting your guidance.
    My sister is US citizen and when she filed I-130(Brothers or Sisters of US Citizen) for me at that time I was in US with my wife and kids. She received I-797A now and need to file I-824 for me as I moved to Canada. Can someone help on the below:
    1)In I-824 Part 2 she chose 'USCIS to send my approved Visa Petition to the NVC' and my details(beneficiary) in Part 3, then whether she must also file my family(wife and kids) details in the 'Dependents' and 'Foreign Address of Dependents' , so that USCIS send immigrant visa request to NVC for my complete family?
    2)What additional documents need to be sent to NVC in addition to I-797A, filled I-824 form and the I-824 fees receipt ?
    3)What would be next steps for getting immigrant visa for me and my family, will NVC/Consulate in Canada process immigrant visa for me, my wife and my kids together?
    4)After reaching US post getting Immigrant Visa how long will it take to get Green Card for my entire family?
    Requesting you to kindly suggest so that we can proceed accordingly... Thank you in advance.

    It is interesting that the USCIS website says an average of 35 months average to process the case, is this different than waiting for the Visa, correct?
    Also, can we speed up the process by requesting help from our representatives in Congress?

    My wife's F3 petition was current now from the NVC and she was here in the US along with our siblings with H4 visas who are her derivatives. I myself was also had a current F4 petition from my sister , came here with H1B but out of status. Is there a chance to adjust her or our status here in the US?

      Hello and thanks for your comment. They are currently processing cases that were submitted back in 2008, that means that your priority date is not current yet. You can check on that periodically by looking up "Visa Bulletin 2023".

      @@HackingImmigrationLawLLC hi there but from what I saw from uscis processing times. It will depend on uscis field centers for example if your case is in Nebraska field office it wont that long is that correct? And it could take 22 months to approve it?

    Your blood brother or sister is a sibling. You can't get anymore immediate and direct than that, and in most cases, you have a closer relationship with your siblings. There is something WRONG with the people who wrote this act into Immigration law. It should be unlawful and in point of fact, be considered a Human Rights violation. Immigration should be processing these sibling applications as fast as possible! I know I wouldn't want these people here 15 or 20 years later when they're looking to retire and become a burden on the system. Hell no. I want them here as soon as possible to get them qualified and working, and paying taxes into the system. They have this shit backwards.

    If I was applying for a visitor visa and I told the interviewer that I want it to be a refugee in the U.S. , would I ever be accepted?
    please, answer me in the comments section, I've been learning English & saving money to run from my country, I have no rights here as a Christian & some guys wanted to harm me for speaking my opinion about their religion, but, I'm hiding now, they can't get my information, but, I wanna speak freely! and that means harm
    I'm also not allowed to adopt a child, cause my country forces the whole nation to follow Islam's laws. I have plenty of reasons, but, these are the latests.
