Glad Charlie pointed out that the hot coffee lawsuit was not frivolous like the prevailing notion that it was. McDonald's was operating all their stores telling them to keep the coffee way hotter than it should be for some reason. All that lady wanted was for them to cover medical expenses but they refused so she had to take them to court.
The reason was that a lot of people would buy the coffee on their way to work. By brewing it at extreme temperatures, it would still be hot by the time customers arrived at their work places, which would make the coffee more desirable. They basically chose profits over safety.

Also worth mentioning: part of why the coffee burn was so severe wasn’t *just* a temperature problem, but when you are an elderly person, your skin is much more fragile. Like tissue paper. And she was at a stop, spilling it in her lap, where it was soaked up immediately by her cotton sweatpants, which then held the boiling hot coffee against her skin. The incident nearly killed her. This is why, when I worked at Starbucks, I truly took issue with the people who ordered drinks at 190°. And would MAKE US REMAKE IT if it wasn’t sufficiently magmatic. It was always the worst and rudest customers too, I’m convinced they need to consume something that is reminiscent of the flames from Hell, when they’re homesick.

The coffee lady case is actually something we studied in my senior PR class in college. The coffee lady was 100% in the right, and the hate she got was completely uncalled for.

Yes she was a bit dumb for placing the cup between her legs but there is liability on McDonalds' part. I wouldn't say she was "100% in the right" but she totally had legal ground for the lawsuit. The reason people look down on this case in particular is the way the media spun it and presented it when it was ongoing and after the fact literally skipping over facts. The way it was spun at the time, and was perpetuated by the internet, is that some old lady went through the drive through and took her coffee home spilling it on the way and she got burned by it. They didn't mention that the coffee was hot enough to send her into shock, they didn't mention that it literally caused 3rd degree burns in seconds, they didn't mention that she was parked at the time, and also didn't mention that she wasn't the one driving. The way it was presented was effectively that this greedy careless old woman spilled some normal temperature coffee on herself, got upset and sued McDonalds for no reason. Spilling coffee you make at home on yourself burns, but you tend not to get more than 2nd degree even for a slightly prolonged contact. This woman had scalding hot coffee pressing into her legs and crotch due to it soaking into her sweatpants. Again, while I disagree that it was 100% McDonalds' fault, as it doesn't take a rocket scientist to realize you need to assist your 79 year old aunt (the driver was her nephew) put sugar and cream into her coffee in your car that doesn't have cup holders. But the coffee should not have been hot enough to do that which is the crux of the matter that most people ignored back then and continue to ignore. THE thing about the case that makes me glad she won though is... she simply asked McDonalds to cover her medical expenses which she estimated would be around $20k, McDonalds denied that and then she was advised to sue, which she did and won. Multiple other settlement offers were made prior to the trial as well, all of which McDonalds denied. The lawsuit didn't even get her that much money as after the fact it was appealed and a settlement was reached out of court. She apparently also made it to 91 years old but had to have a live in nurse for the entire 12 years which probably drained most of, if not all of the settlement. She was stated to have horrible quality of life after the incident. Again, I feel her nephew and her are at fault to a degree, but not to the point people make it out to be. Without her case McDonalds would still be serving coffee in flimsy paper cups. They were, and are currently, the store that sells coffee at the highest temperature in the US I believe. There are more facts to the case, and others have described it way better than I have, or could, I would recommend you looking up some actual info on the case just to clear the misconceptions.

Thanks Charlie for telling the facts about the poor old lady burnt by the coffee. She sued only for the medical bills. The judge gave her much more which she deserved. The media caused that poor woman so much pain on top of her skin being burnt off her thighs and private area. She wasn’t driving either. The media never corrected that story either. @KingKami - The general rule with YOUNG kids, especially when driving, is if nothing you could see having caused actual harm to them has happened then they're probably throwing an emotional fit. Like, for real, a kid in a car seat that spilled their nuggets would cry for 2 minutes. You don't pull over every time your kid fusses that they're sad. You'll never get to where you're trying to go. Four year olds just aren't capable of emotional regulation, and the best you can do is try and talk them through it while driving.

As a former McDonald's employee (I only worked for one day) the way McNuggets are made is we take frozen nuggets, dip it in the deep fryer at the exact 160°F temperature and when they're ready we drip dry them and stick them in a heated shelf so that they're not scalding hot but they're not room temperature cold neither. Taking this knowledge into effect I can safely say this mother should be held accountable for torching her daughter.
I've been there for 5 years, and i 100% agree. We tell people their food is fresh and really hot, but they eat it right away anyways and get mad when they're burned. Also thats a toddler, you gotta check their food, if you cant hold it between your fingers for 5-10 seconds without it being too hot, its too hot for your baby.

