  • 39 Essex Chambers thank you for joining our webinar, with presentations from the team as they discussed and reflected on the long-awaited Supreme Court decision on secondary victims, which was handed down on 11 January 2024.
    Paul v Wolverhampton and conjoined appeals raise wide questions about secondary victims, remoteness and duty of care. Following our webinar in 2020 after the first instance decision, we reflect on the outcome of Paul as it clears the final hurdle.
    Charlie Cory-Wright KC, Emily Formby KC and Scarlett Milligan provided an early exploration of the decision and its implications.
    We looked at definitions of proximity; timing between breach and consequence; hospital cases and causation; and reflect on what we have learnt from the judgment.
