  • In March 2021, Malvinder Singh rented his flat at Grand Omaxe Society in Noida 93 B to Manali Agarwal. Now, when he asked her to vacate the flat in January 2022, after serving a month's notice, Ms Agarwal refused to vacate the flat. The matter is being heard at the ADM court in Surajpur.

    She is now a squatter, not a tenant anymore. Wait outside or anywhere close. Tell the security to inform you as soon as she goes outside. Bring a locksmith, change keys and remove all her belonging outside. Let her go through the legal route, you already have everything you need to back yourself.

      @@yentaba1139 Nope...that'd be theft. For any property held like that, they'd have had to agree in the contract for it to be the security. And it would give her a legitimate reason to use force to enter the apartment again. You shouldn't get yourself into trouble while trying to reposses your home

But considering that she's not a tenant anymore and she herself refused to vacate the property or pay rent, isn't her belongings wrongfully parked in that property? It was technically her job to move out her belongings because that property is not her's anymore. If she fails to do so, then she can't blame that her belongings have been stolen. She left them at that place.

      @@devashishgole4722 Nope...she can file a case of theft against you and use that to get inside whether she 'blames' you or not, then good luck with evicting her again. Where someone leaves their belongings is their business, but that doesn't give you the right to acquire it. If somebody accidentally left something valuable of there's in your home and you refuse to give it back, you'll surely be charged with theft. It doesn't matter whether it's your home or she put it there despite the place not belonging to her. That's still her belonging, the ownership of those thing doesn't change based on where its "parked".
      You can try to justify it however you want here, but that's not going to work with police or in the court.

      That's unbelievable.
      It's one thing to not vacate a rental property even after expiration of aggreement, but she's still a tenant, she needs to pay rent in order to have rights of a tenant.

    It happened with us too. My father asked the electricity department to cut the electricity of my apartment. She left the house in a single day with all belonging. After that my father had to pay again to get the electric connection back. But this technique worked.

    We had an infringement on our property once. We had rented it to one guy who never paid rent but he sub leased it to someone other people and was collecting rent from them as a landowner but never gave anything to us. They illegally put shops on our land thinking the guy we rented to was the landowner. When we came from the US to see the situation, we just walked in, began throwing out all their stuff onto the street. They called the landowner who came and asked who we were and to share our documents. We told him to f off and we continued throwing out their stuff. He made a few life threats which we recorded and shared with the police and a copy to the US embassy. Police commissioner called us and told us that the guy is connected to a local politician. We again escalated and the local politician and everyone under him was arrested. These types of guys only understand one language.

I know its not easy to send ur child abroad.. Now when it's their (children) time to stand shoulder to shoulder with de family.. Children hv flown away and can't even send money... lol wats da fun settling abroad if u can't even help ur parents... Im settled in India and still can help my parents financially.     It happened to me.. my tenant who is practicing lawyer, was not vacating. I sent notice to him and took him to court.Finally after a year he vacated and then I sold the apartment. No more headache now.People normally say don't rent your home to lawyers and police. But it's true in my life.

    i wish there were laws where if the tenant doesn't pay rent for more than 3 months the landlord can outright enter the property and throw their things out.

    whenever I hear such news, I am literally shocked that how can a Tenant live so confidently in the flat after all this! . Even after Courts order, police intervention etc she is not vacating and neither paying rent!!! How??? Is it so easy for a Tenant to take control of another person's house? Not even the society's maintenance team is cutting off her power and water supply! Why! How!
    So it means one should think 100 times before investing in real estate in INDIA!!!