Which the courts should not have allowed, this is retaliation for losing in my opinion. A multibillion dollar corporation lost a lawsuit & used their unlimited money to win the public opinion so it canceled out. part of the problem with the Hot Coffee case was it was getting framed as a case of someone not understanding hot coffee is hot. at least that's how i remember hearing it. there was a very distinct lack of information being provided. if it was made clear the coffee was served well over safe temps that would have made everything clear and chances are people would have properly thrown shade at McDonalds.

People forget that it occurred in the days before a) cars had cup holders (they didn't) and b) drink cups had the caution hot liquid warning on it Also, people act like they've never spilled food and beverages on themselves before. Even if it is a "hot" beverage it shouldn't cause you third degree burns. Also, at that time McDonald's had been receiving complaints that their coffee was too hot BEFORE the coffee lady's incident, and they just ignored the complaints and kept making their coffee way too hot. So definitely McDonald's were in the wrong and needed to be made an example of.

McDonald's already won though, they ran an entire indirect campaign by letting news channels know that they'd advertise there only as long as their coverage of this story aligned with what they wanted people to hear. Coffee can only be 100 degrees at most (boiling water), at over 100 it turns to steam. So I never understood the case. She spilled boiling water on herself and sued.

Thank you for talking about how awful those coffee burns were. I remember when that happened and even on the news they were making it out to be an entitled, everyone-is-suing-over nothing trend. Then a few years later there was a documentary on it and they showed pictures and it was HORRIFIC. She was an elderly lady I believe and I remember how emotional her grandson was describing the incident in the car and the agony his grandmother was in. It was disturbing.

As someone who's worked at McDonald's, the food is tempd daily and chicken products need to temp between 165-200 degrees, when coming straight from the frier the often temp around 185 and then are put in a heated cabinet to keep warm. Saying that nugget was over 200 is insane. I have a 4 year old and always test her food before I give it to her, if its too hot I hold it infront of the ac, out the window or simply have her wait. Beyond irresponsible of the parent, even if she was on the interstate she could have pulled over and helped her daughter in sooner than TWO MINUTES. That poor child
I work at KFC, and I agree, it’s absolutely ridiculous to suggest that the food is somehow over 200 degrees. Everything we cook has to be a minimum of 185 after coming out of the fryer, and we do sometimes temp over 200, but there’s literally no way it ever stays that hot after getting packed and being given to the customer.

Imagine hearing your child screaming because they are being burned, but you, the amazing parent just says "Just wait a bit longer we are nearly home". Like take this child away from whoever these parents are.
I dunno I mean they actually didn't say whether it took the mom two minutes to pull over, or two minutes to get home. Either way imagine someone only telling half of your side of a story and everyone on the internet starts reaming you about how you're a horrible person and terrible parent. Mean while the options are: 1. Mom could have been stuck in traffic and genuinely trying to turn around but unable. 2. Mom heard her daughter screaming thought it was a literal case of "don't cry over spilt milk" when she saw the nuggets all over her lap. 3. They could have been literally again just two minutes away from home and the mom didn't realize it was because she was in pain. 4. The child is on the spectrum and had no concept of the fact it was burning them until it literally went through layers of flesh. I have watched as my autistic friend had a similar mishap but with a cigarette. 5. The child screams about absolutely everything, and maybe the mom was overwhelmed that day and didn't realize she was hurt until it was too late. Imagine thinking you can be the judge on whether or not someone is a horrible parent because a youtuber made a 20 minute video about it.

What if the she was doing the best she could at the time and her child was consistantly screaming and demanding the food to where she just gave in. I grew up being given food in the car at a young age, same with my daughter. Accidents happen and I'm sure if the child was choking she would have done what she could have to pull over and handle it. But that could have also been a later thought. I've been lucky with my kid, I haven't had to deal with her choking and I'm thankful for that. But also because of that reason and because I've I dunno taught her how to not gobble down food and to actually eat pieces that she can handle, I wouldn't have thought about choking. I would have checked temperature before serving it, but I'm confident in my daughter and her ability to not bite off more than she can chew

I think what sucks the most about this is how the *employees* of McDonalds will receive the most consequences for this, mainly in the form of hours of mindless slideshows the manager cobbled together after the previous one was sacked for "burning a customer."
I can say first hand that (at least some) McDonald's restaurants don't even care to complete their own training materials; nobody knows how to do half of the crap in there and ends up with stupid stuff like "we're out of Sprite because we don't know how to change the BIB." It would be a miracle if there was even a mention to this. This isn't the fault of employees, but rather the store managers responsible for keeping track of their employees' progress.

