@@HappilyHomicidalHooligan there was a French comedy show with a famous guest star playing a hippy RN in annold folks home. One of the two protagonists started threatening them saying "I'll tell you exactly where you can shove those pills of yours!" To which the RN replied very passively (but somehow like a homosexual advance) "Promises Promises" while casually flinging his hair.
Now every time the situation you describe is presented, I am reminded of that RN.

In the guitar story, OP is NTA. The seller could have done the exact same research if he cared to get an accurate and fair price. He didn't and that is only his own fault.

I remember another story where OP got a signed guitar for 40$ when it was worth like a million. When he ends up questioning the mother why she’s selling the guitar, she responds “it’s broken, my baby boy was playing a guitar themed game so I gave him this guitar but he can’t play it for some reason, so it’s broken” (abridged). So he ends up buying it, it took a while for the actual worth to get back to the wife and she demanded he returned it back. The real kick in the pants was it was owned on the fathers side of the family and she didn’t tell him she sold it.

It sounds to me he didn’t bother to ask OP, “You’re an expert; can you tell me how much you think it might be worth?” Instead he wanted to sound like an expert and to be able to tell people, “I sold a guitar for a great price!” It’s unfortunate, but it’s his own fault for not being humble.

Case law on the guitar story is very clear. You're allowed to sell something for less than it's worth. And if you later find out that you sold it for less than it worth, that's your fault.

You are correct, but there is contract law that could be argued concerning either unconscionability or unilateral mistake if one party is aware that the other has made a mistake. OP admits that he knew the actual value of the guitar. If OP didn't know, free and clear, but I think the angry a-hole has a case (though admittedly not a great one).

@@sinclairbowman92 Overpriced "luxury" goods are a prime example for undermining your argument. To the best of my understanding, there has to be some kind of malicious deception beyond the usual "getting the highest price for your wares" shtick. Generally some kind of fraudulent misrepresentation (counterfeit goods, undisclosed breakage, or undisclosed missing critical parts), or one side (usually the buyer) completely misunderstanding the nature of the deal (ie you think you're buying a car, but only get a picture of a car) are some of the few things that could make that kind of case viable. Otherwise, it's functionally next to impossible to win the case. The only other way to undo these kinds of deals is if one party was obviously showing signs of mental impairment of some kind that the other party should have recognized.
But I am basing all of this on Canadian case law from a business law course. Laws could be different in DUMerica.

    • @sinclairbowman92
      @sinclairbowman92 6 หลายเดือนก่อน

@@imofage3947 so in America, unilateral mistake, where one person knows of the mistake, makes for a voidable contract. Here, Seller was basing what was fair on what he saw telecasters going for generally online, not knowing this specific telecaster was worth way way more. It’s not that buyer knew he was getting a deal, but knowing that deal was based on a mistake that he knew seller was making.
When one person benefits from the known mistake of another, the contract is voidable. I don’t think it’s dumb that there’s a protection in place so people can’t be taken advantage of that easily. And the $46k he’s out, while it shouldn’t led to his saying such awful stuff, is understandable. It’s life changing money that Seller should have.

Because it is not just buyer beware, it is also seller be aware too. Even if the OP then went on to sell the guitar for some awesome profit, they would still not be the butthole as the seller had every chance to lookup the guitar themselves to know the actual value. The guitar story just shows, if you are selling something which you have inherited, and want to get top dollar for it, you had better make sure you know what it is worth. Look online for auction prices for the exact same make and model if it is a production item, or very similar items if it is one of a kind. If you don't do this, and a buyer pays you the price you are asking, don't complain. You got the price you asked. That's an end to it.