    Similar problem I faced in my Kolkata apartment. The tenant started defaulting on his rent. He said lockdown is going on so his car rental business is not going well. Fine I said and we waited. Soon lockdown was over and his business was also running. Still he didn't pay rent and was not moving out. Police came and told them to vacate the house peacefully without going to court. I even said I don't want my rent, just vacate it. But he was adamant. Started saying his parents are not well, his business is struggling. He will pay all the due rent and then only leave, even if it takes few years.
    Now I don't stay in India much and my parents stay there. I came back to Kolkata after 6 months, still he didn't vacate the house. We got an order from the district magistrate in another 6 months that they should vacate the house.
    Then I put false allegations against him that he is selling marijuana and is creating nuisances in the building every night after being drunk. In 2 weeks we brought the police, local political friends and we broke their lock and barged in. We started taking out his furnitures and putting it on the road. He came and started shouting lol. I said I have sold the house and new owner wants this to be vacated today as tomorrow onwards they will start renovation. Trust me friends, within 4 hours he found a new rented house and by evening he moved out. We gave him 2 days time to shift his remaining furnitures.
    So in this type of situation you have to force your way into your house and then let them complain. You will be charged with trespassing but actually it is your property and occupant is staying illegally, so they are trespassing. When police is there as witness then there cannot be any charge of robbery also.

    My Mother allowed her maid to stay in one of our investment properties after she got married. She & Her husband gave us really hard time to vacate the same. They went on to police station & posted about us on media giving false claims.. finally, my parents had to pay them up to leave. The world is full of thankless people.

    Case daal ne se kuch nahi hoga . Employee a man for Rs.15K . All he has to do is visit your flat every day and put a lock on the outside at 7AM and go to the spot where all electric meters are there and pull the plug and take it with him. He will definitely vacate. Case daal ke 1-2 Lakhs kyu waste karni.

    We faced the same issue, our tenant put a case on my father that we harassed them, when we asked them to vacate. Court case went on for 2 years and she was luckily forced to vacate. But she had abused the house so much that we spent a lot of money to restore it

    Eviction order from court must be served by court personnel along with local police protection. Any objection to this becomes contempt of court.

Paaji is totally right, why would he ask for help from children when he already has his own house, it is not that they are living on streets and children are ignoring them. The correct way to deal with such fanatics is by force, let the help of goons make their life miserable so they'll run on there own, society people if not intervening then they can't stop the paji as well. And if the Dr sahiba complaints she won't even get the police support as the court orders are already there. Pathetic laws we have, that at times require taking themselves in hand.

      I don't understand on why that woman said that She isn't aware of the court order. Is that a problem of Court or the complainant or Police ? It's only and only her problem. She needs to talk to her lawyer if she isn't aware of any court order. But even after knowing the fact of the court order, she isn't vacating the flat. This lady should simply go behind the bar.     You need proper legal representation, file an application for delivery warrant along with police protection and break open of lock to recover possession. If the police and court staff fail to recover your possession , file a contempt petition in high court , all arrears of rent must also be paid, so file an application for recovery of arrears of rent by attachment of all the tenants movable property.

    This halpened to my uncle whose house was acquired illegally by the tenant. Court case took 30-40 years to solve however nothing happened to tenant he still aquired the half of the house property got sold put after judgement at very low price all sugfering and pain and cost was ot compensated.
    Shame on the judicial system, also an eye opener for the people who are investing in property without power.

    Happened with me too recently. Leased out my flat to a contractor, wasn't vacating. Got the electricity disconnected. F*cker had to leave. If the court has also ordered to vacate, then simply lock the house from outside, or use force to throw her out. Let's see what she can do.

      Mine is going on from 2017. He wanted to buy the apartment but my dad was nice to him and rented the house to him while his loan was being finalized. He kept delaying the purchase and paid some advance whenever we asked him to vacate saying that it'll be done soon.
      Due to immense health issues and this on top my dad passed away in 2018. He paid rent till 2020 then stopped that also. We are unable to vacate him, court system is very slow. Multiple tears have been shed to no avail.

    I also bought a plot in delhi from a delhi police officer. After four years we recieved a notice from electricity court to seal our premises, later we got to know that a FIR was registered in the name of that police officer but in the court he gave a wrong statement that this plot doesn't belong to him. We produced all the property chain to the hon'ble judge but he asked my 70 yrs old mother to pay the claim amount for a theft that happened 4 years ago before we purchased the property. That day I lost all my trust in the law. I sold that property and relocated to another country. I can feel the pain of this uncle ji, that what he is suffering due to corruption and beurocracy.

    We literally told our tenant to vacate our house after she legit destroyed it to pieces. Her dogs scratched up walls and doors. We've had decent and sophisticated tenants as well in the past but this one was just nasty. It was as close to her occupying the flat. This is messed up on so many levels.