I strongly disagree. Yes, the employees may have to sit through slideshows or training materials. But that does not even come close to what the company has to pay, not to mention the branding stigma. The McDonalds coffee case involved serving coffee at a much higher temperature than is even possible using traditional methods. To put it in layman terms, they were basically making coffee in a pressure cooker in order to save time resulting in a product that was extremely dangerous when it was handed to people in cars in flimsy styrofoam cups. In fact, McDonalds had been warned by their own people that it was extremely dangerous to do this and they simply ignored the warnings.
According to Wikipedia the coffee was 180-190 Fahrenheit or 82-88 Celsius while here in Sweden McDonald's serve coffee that is 92-96 Celsius or 197-205 Fahrenheit. You need coffee to be that hot to make good coffee.
@@Thulzor I did, and it seems it mostly comes down to preference. Temperature Ranges: 120F - 140F (48.8C - 60C), 155F - 175F (68.3C - 79.4C), 180F - 185F (82.2C - 85C) So your assertion is a matter of opinion on _one_ method of serving hot coffee, not _the_ method.
A brief reminder that anyone's perspective of a restaurant can be based off a single location. I had a thing against Taco Bell for years because every time we'd order from this ONE LOCAL LOCATION, they ALWAYS magically FORGET to give us something we order. One time they forgot my DRINK.
This is true. On the rare occasion I want McDonald's I go out of my way to a different location because the one near my house always messes up. They've forgotten an entire meal when we ordered for a group of people. Society is on the path to its downfall and eventual extinction. As a fast food worker, I remember a lady who ordered an extravagant quantity of sauces and questioned why she didn't get them for free. She proceeded to discipline me like a child for attempting to explain our company policy (she cut me off just a couple of words in), saying that she is a mother and her children would never disrespect her like that. If that's really how you raise your child, you're not giving them a bright future.

Its literally just because news outlets attacked the old woman siding is Mcdonalds and calling the lawsuit frivolous so most peoples first access to the information was very one-sided and ignored alot of the facts.
Kids will literally cry and scream over anything. The mother put nothing in the back seat with her child that she would have thought would hurt him. It is not her fault that she thought he was crying prob because he dropped his nuggets or whatever. It seems the kid was either too young or unable to communicate that he was being burned.
Honestly, it's really telling how much public perception has flipped on the coffee lady. It used to be people would reference her story to compare bogus lawsuits to it. Now, the situation is reversed: new, less legitimate lawsuits are now piggybacking off of her story to make their case seem more legitimate. For what it's worth, I am glad that lady wasn't enshrined in popular culture as a con artist, she went through hell and the world at large thought less of her for it.
Theres a reason we all had that perception. They used her case and others like it to put caps on damages in all lawsuits. In a lot of states, even if you are awarded 100 million dollars, you can only recieve like $500k now. The media put cases like hers in the news to show the "need" for the caps.
Obviously not if she created a whole lawsuit around it. She also from the sounds, still pulled over to remove the nugget? So sure it's definitely the moms fault and there are not external factors that could have caused any of this. Just shitty moms being shitty moms right?

The coffee story is legit, and it's unfortunate that people view it as some frivolous thing which is exactly what corporations wanted people to think so they could start lobbying for laws to insulate themselves from liability for negligence and malpractice. That said, I find it really hard to believe a nugget from McDonald's could even be hot. Any time I've had food from there it's been lukewarm at best.
In the rest of the world it isn't s problem to serve freshly brewed coffee. I hope the corporations succeed because it's ridiculous that they should have to treat adults as toddlers and be responsible for anything they do.

I’m so glad I started working at McDonald’s AFTER the coffee lawsuit. One day I worked a morning shift and was switching an empty coffee pot with a full, FRESH brewed one and ever so gently accidentally tapped them against each other. The full pot shattered and drenched hot, fresh coffee all over me. I was fine, it just hurt a little, but I dread to think what would’ve happened if the coffee was as hot as the lady’s 😭😭
Crap, I just realized the coffee they serve at the hotel I work at is heated to 200°F. Our coffee is hotter than the coffee that permanently disfigured Stella Leibeck. And most of the people who drink our coffee, are elderly people often confined to wheelchairs. It’s a lawsuit waiting to happen.
@@2nukitv218 Not as problematic as a drivethrough. Liquids in a car have a much higher chance of spilling, whereas coffee in a hotel can stay still on a table, unless there's an earthquake. Either way, you can just wait for a bit before serving the coffee so that it gets slightly colder.

