    Assault, Criminal Force & Hurt are stages in chronological order. All three terms are defined separately and are different. They are the stages leading to the commission of a crime and might affect differently. Assault is a preparatory act which causes apprehension of use of criminal force but may not require the actual use of criminal force. It creates a fear in the minds of the victim, of violence against him, as intended by the accused.
    The moment criminal force is used, there act is beyond assault as it causes motion or change in motion or cessation of motion, without consent. Thus, the motion if further leads to any pain or bodily injury such result is known as hurt as defined under section 319 of penal code. Hence the offence is termed as hurt when the injury or pain is caused and these are stages of committing an offence 🙏🙏

    1. The gravity of hurt is higher than of criminal force.
    2. A person when hurt suffers from severe bodily pain but in criminal force bodily pain is not necessary.
    3. Both are non-fatal crimes
    4. The ingredients of hurt are bodily pain, disease or infirmity whereas the ingredients of criminal force includes intention, knowledge and harm or fear or annoyance.
    5. Gravity chain :
    Murder>culpable homicide>grievous hurt>hurt>criminal force>force

    Difference between hurt and criminal force:
    1. Hurt can be unintentional or without knowledge whereas both are necessary ingredients of criminal force
    2. Hurt may result into bodily pain, diseases or infirmity whereas criminal force will cause injury, fear or annoyance
    3. Hurt is punishable only when done voluntarily whereas in criminal force there is no such thing as voluntary or involuntary.

    In hurt define in section 319,& here ingredients is bodily pain,disease or informity & in criminal force (350) it's important to change the motion of anything to prevent (means use force)other movements, so it's different between hurt & criminal force.......

    edit : Hurt VS Criminal Force, Mens Rea and Apprehension are 2 main differences between the two.
    *Hurt does not mention Apprehension and Mens rea is not that important*
    Whereas, in case of
    *Criminal force both Mens Rea and Apprehension are important ingredients which make up what we call Criminal force.*

    Difference between hurt and criminal force : Hurt- bodily pain, disease and infirmity to any person is necessary.
    Criminal force- only using force, intentionally and knowingly that it will cause......., causing any bodily harm is not necessary (only intention and knowledge is enough)
    Hurt: must result in bodily pain etc
    Criminal force: use of intentional force is enough.

    Criminal force is reason and hurt is the result. Criminal force may be to cause injury, fear, or annoyance to the person to whom it is applied. When such Criminal force has been applied to cause injury (bodily pain, disease, or infirmity) to that person. it will be hurt. Hurt can be caused by the application of criminal force only, but a Criminal force can be applied even without causing hurt to the person to whom it is applied. All criminal forces may not always cause injury to the person instead may cause fear or annoyance.
    It is also pertinent to note that in both the cases, intention must be present. In Criminal force, presence of intention is clearly mentioned. But in the definition of hurt (319) or grievous hurt (320), intention is not mentioned; still hurt and grievous hurt are only punishable under Sections 323 and 325 respectively when applied to a person voluntarily (with intention).

    Difference between Criminal Force and Hurt.
    Criminal force is making other person worry that some unpleasant is going to happen with him/her in future.
    Hurt is a bodily injury and thus making the other person inable of an organ of that person to perform in normal circumstances.

    Hurt is when a bodily pain is sustained and criminal force is when a force is applied for a motion or to cess the motion that can annoy, injure, or create fear in another person, it can be something related to the person except of his body like- if the person is walking with his god and someone shows a harming gesture, it can create a apprehension of risk to his pet.

    Hurt- sec 319 of the ipc 1860 (hereinafter ipc) defines hurt as whoever reasons bodily pain disorder or disease to any man or woman is said to have caused harm the sec does not outline the offence of inflicting harm bodily pain. Infirmity to another disease
    Criminal force- whoever intentionally uses force to any person without that person consent in order to the committing of any offence or intending by the use of such force to cause or knowing it to be likely that by the use of such force he will cause injury fear or annoyance to the person to whom the force is used is said to.........

    hurt- causes bodily pain, disease or infirmity to another person
    criminal force -intentionally use force on another person in order to commit offence with prior intention of causing harm to that person without consent.
    assault- gesture or preparation to any person with knowing that person is going to apprehend it as the person is going to use criminal force to that person.

    Criminal force is basically the use of force without others' consent in order to commit any offence ,injury, fear, or annoyance to that person ....
    Hurt is basically the bodily injury..
    Criminal force is the prior stage of offence and Hurt is the ultimate results of it.
    Criminal force may cause harm to any person's body, mind , reputation or property. But hurt is only bodily injury. So criminal force have wider scope than Hurt.

    Criminal Force... word starts with "Criminal" hence question of intent is 100% established... n ends with "Force" which is outcome of contact - be it direct or indirect... whereas Hurt can have elements of intention or knowledge, any of it, n in Hurt physical contact, again, be present or absent... one may say Criminal Force looks like subset of Hurt... but it's not... as in Criminal Force presence of both, offender n victim, is required at the place of offense at same time... whereas in Hurt collision of "presence and time" is not the point of discussion.. that's my understanding... happy to learn if wrong or missing some dimensions...