    My father-in-law's property in Noida was illegally taken by a corrupt police officer. The officer hired thugs to prevent my in-laws from building anything on the land. Later, the officer built his own house on the property. Despite my father-in-law being a high-ranking government employee, he was unable to take action against the builder and the officer. This is the unfortunate reality of Delhi NCR.

    The owner is absolutely correct, just a bit of a point that I observed here. The rent agreement was of 36 months, however, in the video it is not quite mentioned that the agreement was a notarized agreement or was it the registered agreement from court where the court vacates the tenant in case of any discrepancy. Because in case the agreement period is more than 11 months, registered agreement is mandatory in most states (not sure about Delhi though).
    If it is the registered one, the court shall take responsibility and not the owner to vacate the owner by any means, by force too.

    Some case with us. 6 months, no rents. Went to court through a lawyer. Lawer took 30k, court is postponing. Knowing that even after hearing, the job will be not done is heartbreaking. Judicial system is inefficient.

A tenant can issue a fresh notice stating she doesn't knew about courts order, later will file fresh application that she doesn't have anywhere to go, later she will file harasment case making video if owner comes to their own house to talk with her. Thus, she stays FOREVER and long as she wants for FREE... Sardarji is lucky that he at least got court order in 1.3 years after filling complain... For some, it takes decades and die fighting.

    In India judicial system is just to get formalities done , once done you have to use the parallel system created by politicians to vacate the house and u have to pay some money to them. Same issue happened with my friend house and he didn’t even go to court just took help from MP to vacate the house. If you go to court it takes years to just get verdict but in parallel system within a week it gets settled

    I too had a tenant he went and gave police complaint also when i asked him to vacate the flat saying that they are harrasing then i went to police station they told you have to seen in court you can't ask him to vacate if he is not willing to, Then what i did i took my mother, father and sister cut hos electricity but he fixed electricity also then we looked his door then police came he told we will charge case on owners because they are creating violence . Policemen is also saying go to Court and face it
    But court once you apply it will take more than 3 months to get notice to tenant and then case dates we will get by the time we get the house it will be 3 years. Then my parents and we decided to Hit him when he comes. We hit him in a way that can't call police only he can go to hospital after that i gave house to another tenant immediately. His things i threw i kept in road and after 4 days he came and took his things.

    We also had a tenant once who refused to leave and she was not paying any rent too. My family threw her out and she filed a police case against us, the apartment was sealed for a few months and we suffered some losses due to this but we were happy that we got rid of the squatter

      US is pretty good at eviction, barring a few cases. Canada's legal system is still far better than India. Not only that. Nonpayment of rent could reflect in credit history. Someone who is able to pay will not risk it, as future rentals could be difficult.

    I am working in this industry for the past 5 years and i can guarantee you this is not at all a common scenario. It only happens when the owner become very lenient on the tenant and over trust them. What they forget is that they are still in a business relationship with the tenant. It's not a personal relationship. This looks a clear case of police inaction due to several factors. Cheats and specially stubborn cheats are everywhere be it medical, education , insurance or business.
    .
    Owner should be as stubborn as the thugs otherwise they won't get their rightful share anywhere in the world. It's good that quint covered their story. He will get some support and pressure on the local police.

    The rent agreement is not valid one.. Beyond 11 months of rent agreement, the agreement should be properly registered as per registration act before registrar, failing this criteria agreement is null and void

    I have been through this problem . Highly recommended not to rent to single women , bachelors , or any family who don’t have a good job or a decent source of income .
    Always ask for the employment letter , salary slips etc before signing the rent agreement
    Most of the squatters come from a poor family background or don’t have enough money to pay rents thus they tend to occupy flats . Also the law doesn’t do much maximum they can do is send notice to the tenant . That’s all

    This is sad that even with 2 sons parents have to struggle for such petty case. She is clearly paying Half the Rent to the Police Authority to not take any action. The issue has to be forwarded to the Police higherups to use force if needed to vacate the house. I hope Quint can help these to elderly in getting this issue resolved.