It was the jury that saw McDonald’s didn’t give a shit who awarded her 2.7 million dollars, which was reduced to 400k by the courts. Then after she won, McDonald’s went on a smear campaign against her!!! When she only sued for medical costs! With the nugget case, she gave the child the nuggets, which were regular temperature nuggets but fresh off the fryer. Years ago Fred Durst accidentally broke a fans nose with his microphone and the person won 5 million. It’s disgusting the court cut back the money by over 2 million! The pain that woman went through not just physically, but was harassed and had her name dragged through the mud by the media and regular people must have been so stressful and demoralizing. Typically there’s a huge difference between a child crying and screaming vs being in pain. While it might sound like shrieking for both, a parent is usually able to tell if the child is crying over spilled nuggets or is currently getting 2nd degree burns
The bit about chicken: fried chicken has to be cooked at a really high temp in oil in order for the meat inside to cook and the breading to basically flash-cook hot and crispy. Typically if you’re making standard fried chicken you’ll cook it somewhere around 350 in hot oil at much quicker time for chicken nuggets in particular. The nuggets can possibly be really hot enough to burn the skin if they’re fresh and they served the nuggets very quickly.
I second this, I work at KFC & our fryers for fries, popcorn, & patties are at a constant 350, and our pressure fryers heat to 330 - 360 (the chicken in these is cooked for around 15 minutes, aside from tenders, which are cooked for 4:20) when the chicken comes out of the fryer it has to be a minimum internal temperature of 185 or we have to throw it out. It usually reaches 200 or a little above.
It's likely also that liquid burns more easily at lower temps, too. But I don't think a 200+°F nugget stuck to a toddler's skin for *2 MINUTES* would've only caused a 2nd degree burn.
@@Major003Really depends on if it was directly contacting the skin, or burning through something. Hot liquids will soak through a fabric and contact bare skin regardless, a dropped nuggie would not. At worst, a small amount of oil would soak in, but it wouldn't be the same as spilling the equivalent temperature in fluid on yourself
I got 2nd degree burns on my hands and wrists when I was like 7 or 8 from losing balance while on a mini trampoline which resulted in me grabbing onto the nearest object, an (unknowingly) still-hot grill, for like not even 10 seconds, and recently I've gotten small 2nd degree burns on my arms while accidentally bumping into a hot oven door (twice lmao) while working in a kitchen and the contact lasted not even a second. I have scars from both of these events too. a CHICKEN NUGGET burning a child to the same extent as getting burns from a hot grill or hot oven door is a very wild thought.
Idk I work in fast food, hot food probably wouldn't even have to be fresh from the frier to cause damage if it was pressed against your skin for over 2 minutes like in this case. Which I personally think the food wasn't fresh because I feel like fresh chicken would do much more damage.
As a Parent, it should be common sense to check your child's food if they're a certain age. Specifically for reasons like this. The mom should have checked the temperature before hand, instead of just giving her daughter the meal. Even though it seems that this would be that One In a Million situation, because I've never gotten steaming hot nuggets from any Mcdonald's, and I've been getting those for about 30 years now.

As a parent of a current 4 years old I trust him to be old enough to understand when something is too hot and to know to wait, brake it or blow on it if it is. I would also probably think the initial cry would have been because he spilled the nuggets not because he was hurting. Kid thay young first response is still to cry first and articulate what's wrong later. So until he outright say that he is hurting or cry become clearly pain cries I also don't think I would have stopped immediately.

I dropped a fry and it burnt my inner thigh and I cried, but I usually was kind of an asshole in the car so my parents just figured I was having my normal tantrum. When we got home and realized I burnt myself they felt bad but they didn’t go an sue McDonalds… that’s ridiculous

A four year old is in the back seat, and the nugget stuck behind a seatbelt isn't gonna be easy to know. I was a manager for McDonald’s for 3 years, recently quit a couple weeks ago. At 10:00 everyday we do something called “change over” to get everything ready for lunch by 10:30. Part of that process is temping out the product and making sure it’s not under/overcooked. At my particular McDonald’s the frying vats were set at 350 degrees and the nuggets cook for 3:30. When those nuggets are fresh and you put the pyrometer in within a minute of them coming out, they can be pretty hot, ranging from 190-205 degrees, so I could maybe see this happening if her nuggets were straight from the fryer. That being said tho, they’ll cool down to a warm enough temp not to cause damage within 5 minutes, that’s why we have 2 trays, if one runs out you drop some more and when they come up you can put them in the cabinet and let them cool down while also staying warm enough to be enjoyable.
Probably for the same reason all the freezer section nuggets I've ever bought at the Supermarket say "let stand for 5 minute before consuming" because you want to internal temperature of at least 165F to lower to none scalding temps
Only 2:30? Our nuggets, filet, and McChicken go down for 3:30 at My store and Crispy chicken goes down for 7 mins flat, but I'm a night time manager so the temp check and changeover Is done by the time I come in so I don't know what they coming out to, I'd guess about 180 tho cus I've burned my mouth on fresh nuggets