As for the guitar, it was in mint condition, only reason the kid couldn't play it is because playing an actual guitar is completely different than playing a guitar in guitar hero, which karen didn't know, and neither did her "guitar prodigy kid"

if you ever want to see someone who actually played a classical guitar well, look up Charo. The travelling story: I, too, always try to act as a beacon of decency, especially abroad. I‘m German, more precisely Bavarian, and I don‘t like the entitled behaviour of some Germans when on holiday.
At the same time, I once sat in a small tavern in the alpes. We were a group of 5 or 6 in our mid twenties, stayed there for a week long camping trip. This was the only tavern (this word just fits best, maybe look up „Wirtshaus“), so we went there in the evening to have a few beers (we couldn’t just sit by the fire, as open fire was banned on the campsite, so we decided to support the local inn). We got friendly with the locals and the innkeeper, a really gruff, down to earth, Bavarian, one of a kind guy. We were having a great time, when a family strolled in. They were the living cliché of city dwellers out in the mountains. Also, their dialect located them somewhere in north-Western Germany. They were „hiking“ in less than adequate gear and literally bleeding snobbishness. Now, this inn served good, homemade, local food - and plenty. But of course, it tasted not processed (if that makes sense).
This family mocked the old fashioned interior (again, look up old Bavarian taverns), the heavily meat based menu, the dad complained that his Schweinshaxe (knuckle of pork) had 1) too much fat (duh!) and 2) to hard a crust (which is the best part of the dish). They maybe expected Eisbein (which is also knuckle of port, but cooked, not from the oven/grill). They even disposed the beer (from a local brewery, it wasn‘t the best I ever had, but still quite good, and we take a lot of pride in our beers in Bavaria)!
Well, after about half an hour of unpleasant company, the innkeeper had had it. He walked up to them and growled in the broadest Bavarian dialect: „If you don‘t like it, leave. I don’t need you or your money. Get out, don‘t come back and tell all of your friends to never bother me. Now eff off!“ He then took the (still full) plates from under their noses and retreated to the kitchen. The customers were dumbfounded, and we as witnesses of the whole ordeal were nowhere to be seen - we literally slipped under the table from laughing uncontrollably.
After the family left (rather deflated, as they left hungry and could of course still hear us roaring from under our chairs, we literally laughed them out), we had the most amazing time. The innkeeper came to sit with us, some locals showed up, we played some cards and stayed until the inn closed (actually, beyond opening hours). And man, we were jagged when we left - it only occurred to us when we sobered up the next morning that the whole evening cost us about 10€ each. We had food and an awful lot of beer.
When we came back this day (last day, wanted to say goodbye and ask if we forgot to pay anything), we asked what happened. The innkeeper grinned and said (again, broad Bavarian dialect): „I like guests like you lads. You just were great company, enjoyed your time here, complimented my wife’s cooking and contributed to the funniest night this village has had in a while. I comped your bill, but you insisted to give my son [he was about 16 or so and helped serving] a tip for his school trip. Now, a last beer for the road?“
And that was that. Don‘t mess with a Bavarian innkeeper in a small village tavern.
Btw, this happened about 15 years ago, and I still remember it vividly- up to the point I don‘t remember anything at all until the next day…

Story 3. A while back I was a customer in a business and happened to be nearby when this entitled jerk was harassing an employee! I was getting fed up when he pulled the "I'm never coming back to this store again!" Before the employee could respond I shot back at him "I will damned sure be a witness to that, and if I happen to be shopping here and you show up, I WILL see that you keep that promise"! The look on his face was priceless!

First thing about being a good guest, never abuse hospitality, especially if you visit/room with friends/family, and they take you to good places.
Couple of months ago, I visited my little brother, and he took me to this Japanese hibachi steakhouse. We didn't get the Show seats, where you actually watch them cook right in front of you - hour long wait for that - so we went to a different table to, as my brother put it, "Just eat." The meal was delicious. Now, the price of my meal, not including drinks and the like, was over $30. So, I gave my brother $50, because it wasn't just the two of us - as his then good friend (now girlfriend) was also eating with us. Got to make things easier for him you know. Then there was the belated-b-day gift I bought for him. Still, I had fun.

Getting the market value of an item before the sale is the responsibility of the seller. The buyer can take it or leave it, they can tell the seller he’s underselling but they aren’t required too!

