Recent subscriber saying I really enjoy your videos! Not enough Canadian Content in this area available out there! Your videos are to the point, just the right length and full of valuable information. I do not drink but I would love an episode (or series) about the implications of a roadside test (at holiday time or otherwise) where the officer thinks they smell marijuana and what happens if there is 0.0 BAC involved? Thanks

Didn't the Supreme Court of Canada agree last week with a case in Quebec that prohibits Police from pulling a car over without cause (DUI checkpoint excluded), thus shutting down the pull over for "safety" check?

      R. vs Ladouceur. They can. The Supreme Court of Canada is one of the main forces of erosion of Canadian freedoms. The judges just do not consider a traffic stop as “a search” or “a seizure”. So freedom of speech is not absolute, so remaining silent should not stop the police interrogation, so not having a lawyer present during interrogation does not violate the Chapter. Everything is for the sake of “public interest”.

@@sircorn4248 OP is referring to a case in Quebec in which something extremely rare occured: a court of first instance (in this case, Quebec Superior Court hearing a s.24(1) suit) overturned Supreme Court precedent (in this case, Ladouceur) and declared arbitrary stops unconsitutional (in this case, on account of blatant racial profiling by police)
of course the Crown appealed, and last week the Court of Appeal of Quebec confirmed the lower court ruling
it hasn't hit the SCC yet but it's headed there, and in my view Ladouceur is very likely to be overturned
the original case is Luamba v. Attorney General of Quebec (2022)

During a DUI checkpoint. Do we have to talk at all?
Do we have to do the eye test or walking test?

I am on PGWP (applied status) Does conditional dischagre have any impact when i will be filing my Permanent residency application. I was charged for Criminal harassment and uttering threats. The crown offered me a conditional dischagre rarher than a peace bond.