A couple of things I thought of- the kid was probably in a carseat in the backseat. The mom probably glanced back and didn't see the nugget because it was under the seatbelt. A 2 year old baby is going to have much more delicate skin than an adult or even a teen. That said, it's on the parent to monitor the kid and it's probably not a good idea to give food to kids who can't clearly tell you if there's a problem. The kid could've just as easily choked and the mother not notice until it's too late. Would she have blamed the restaurant for that?
When I worked at a place frying chicken, it was normal for the chicken to be 185 in the coldest area and 215 in the hottest areas, but the time letting the oil drain off of it was plenty to get it down to a temp that wasnt dangerously hot. Also I have left chicken in the fat fryer and forgot about it, it doesnt liquify, it crystalizes, turning into something so hard no mortal could attempt to bite into it.
Thanks for telling the real truth of the hot coffee story. That poor woman suffered a horrific burn and then, to quite literally add insult to injury, McD's engineered a cover story of her being clumsy and whiny. When the incident had been the fault of their negligence. I've gotten first degree burns on my elbow and hand. Very mild, but they still hurt (and were itchy when they were healing.) I can't even begin to imagine how painful third-degree burns on your crotch must be.

I work in the kitchen at a CFA and the fryers cook at around 325 degrees. Chicken comes out around 180-190. It sits in the fryer for 3-4:30, depending on if it's nuggets, strips, or fillets.
As a Dad of 2 kids (age 5 and 3) my kids will drop their nuggets on their laps all the time and never whined about it being too hot usually, and whenever my kids do drop something hot on them sometimes I react fast swiping it off, I’ve even taught them to react and now they get it off themselves. I hate that parenting is being pushed on companies now. People will have kids but they don’t want to be parents
The child is autistic and was 4 years old when the situation occurred. She got the burns because the 160-degree to 200-degree chicken nugget was trapped between the seatbelt and leg, and she still has scars from the event in the present. I recommend you look at the pictures to understand better because the way Charlie explains them doesn't do the burns justice. The woman was also driving while her two children in the back received their happy meals. You could ask why the sibling in the back didn't help their sister, but maybe they didn't know what was happening and would only let the mother get the chicken nugget out. Plus the mom was driving on top of it, so by the time her daughter started screaming because of the burn, she didn't have anywhere to truly pull over for two minutes. It's likely a situation of the franchise owner potentially crunching workers and having them cut corners to get food out faster. So the oil in this case likely wasn't shaken off or the chicken nuggets weren't sat for the allotted time they were supposed to.

Let's say the child choked on the food whilst the mother is driving and it takes 2 minutes for her to pull over and help the child, is it the parents fault for letting their child eat whilst they drive or the restaurant for serving them food? The mother didn't need to be driving, let them eat in the car whilst parked, park and eat inside or reheat the meals when you arrive home if it's a short drive and you don't want to wait. I don't fault parents for things like this when the chances of an accident is so low but to blame others when that low chance accident occurs is ridiculous.

I've gotten 3rd degree burns from a burning paper plate, and had skin graft surgery, it's a serious injury. The fact that poor woman suffered that from COFFEE is actually scary to me, and I'm so glad she got what she deserved in that lawsuit. I'm sure that was months of pain, on top of months of healing...
Having worked in food service, fried chicken absolutely does come out of the fryer with an internal temperature of 200+. But also the time it takes to throw in a sandwich/box, serve, and then be eaten by the customer, should be more than enough time for the temperature to drop

And yea, cooking food internally TO 165° doesn't mean the external temperature is the same. It's way hotter, say as hot as the liquid it's being cooked in...

What unfortunately happened is that the mother probably intentionally let her daughter get burned (not even like threw the nugget herself, but like in a "see what you did? I hope you learn your lesson" kind of way), and now is suing just to get Mcdonald's to settle because she knows she might as well take advantage of her kid's real injury.
I can chime in on this!! I work at Pizza Hut, and sometimes our wings come out around 200 depending on the heat of the oil(cause we have a set cooking time). But for this to have happened, that shit had to come out of the fryer, be bagged, handed to her, and she gave it straight to a toddler. This is a case of bad parenting. Case closed in my mind.
If food is handed to a customer while still at a temperature that is actively dangerous to touch, much less eat, that is definitely the fault of the restaurant.
As a former manager at McDonalds I temped thousands of nuggets and they were always between 190ish and 200ish STRAIGHT out of the fryer. So unless they pulled the nuggets out with tongs and immediately started tossing them at the daughters legs theses no way they were above 190. Even then I’ve bit straight into fresh nuggets and started breathing fire like a dragon but I recovered 20 seconds later because it was no longer in my mouth. This sounds more like parental negligence than anything.

