This is exactly me. I had a multiple qualifying injuries i n 1984. I filed for disability when I mustered out of the Army in 1987. I never heard back on the claims. After 36 years of continued issues related to those injuries, I filed again in Dec 2022. When filing, I found a letter from 1988 denying the original disability claim. I never received that letter even though the Army had my address. In the new claim, I was approved at 60% (so far) for other injuries but was denied again on 2 of the original injuries. I've filed an appeal and requested a CUE claim to have it backdated to 1987 since I never received the original denial letter. I never had the chance to appeal the finding.

Thanks for the information, it was very succinct and enlightening. I have a question. What if a veteran submitted a claim in 2011 for flat feet and arthritic knee and was denied. Later the veteran finds out that in their service treatment records there is a copy of a medical entrance examination that clearly lists a diagnosis of pes planus mild bilat asym (flat feet) and a radiologic report stating that mild patello fem djd and small osteophyte of the iknee. Both of these documents were in the record when the decision was made in 2011. Could this be a CUE?

I need to file a Q.. almost same situation..just recently found out I fractured my lower back long ago from a recent CT scan...it was initially given a 10% rating when I got out for my back issues...I wish they would have looked more into my issues when I was in maybe I would be in better shape today... should I get an attorney or is this something I can file on my own?

ok he said their should be a statue of limitation because there should be a end to claims I say first there should be a end to War.
Hard to argue with this.
I call it FRAUD,FRAUD and more FRAUD. There are no statures against limitations on Fraud, same as Murder.