    Unfortunately this is the case of legal affairs in our country....where common people have to struggle to get their own property... and for such a straight forward case, it took almost 2 yrs to give the judgement.
    For criminals & politicians, the court can be opened up even at anytime to give a hearing!!

    My family faced similar thing! A guy came and asked to rent our vacant house but he let someone else live in it. When confronted, we found out they were lowkey thugs and had political connections. We couldnt do anything about it. After 1.5 years of not paying rent we finally filed a case in court and they were ordered to move out which they did after 6 months. While leaving, they damaged the doors and shelves and made a mess of the house. We had to renovate the house all over. It boils my blood to think how shameless that family is to be able to do such a thing. Also it seems they had borrowed 12 lakh from a women and cheated her out of it. She came to the house after they moved out and was panicking to see they left. Poor woman I feel so sorry for her. Trust no one people. It's a harsh world. I hope they get their karma.

      @annamalais2870 Sadly not yet. They live in a nearby area now and seem so happy and unbothered of their actions. The woman I mentioned above is still begging them to return her money, while we are still waiting for our compensation after filing a second case. Life goes on for them while we suffer.

    Either police man is her boyfriend or she knows laws misusing at extreme level.
    The man has the keys should directly go to HIS HOUSE and throw her stuff out. If police or court interferes he can show all the documents required hhim to evict her. This can only be done while video taping for evidence purpose.
    Refusing court order is like Court also doesn't have any authority.

    Here in California if a tenant doesn't pay the rent they get evicted by the court . The sheriffs give 24 hour notice to quit with there belongings once the court gives approval . I feel sorry for uncleji.

    This is the story of almost every household in Bengal. Tenants occupying property for decades and paying penny rent to the rent control. If you go to the court it takes another couple of decades for nothing to happen. We house owners are helpless.

    Court Order and Judgement is different thing and implementation is different...
    You have to file Execution Petition of the Order, then Court Orders local Police to Evict tenants with Force .

    This is absolutely horrible. He deserves to retire in peace. I believe each society has a Society Group in place - which comprises of residents from the society - which can help out in cases of abuse by tenants. Perhaps they can help out too. Thank you, Quint, for bringing his story to light.

    Cut the electricity and water supply, Same incident happened to me in 2021, and I didn't go to the court because I knew that the other person would enjoy my problems. Then I asked the electricity and water department to cut the supply. Then the family finally vacated the flat in 1 month. Trust me , no one can live without water and electricity. So go ahead and do it. And thats completely under your rights to cut the electricity and water supply because that's your property.

    I am facing this situation as well. Tenant illigaly occupied the flat and not leaving. Rent agreement was expired. Almost 1.5 years gone. Court case is going on. Don't know how long court proceedings will take. Court expenses, lawyer expenses, plus harrasment from tenant side, all are giving me so much tension, pain. I am a BP patient.
    Hopeless Situation.

    I was going through this but I am partially responsible for it. My tenant started defaulting on rent citing his business failure during COVID. My mistake was my sympathy towards him. Also his sweet talk saying he will pay everything once his business is back on track. And like giving biscuit to a dog, he kept on paying small amounts to me giving me some hope that he will pay full. Then when i knew his trick and asked him to vacate , he started talking about his moral responsibility to pay me full outstanding amount before moving out. Again I was a little soft on him and allowed for another few months. Finally I got fed up and kicked him out saying I am going to police station to file a complaint. By this time , he owed me 1.8lakh in rent! He vacated and with great pain i know I am not going to get my money. 😢 Interestingly he still messages me saying he will pay me some day!

    Sir you shud file a writ petition in high court ...once the petition is passed thru court then the police will be bound to carry out the court's orders & within 7 days time your flat will be vacated.

    if it is loan free property then mortgage it to bank. Default the payments willfully and ask bank to cease the apartment. Also never make more than a year agreement.

    Since there's court order favouring the landlord and despite the order the tenant doesn't vacate the house. This amounts to CONTEMPT OF COURT... The tenant can appeal against the court order in higher court's and precisely this is what the tenant wants to do... Keep the legal cases going on and on... To harass the landlord... There's a Goa High court order published in TOI dated 24th Jan '24... The landlord can exercise his right by citing the case and asking for eviction of the tenant.