If McDonald's gave them a hot cup of coffee and you handed it to the child and they spilled it and burned them it would be the parents fault. They shouldn't have let them handle it. Sometimes you just can't differentiate between your child's/sibling's cries. I usually go check on them despite any crying because I have time, but my mother is sometimes to tired, especially in the car. I have like 2 siblings under 10, I see what goes on ib my house. So if a cause of negligence because of this one, it's genuinely really fucking minor.

when my sister and i were really little and we went through the wendy's drive thru my mom would never hand our food to us. sometimes if we were extra hungry she would hold individual french fries in front of the air vents to cool them off and then pass them back to us to pacify us, but we didn't get our whole meal til we got home. and even then she would tell us "be careful, it's hot, you need to blow on it first" and if we didn't listen and put hot nuggets in our mouths anyway, she would make us drink cool water immediately to quickly dissipate the heat. idk why anyone would hand their toddler fresh hot food while they were driving and unable to assist them.

I'm the dad of a 14-month-old and if a chicken nugget got lodged in my kid's leg and they were screaming about it my immediate reaction would be to pull over and help them, not finish driving home and let the chicken or whatever had hurt them continue to burn their skin. Absolutely a parenting issue.
No where in this did it say she finished driving home. And if the drive home was 2 minutes away from mcdonalds I'm sure she would have just made her wait to eat it until they were home. The mom could have been literally stuck on the highway with no where to turn or pull over or stop. Why are you acting like parents have control over absolutely everything? As a mom to two kids, a toddler and a newborn. My toddler screams about every little damn thing. You have not even reached the terrible twos yet where they scream about legitimately everything. Also- are you saying you cant tell the difference between your kids being rowdy and your kids being in genuine prolonged pain?? like, regardless of the reason, if a kid is screaming at that level (which i guarantee she was, its a 4 year old, they can usually talk well enough to explain at least that theyre in pain) you should pull over, or at the very least figure something out.

@@pughat5233 I have gotten 2nd degree burns quite frequently. I've melted the flesh off of my arm at the age of 7 when making fish sticks for my mom who had a torn rotor cuff. I've also burnt myself on numerous bangers and nails heated by torches. No you don't always scream. You don't always cry. And my daughter earlier today screamed like someone had genuinely ripped her open but it was because she didn't want to watch mickey mouse any more. So??? Again this child could be on the spectrum or have numerous other underlying things that we did not hear about. Again she could have been in a stretch of road with no area to pull over safely? As someone who worked in fast food I do believe a chicken nugget can get that hot, but it's something that would only really happen during a lunch/dinner rush, or if you ordered like a hundred nuggets. I was usually the person to put together orders and I'd tend to tell people "hey, just so you know your nuggets/fries/chicken sandwich is very hot," but I'd never say it was a responsibility, it was a way to try and get people to calm themselves when they've been waiting in a busy drive-thru. Heck, I never got burned by anything working there, despite the time I got a batch of fries still dripping oil dumped on my hand. Bottom line, any burn that child got was a result of that mother's negligence, and I think she's doing whatever she can to make it look like she's not a horrible parent
So with the McDonalds coffee, no one ever mentions that the coffee was around 180 degrees and she had third degree burns all over her thighs and crotch and had to be hospitalized. She initially just wanted $10,000 to cover her medical bills. McDonalds laughed in her face so her lawyers stepped it up to hire amount so that they would face damages for defamation. Also there were around a dozen other incidents of this happening to customers prior to her suit, which McDonald’s flat out ignored.

Glad Charlie pointed out that the hot coffee lawsuit was not frivolous like the prevailing notion that it was. McDonald's was operating all their stores telling them to keep the coffee way hotter than it should be for some reason. All that lady wanted was for them to cover medical expenses but they refused so she had to take them to court.
The reason was that a lot of people would buy the coffee on their way to work. By brewing it at extreme temperatures, it would still be hot by the time customers arrived at their work places, which would make the coffee more desirable. They basically chose profits over safety.

