It may be perfectly normal for a person of say 70 or 75 to be unable to balance on one leg, and to show some reluctance to try. As we get older it is normal that the cartilage in our joints shrinks. This can particularly affect the bone to bone spacing in the knee joint. When that spacing becomes very small (e.g. I am 68, my Xrays show a very small spacing of about 1mm) and extra force is applied, such as standing on one leg or bending forward, the bones touch, and you suddenly loose flexibility in the knee and there is sudden discomfort. The consequence is sudden loss of balance. When this starts to happen you also become cautious of this action, as knee bones grating on each other is sometimes painful, and can result in joint damage and continued pain and swelling. If anti inflammatories are not enough you typically need physiotherapy, which is a matter of concern on a seniors budget. Also, it may shorten the time until you need a knee replacement.
I can't walk straight without my cane and I stagger slightly at times even with it. What does that have to do with my cognizant thinking or ability to drive? The cop now has started me on an expensive, time consuming, life interrupting, highly anxious time. The heart rate & blood pressure are going to be elevated! I don't drink and other than meds, that most people my age are on, I don't due drugs. But I'm now guilty until I can, hopefully & expensively, prove my innocence! All because a badge thinks he knows everything and that they are doctors. Most barely know the law! I don't want a cop jabbing a needle in my arm for a blood draw, nor any other things they are allowed to do, because the feel they have a right to do it. The whole thing is one sided, because they're digging for evidence of guilt, so they shouldn't be a allowed to run the tests. The Police have way too much authority and they are not fully trained to do medical procedures, nor half of the other things they get away with! Sorry for the rant.

This is indeed a slippery slope. In my case, I suffer from degenerative disc disease and have had 3 discs replaced in the last 7 months. And because of the issues with my discs, I have MANY prescription drugs onboard. In my opinion, these drugs do not impair me as I'd be worse off without them. That said, I limit my driving just to avoid such complications. It's best to err on the side of caution than to waste a ton of money in the courts!!
Because it's subjective, can you refuse and just agree to urine test? What about if have a physical impairment, for example you were in an accident and you have a fake hip and one of your legs has a steel rod in it with a locked ankle? You will fail even if you were stone cold sober. Are you exempt from the subjective test?

If you need to pay a lawyer and a toxicologist to prove your innocence you lose anyway. The criminal justice system is a lose lose system.
