      I find it very confusing how people would speak about free speech benefits their agenda for point. But free speech goes off the table when you're annoying 🤨🤨🤨🤨
      Well anyway something kind of like this happen to me that I thought I was very much Justified. But because every single person is in a minority they sided with the other guy and said it was free speech even though it very much wasn't 🙄. What happened was that a guy was yelling multiple racist slurs against me and then threatening me. And then when I said something back to him he got aggravated and pissed off so he started to come at me so I shut them up. And I was told that I was in the wrong for doing what I did. Because racist slurs are okay because you know cares 🙄🙄🙄. But then if I was to call your wife a B or you white 🗑. That's not ok.... I find this whole thing very odd and confusing that if the other person can understand your point of view then it's okay even though they're not going to look at the situation as a hole

      It wouldn't have happened this time, sure. But this delivery driver was unhinged. He likely would have gone on to shoot someone else later on during some other altercation.

    One important thing to remember about this is that the video does not start at the beginning of the encounter. The "prankster" followed the driver and stared at him in an intimidating way for 90ish seconds before approaching. That kind of behavior is almost guaranteed to put someone on high alert and definitely contributed to the driver's reaction.

      Thanks for this detail, Doc. It makes a difference and likely contributed to his defense. A minute and a half of being watched and followed would certainly elevate anyone's concern and anticipatory anxiety. It doesn't meet the standard of stalking, but could be considered harassment, menacing, and the period of annoying contact has a reasonable potential to be interpreted as a bizarre prelude to assault. Fair guess the jury understood it this way and acquitted him of the greater charge.

      Well sadly prosecutors will charge someone with 10 extra things to hope something sticks, and there are a lot of laws on the books. So many laws no one person can keep up with them, yet ignorance isnt an excuse apparently.
      Anyway if you are following the law to the letter, sometimes yeah you might get convicted over something dumb or idiotic.

      Thing is, he thought he was defending himself. He actually did but in the wrong way. The problem is, he used deadly force where a deadly threat did not exist. If anything, he was facing a threat of ordinary force. Pepper spray or a punch in the face would've been more appropriate.

      I do agree, even so. That guy was way taller, 250+ pounds, and on top of that he had two other guys with him.
      You dont typically wanna scrap with someone who is bigger and stronger than you, and has buddies, if a fist fight breaks out, they can take your gun away easily with numbers, or beat you to a pulp. He could have pulled out the gun though but not shot to get them to back off though, and I’d have considered that reasonable.
      A threat of a weapon is usually enough to avoid physical violence. If they didnt back off after seeing a gun in his hand, then they deserve to get shot via Darwin award.
      Still… I dont think I’d convict on a jury.

Tho we, after the fact, know the outcome, what other videos have we seen when 3 guys surround/follow someone and they cannot just wait to be attacked first to stand a chance. Force multipliers get tricky. If they were criminals trying to isolate him then hurt/rob him, the pepper spray would escalate and not do much against 3 except provoke revenge response.

    John I felt I needed to amend your description of the encounter: Yes, the guy is bigger than him and sticking a phone in his face however, he has accomplice right next to him AND the camera guy who is clearly with them behind him; so effectively surrounded by these guys. The TH-camr is more than a Morron he was probably a bully in school and now TH-cam has a allowed him to become a professional bully. Despicable.

      As someone who was robbed almost exactly like this. One guy talking to me while the other punched me in the back of the head. Id definitely feel as though something bad was about to happen with one guy trying to distract and the other two lingering around behind me, even if one just has a camera. Think about how many fools video recording themselves commiting crimes

    2 points to be noted:
    1. Another man who was simply trying to make a living for himself and family, now has his life ruined by another person seeking fun.
    2. Anybody that stares another down and proceeds to harassment is a NATURAL bully. These are people who proactively seek out the weak and vulnerable to carry out harm, just to gratify their ego. They always leave trauma in their trails.

      That legally justifies the use of normal force (strike, shove, pepper spray), not deadly force (gun, knife, etc.). There is not remotely any legal or moral justification for use of deadly force in the scenario as presented in the entire history of Western Jurisprudence all the way back to Biblical times. There is simply no legal or moral justification for how the delivery driver acted in this scenario. You can’t just shoot someone because you’re scared of them if they don’t actually provide an imminent threat of deadly force; you’re the defender, not the attacker. You can’t give in to your irrational fear in these scenarios. When you do give in and use grossly disproportionate force (deadly force in a normal force scenario), you have just made yourself the attacker.

    The reason I sympathize more with the delivery guy is that the "prankster's" actions were so strange they couldn't be put into any harmless "box". Is this guy selling me something? No. Is he asking for directions? No. Is he warning me about something? No. This guy is aggressively invading my space and I can think of no legitimate reason.

    Bottom line: the delivery driver is NOT a threat to society. None of this would have happened had some big goon not gotten in his face and relentlessly pursued him while he attempted to retreat. (and don't forget there was a second guy too) He only fired one single round from what appears to be a "mouse gun". Small sub-caliber pistols like that are often described as "get off me" guns and that was exactly what the delivery driver wanted. That said, I do wish he had some kind of pepper spray as a less deadly option.

    The guy is 6’5” and probably 250+ lbs. if you’ve told them to leave you alone and they continue to pursue you, there has be be an equalizer to protect yourself. He asked politely, he pushed the phone away and then the next step is a physical altercation. It was absolutely justified.

    As someone who has been on two criminal trials, how you live your life matters. This guy 100% got off because the aggressor was a huge a**hole who part of the jury thought deserved it.
    In my manslaughter trial, the jury was hung by one person simply because the victim was a huge bag of d**ks and the perpetrator was a likable young kid turning his life around.

    The self defense jury instruction says that if self defense is raised as a defense, the jury must find beyond a reasonable doubt that the accused was not acting in self defense in order to convict. Obviously this is a very high standard.
    Secondly, John keeps referring to the money this guy is having to pay for his attorney. Let’s face it, he is a delivery driver probably struggling to get by. He likely had a public defender.

    Don’t forget there were 3 people surrounding the food delivery driver. The “prankster” and his buddy and the guy holding the camera. He had plenty of reason to believe that 3 dudes surrounding him might do him bodily harm and they would not stop antagonizing him.

    When I saw this video I was floored. I was sure the shooter would get 10-20 in the pen. I was even more shocked when the jury didn't do that. This IS the perfect case for OC.     This guy pranked me and my coworkers while we were just trying to do our job. The comments on the video sucked to read because they all thought it was funny. We didn’t find it funny; however I did laugh at this one. Probably his best work to date.