Also worth mentioning: part of why the coffee burn was so severe wasn’t *just* a temperature problem, but when you are an elderly person, your skin is much more fragile. Like tissue paper. And she was at a stop, spilling it in her lap, where it was soaked up immediately by her cotton sweatpants, which then held the boiling hot coffee against her skin. The incident nearly killed her.
This is why, when I worked at Starbucks, I truly took issue with the people who ordered drinks at 190°. And would MAKE US REMAKE IT if it wasn’t sufficiently magmatic. The coffee lady case is actually something we studied in my senior PR class in college. The coffee lady was 100% in the right, and the hate she got was completely uncalled for.
@@littlekirby6 She was in the right because of just how hot the coffee actually was and a flimsy cup, I believe is the reasoning. The coffee was actually WAY too hot. Yes she was a bit dumb for placing the cup between her legs but there is liability on McDonalds' part. I wouldn't say she was "100% in the right" but she totally had legal ground for the lawsuit.
The reason people look down on this case in particular is the way the media spun it and presented it when it was ongoing and after the fact literally skipping over facts. The way it was spun at the time, and was perpetuated by the internet, is that some old lady went through the drive through and took her coffee home spilling it on the way and she got burned by it. They didn't mention that the coffee was hot enough to send her into shock, they didn't mention that it literally caused 3rd degree burns in seconds, they didn't mention that she was parked at the time, and also didn't mention that she wasn't the one driving. The way it was presented was effectively that this greedy careless old woman spilled some normal temperature coffee on herself, got upset and sued McDonalds for no reason. Spilling coffee you make at home on yourself burns, but you tend not to get more than 2nd degree even for a slightly prolonged contact. This woman had scalding hot coffee pressing into her legs and crotch due to it soaking into her sweatpants.
Again, while I disagree that it was 100% McDonalds' fault, as it doesn't take a rocket scientist to realize you need to assist your 79 year old aunt (the driver was her nephew) put sugar and cream into her coffee in your car that doesn't have cup holders. But the coffee should not have been hot enough to do that which is the crux of the matter that most people ignored back then and continue to ignore. THE thing about the case that makes me glad she won though is... she simply asked McDonalds to cover her medical expenses which she estimated would be around $20k, McDonalds denied that and then she was advised to sue, which she did and won. Multiple other settlement offers were made prior to the trial as well, all of which McDonalds denied. The lawsuit didn't even get her that much money as after the fact it was appealed and a settlement was reached out of court. She apparently also made it to 91 years old but had to have a live in nurse for the entire 12 years which probably drained most of, if not all of the settlement. She was stated to have horrible quality of life after the incident. Again, I feel her nephew and her are at fault to a degree, but not to the point people make it out to be. Without her case McDonalds would still be serving coffee in flimsy paper cups. They were, and are currently, the store that sells coffee at the highest temperature in the US I believe.
There are more facts to the case, and others have described it way better than I have, or could, I would recommend you looking up some actual info on the case just to clear the misconceptions.

Like, for real, a kid in a car seat that spilled their nuggets would cry for 2 minutes. You don't pull over every time your kid fusses that they're sad. You'll never get to where you're trying to go. Four year olds just aren't capable of emotional regulation, and the best you can do is try and talk them through it while driving.

As a former McDonald's employee (I only worked for one day) the way McNuggets are made is we take frozen nuggets, dip it in the deep fryer at the exact 160°F temperature and when they're ready we drip dry them and stick them in a heated shelf so that they're not scalding hot but they're not room temperature cold neither.
Taking this knowledge into effect I can safely say this mother should be held accountable for torching her daughter.
I've been there for 5 years, and i 100% agree. We tell people their food is fresh and really hot, but they eat it right away anyways and get mad when they're burned. Also thats a toddler, you gotta check their food, if you cant hold it between your fingers for 5-10 seconds without it being too hot, its too hot for your baby.

These days, most people know it was a legitimate case, but for years, they spun it well.
I remember hearing about it for the first time and being given the impression that it was an extremely minor burn. Then I saw a youtube video on it a few years later and I was horrified by how terrible her injuries actually were. part of the problem with the Hot Coffee case was it was getting framed as a case of someone not understanding hot coffee is hot. at least that's how i remember hearing it. there was a very distinct lack of information being provided. if it was made clear the coffee was served well over safe temps that would have made everything clear and chances are people would have properly thrown shade at McDonalds.

Thank you for talking about how awful those coffee burns were. I remember when that happened and even on the news they were making it out to be an entitled, everyone-is-suing-over nothing trend. Then a few years later there was a documentary on it and they showed pictures and it was HORRIFIC. She was an elderly lady I believe and I remember how emotional her grandson was describing the incident in the car and the agony his grandmother was in. It was disturbing.