That last story really hit home.
My wife and son moved to China for 7 years. When we were in Beijing we had another ending parade of relatives that we seldom saw in the past. One particular and an uncle showed up with just one day's notice. As a result, we are very conscious about our behavior when we travel and stay with family.
I have an aunt and uncle back in the states that we quite like. When we go back they allow us to stay and we always be sure to pay for meals, rent our own car so they're not driving us everywhere, and keep them informed on where we're going and when will be back (and should we stay longer or come back sooner)
Other family members have stayed with the same uncle and Aunt and I know that they do not do the same as us.
I don't have a problem staying with family when you travel, I don't even have a problem with getting a free room from family when you travel but you're supposed to TREAT YOUR HOST LIKE FAMILY! When they pick you up at the airport, take them out for dinner on the way home.
On grocery shopping day, go with them and buy the groceries.
My my aunt and uncle pick us up at the airport and they drop us off. I make sure that that is the largest expense that they have during our stay. Even with everything that we do and pay for it is still so much cheaper than staying at a hotel and I like my aunt and uncle, they're more fun than staying at a hotel. Win win

My family has a story that is kind of like the guitar story. My mom used to collect figurines, salt/pepper shakers, and other pretty knick knacks. My dad was at a garage sale and picked her up a pretty little thing for $10. It was very beautiful and fancy looking, so mom had him take it to an arts appraiser. It turned out to be a Faberge (sp?) egg worth nearly $100k. They took the egg back to the lady he brought it from, explained what it was, then showed her the appraisal report. They offered to sell it back to her for the $10 dad paid for it, but she wouldn't take it back at that price. Her reason? She didn't do the research to know what it was or how much it's worth and dad bought it fairly at the price she set for it. They did, however, negotiate and my parents sold it back to her for $45k. She was having the garage sale to raise funds for a surgery her mom needed and my parents later found out she was able to sell it at an art auction a couple weeks later for $86,500. That was more than enough to pay for the surgery and have a comfortable amount left over.

_I think that money spoils most things, once it becomes the primary motivating force._
    ~John Cleese
I guess one _thing_ that can also be _spoiled_ is people. Now one thing I always say is that it’s not the paper notes that people love, it’s what they represent, or what you know you can turn them in for: nice houses, cars, pools, cribs, party stuff and other material pleasures. The most money hungry people are the most materialistic.

My husband and I lived on an island in the Caribbean. We had several people call and announce they were coming to visit on a particular date. Never did they ask if it was a convenient time or if we wanted them to come. Several complained that we didn't take off work so we could go places with them (we explained it was their vacation, not ours). One guy complained because we didn't have a dishwasher so our dishes weren't sanitary ( I bought paper plates and plastic flatware for him to use). One of our friends took this guy all over the island and the guy complained about the food at the places he chose to eat at and bitched about me all day, but never offered to buy lunch for our friend nor offer gas money (this was a guy working for minimum wage). He told the Spanish speaking islanders they were pronouncing Spanish wrongly (he speaks Mexican Spanish, not Caribbean Spanish). He expected me to take him to the airport. I took him to a taxi stand and paid the cabbie including the tip (he is opposed to tipping). he said he was afraid to use an ATM that was not his own banks. He saw someone he had flown with on the way to the island and bragged that he had only spent $20.00 for his entire 2 weeks vacation. I hope to never see this bum again, and we really used to be friends. We have moved to the desert and didn't give him our new address.

Years ago I bought an Amalio Bouget flamenco guitar for five hundred dollars. These are among the finest guitars of their kind in the world, worth at least five thousand American, and verifiable on line. The man selling it had received it as a fifth anniversary gift from his then wife and was selling it after the marriage had broken up many years later, to annoy her.
I wonder how he felt when he told her what he had done and she told him what it was worth. Fortunately, he was not idiot enough to call me and ask for more. Kudos to OP on finding his dream instrument at a great price! Now he knows that any mistake he makes is his own fault, not that of an inferior instrument.

I spent 4 yrs in Germany as a military personnel. We found a place in a small village to live. At first we were not warmly received but as we tried very hard to learn the language and would greet our neighbors in German they warmed up to us. Appears the previous tenants were also military and were very rude to the villagers. We ended up changing the villagers view of Americans and for the 4 years we lived there we were treated like family and were invited to many personal events. I really cried when we had to leave to go back to the states.

First story: I was in a slightly similar situation. I had bought a book at auction, and it turned out to be (a) inscribed to the previous owner by the guest of honor at a recent science fiction convention, and (b) donated by a friend of mine. I asked him if he had intended to donate that particular book. He had donated it by mistake, so I sold it back to him for what he had paid.
Had it been someone I don't know, and someone who said he had researched the price on the internet, I'd have been less accommodating.
