- The decision of the Supreme Court in R (Worcestershire County Council) v Secretary of State for Health and Social Care [2023] UKSC 31 has shone a spotlight on the complexities to which s.117 MHA 1983 can give rise. Further, whilst it has given much-needed clarity in relation to some areas, there remain practical and principled questions that public authorities have to grapple with when navigating the legislation.
In this seminar, chaired by Alex Ruck Keene KC (Hon), expert speakers from the 39 Essex Chambers Public Law and Court of Protection teams will both set out road-maps for public authorities through s.117 and answer questions about the legislation and its interpretation by the courts. We will also consider what the future might hold.

Can you please answer this question ... if someone is already living in the community in enhanced supported living and on s.117 aftercare and the ICB are wanting to create a "step down one month trial for the person in their own home" and the person has to continue to pay their utility bills at the enhanced supported living placement whilst doing the "step down trial" should the ICB be responsible for paying for the utilities at the "step down home" during the one month trial period?