    Bodily hurt may be caused by many acts which are not assaults example- a person who mixes a deleterious poison and place it on another's table or digs a pit in public path intending that another may fall into it & cause serious hurt.

    As its the word own defines the term, that is hurt is not a criminal force, (grievous hurt may be), and the criminal force is applied with higher degree of mens rea and actus reus. All the factors such as intention , knowledge differs in both, criminal forces contains all these factors at higher level.

    hurt aur assult mei 1 diff ye hai ki force can affect substance also but hurt can only have affect on person. 2nd hurt mei assault jaise koi gesture aur apprehension nahi hone wala woh direct hoga. assult 1st stage hai hurt ha hurt 2nd stage hai. isse simple nahi hogi
    force is any kind of illegal touching...1st stage. that is called battery. hurt is when that illegal touching gets severe. 2nd stage.

    Hurt and Grievous hurt requires physical contact while Assault requires gesture and apprehension in the mind of the other person.

      In many cases it has been held that physical contact is not a necessary condition for hurt as defined by section 319, and even shocking the victim enough to induce by any way bodily pain would be enough to bring the said act under the purview of Section 319 that defines the offence of Hurt. (Kindly refer the book on IPC by KD Gaur and check out the topic of hurt, he has mentioned the relevant leading cases supporting this line of thought of the court).

    The major difference between hurt and criminal force is that, in hurt(Sec319)the offender knows *that it's* likely to cause hurt whereas in criminal force (sec 350) offender knows that *it will* cause injury to the person. I think *it will* in Sec 350 make more sense and the degree of knowledge is more than as compare to Hurt.

    Sir first of all Thank you so much for giving such a simple lecture on these topics. Hummmmm aapka video aaj dekhe hai and am trying to answer the difference between Sec.319 Hurt and Sec. 350 Criminal Force.
    1. In hurt there is only causing of bodily pain, disease or infirmity but criminal force is said to be applied where there is cause of injury, 'fear' or annoyance.
    2. In 319 there is no any mention of word intention but 350 is applicable where there is any intention by use of such force to cause not only just injury, but even 'fear' or 'annoyance'.
    3. Sec. 319 only include causing of the act but sec 350 also includes intention and knowledge of doing such act. (Sec. 319 needs only Actus Reus and Sec. 350 needs both Actus Reus and Mens Rea)

    Criminal force will be applicable when a person causes fear,injury or annoyance but in case of hurt a person must cause bodily pain,disease or infirmity.Hurt is more serious offence than Criminal force.

    Sir, in hurt there is only actus reus and no mens rea involved whereas in criminal force the main ingredient is mens read i.e. the criminal intent and sir in hurt it is necessary that there must be either bodily pain, disease or infirmity should be caused whereas in criminal force even a slight fear, annoyance or injury can be caused.

    Hurt can be caused with consent as well whereas to constitute criminal force it shall be without consent. Further, for hurt bodily injury is the only necessary ingredient whereas for criminal force, along with bodily injury, fear and annoyance are important too. Section 350(criminal force) also pays attention to the intention of the person causing criminal force.

    HURT - Bodily Pain, Disease, Infirmity
    Criminal Force - Causing Fear, Injury, Annoyance
    In hurt, you cannot take the plea that I was annoyed, but you have to be suffering from Bodily pain

    According to section 350 for criminal force there is necessary that any person cause motion, change of motion or cessation of motion to that other or any substance but in hurt motion is not a essential element.

    Criminal force is the cause, hurt is the effect. In other words, hurt is done when criminal force is complete.

    Can you please explain why the punishment of Assault and Criminal force are clubbed together in section 352?
    Please plot the relationship between these two, and can you please explain that, is it necessary that assault is the key element of Criminal force or vice versa?

    But
    In criminal force ,offender use force without consent in order to commit the offence

    Hurt means bodily pain to another person punishment upto 1 year and fine
    Grevious hurt means ie if a person brakes bones of another person upto 7 years and fine
    Criminal force means If a person spit on another person is called criminal force ie if a use substance towards another person with an intention to committed an offence.

    And no apprehension is needed in hurt but in criminal force it is must

    There is a difference of intensity b/w these two. Criminal force have lesser degree of intensity than hurt.

      what if kisi ne consent se bhi di...or usne criminal force use ki jisse us person ko heavy injury cause ho jati h....to ye exception m nhi aaega na ki usne to consent di thi....ye to NON-COMPOUNDABLE offence ki tarah h...consent ke baad kaam wo krna chahiye jisse REASONABLE APPREHENSION / KNOWLEDGE ho aapko ki us consent se jo aap act kroge...uska result kya hoga

    Hurt is non fatal (koi marega nahi) whereas Criminal force is fatal crime where it may cause death.
