I was diagnosed in early 2020 for sleep apnea, had two improper conducted test in 2012 after getting out of the military in December of 2011. When I claimed it in 2022 they claimed no diagnosis dispite being issued a sleep machine due to the 52 per hour
Im still at 60 percent, starting with 20 percent in 2009. My psychiatrist filled out a Nexus letter for my ptsd and I submitted it both first and second time, but I got denied. I have migrane and taking 2 meds. 1 for prevention and 1 when it actually occurs. Same thing denied along with my anxiety, depression and mood swings, diabetes, high blood pressure, erectile dysfunction, and spine pain that goes all the way to my leg. I get a cortizone shot every 3 months, acupuncture, and choropractic services every 2 weeks, but it's just temporary relief. With the migrane and spine and leg pain, I'm almost crippled and can't do anything, and I have the records and been diagnosed by my doctor, but guess what, Im denied. All of this for the second time submitting my claim. 2 some years ago, I got me a lawyer and been on docket for that long to meet the judge. Im 65, and sometimes I'm losing hope. Sorry for the venting.
This is the 3rd time I am trying to type this. Everytime Social security cuts off and I loose the message. I was diagnosed at Salt Lake VA Hospital with Sleep Apnea, in 2008. I receive my C-PAP machines from SLC VA Hospital. I also been diagnosed from a Doctor here in Idaho Falls, VA clinic. I get 10% disability for my hearing, plus new hearing aids. I am tired.
Medical Evidence, Medical Evidence, Medical Evidence. Did I say Medical Evidence?? If you do not have it, there is no attorney that can get you a solid rating that will stick!!! And, if a rating is given, will it pass the follow up in 5 years? As a PA and former Corpsman I arrest that no evidence, no eating.
I'm tired of fighting with the VA my right leg alone has been operating on a total of five times between the knee and ankle if I only put my left leg on it what at 10% even though I lost half the foot which is causing more pressure on my service connected foot . Back in 2010 the judge wanted me at unemployable and told me to apply for depression which the VA in Detroit denied this has caused a lot of problems I'm not able to work anymore my depression is getting worse my ankles have gone worse
Thanks for your video. I claimed GERD & ISB secondary to my 50% PTSD. Denial based on cited literature being “Pathophysiology.” Cause or certainty is not claimed by vet, only an on going aggravating connection or relationship to PTSD. “Pathophysiology” -or- “meta analysis.” Do you know of any precedents to fighting this rational “Pathophysiology” based denials? Defination: Pathophysiology: the physiology of abnormal states specifically the functional changes that accompany a particular syndrome or disease. Correct me if I’m wrong but this sounds like the evaluator is playing semantics in trying to make it sound like I’m claiming that one causes the other which I am not. A doctor I know offered this… Pathophysioloogy is the study of abnormal changes in body functions that trigger disease processes. Metanalysis is the combination of multiple research findings into a larger summary finding. This is different than a single focused research finding but often more powerful and insightful. A denial of your claim on this basis alone is bogus. Get a highly regarded expert to validate your claim.
I have been told that the most you can get for hearing loss is 10%. Have taken multiple tests and the most they will give me is the standard issue hearing aids.
A doctor doesn’t have to say you can’t work. Sometimes doctors think you can, but a vocational rehabilitation counselor, if they say you cannot work, the doctor cannot overrule that.
I'm at 60% and going to have re eval after back surgery, increased migraines (new kinds) anxiety getting worse...and it just occurred to me my mental health diagnosis major depressive and anxiety is not on my disability.
Hopefully service connected and 100% P&T If you get 70 go for getting paid at 100. I forgot what's it's called but if you can't work you can get paid as 100.
I was already rated at 30 percent and I have another c and p in 3 hrs tomorrow im picking up my sleep study stuff to get up to 50 percent..willi I be rated at 50 percent after that. Thank you
So I am getting DIC from my husbands death to Parkinsons. He was in the military for 4 years. I doon't know what his diabolity rate was before his death. He had several things that are now considered, but since he died in September of 2022, can I still submit claims regarding the additional disabilities he had?
I have a C & P exam on 4, Sept. I am already getting nervous. It is for PTSD. I was deployed to Mogadishu, Somalia in 1990. I am nervous. I have heard some horror stories from fellow Veterans.
I went through this, for the same reason, a little over a year ago (August 2023). Look at it this way: if your paperwork is on point, your C&P is your chance to put a face and a personality onto your file. The first two things you need to do is not blow off your appointment and show up on time (that is, 20-30 minutes early). I assumed that I was being observed in the waiting room so I sat as quietly and calmly as I could. When I was asked how I was doing by the examiner, I told her that frankly, I'd been better. Don't go in there trying to put a brave face on anything. I know we've been taught to "suck it up," but that's probably a big part of the reason why we're in the shape we're in now, and this is NOT the time for it. Don't over-dramatize, but also don't lie. Tell The Truth about the effect that military service has had on you...especially if there's more good than bad. If your mental condition has cost you jobs, relationships, and fueled fires that left you smoldering in jail a few times over the years, say it...and provide the paperwork. But again, Do Not Lie. Benefits fraud is a crime. Also, if you give the examiner a reason to think you're trying to run some scam, he's going to say so in his assessment and the VA is going to deny you. As for the examiner...fortunately, mine were polite and courteous but I have heard tales of examiners attempting to provoke vets into losing their tempers, taking the BS personally and giving the jerk a reason to deny you. If you are baited, let it swim on by. You have an objective here, that's proving that you should receive assistance from the VA for the after-effects of having volunteered for the military, being sent to Somalia and subsequently developing life issues had you stayed at home with the 98% of the US population that didn't/doesn't/don't and won't serve. While your examiner isn't necessarily an enemy, neither is he a friend so if you have to take a few deep breaths and count to 10 before you speak, do that. Keep your cool. I know the horror stories are bad, heartbreaking even. I sat in PTSD "groups" with guys who had been fighting with the VA over things they'd experienced in Vietnam when I was learning how to ride a bicycle. I want to end by saying that the two claims I submitted in March of 2023 were both judged and rated by August of 2023 without any hassle or drama because the paperwork was submitted with a ton of proof (copies of my service records and VA medical records) and I treated the C&Ps almost like job interviews. And I'm nothing special. You can get through this. You're going to get through this. And I'm believing for you, that you're going to have a rating of at least 50% "done and dusted" by Christmastime...so be cool. Believe for yourself too!
MDD , Ptsd , Bipolar all MH -- only get one. OSA + Cpap changes 4/00/2025 See FR. CFS goes to 100%. #6 Spondylosthesis. Migranes. Schziophrenia will not be SC. Aggravation of it might be S/C. Anxiety is a penumbra of Ptsd. OSA see above.
PTSD and any other Mental health rating can be rated separately. It depends on the symptoms and the VA rater, who actually knows how to seperate the symptoms, etc.
Good video!

Have you used the CFR 38? That tells you what criteria the Va uses to give certain percentages
@hocfamilytv I'm not sure what that is, but I will research. Thank you

do recent x-rays have sway?

What does that mean on the cpap change and date with it?

Both are mental health