As someone who's worked at McDonald's, the food is tempd daily and chicken products need to temp between 165-200 degrees, when coming straight from the frier the often temp around 185 and then are put in a heated cabinet to keep warm. Saying that nugget was over 200 is insane. I have a 4 year old and always test her food before I give it to her, if its too hot I hold it infront of the ac, out the window or simply have her wait. Beyond irresponsible of the parent, even if she was on the interstate she could have pulled over and helped her daughter in sooner than TWO MINUTES. That poor child
I work at KFC, and I agree, it’s absolutely ridiculous to suggest that the food is somehow over 200 degrees. Everything we cook has to be a minimum of 185 after coming out of the fryer, and we do sometimes temp over 200, but there’s literally no way it ever stays that hot after getting packed and being given to the customer.

Imagine hearing your child screaming because they are being burned, but you, the amazing parent just says "Just wait a bit longer we are nearly home". Like take this child away from whoever these parents are.
I dunno I mean they actually didn't say whether it took the mom two minutes to pull over, or two minutes to get home. Either way imagine someone only telling half of your side of a story and everyone on the internet starts reaming you about how you're a horrible person and terrible parent.
Mean while the options are:
1. Mom could have been stuck in traffic and genuinely trying to turn around but unable.
2. Mom heard her daughter screaming thought it was a literal case of "don't cry over spilt milk" when she saw the nuggets all over her lap.
3. They could have been literally again just two minutes away from home and the mom didn't realize it was because she was in pain.
4. The child is on the spectrum and had no concept of the fact it was burning them until it literally went through layers of flesh. I have watched as my autistic friend had a similar mishap but with a cigarette.
5. The child screams about absolutely everything, and maybe the mom was overwhelmed that day and didn't realize she was hurt until it was too late.

I grew up being given food in the car at a young age, same with my daughter. Accidents happen and I'm sure if the child was choking she would have done what she could have to pull over and handle it. But that could have also been a later thought. I've been lucky with my kid, I haven't had to deal with her choking and I'm thankful for that. But also because of that reason and because I've I dunno taught her how to not gobble down food and to actually eat pieces that she can handle, I wouldn't have thought about choking. I would have checked temperature before serving it, but I'm confident in my daughter and her ability to not bite off more than she can chew

I think what sucks the most about this is how the *employees* of McDonalds will receive the most consequences for this, mainly in the form of hours of mindless slideshows the manager cobbled together after the previous one was sacked for "burning a customer."
I can say first hand that (at least some) McDonald's restaurants don't even care to complete their own training materials; nobody knows how to do half of the crap in there and ends up with stupid stuff like "we're out of Sprite because we don't know how to change the BIB." It would be a miracle if there was even a mention to this. This isn't the fault of employees, but rather the store managers responsible for keeping track of their employees' progress.

I strongly disagree. Yes, the employees may have to sit through slideshows or training materials. But that does not even come close to what the company has to pay, not to mention the branding stigma. I, like Charlie, feel silly for "defending" a giant corporation...but you can't argue that sitting through a slideshow is somehow worse than paying millions of dollars. The McDonalds coffee case involved serving coffee at a much higher temperature than is even possible using traditional methods. To put it in layman terms, they were basically making coffee in a pressure cooker in order to save time resulting in a product that was extremely dangerous when it was handed to people in cars in flimsy styrofoam cups. In fact, McDonalds had been warned by their own people that it was extremely dangerous to do this and they simply ignored the warnings.

According to Wikipedia the coffee was 180-190 Fahrenheit or 82-88 Celsius while here in Sweden McDonald's serve coffee that is 92-96 Celsius or 197-205 Fahrenheit. You need coffee to be that hot to make good coffee.

I had a thing against Taco Bell for years because every time we'd order from this ONE LOCAL LOCATION, they ALWAYS magically FORGET to give us something we order. One time they forgot my DRINK.

They've forgotten an entire meal when we ordered for a group of people. Society is on the path to its downfall and eventual extinction. As a fast food worker, I remember a lady who ordered an extravagant quantity of sauces and questioned why she didn't get them for free. She proceeded to discipline me like a child for attempting to explain our company policy (she cut me off just a couple of words in), saying that she is a mother and her children would never disrespect her like that. If that's really how you raise your child, you're not giving them a bright future.

Kids will literally cry and scream over anything. The mother put nothing in the back seat with her child that she would have thought would hurt him. It is not her fault that she thought he was crying prob because he dropped his nuggets or whatever. It seems the kid was either too young or unable to communicate that he was being burned.
Honestly, it's really telling how much public perception has flipped on the coffee lady. It used to be people would reference her story to compare bogus lawsuits to it. Now, the situation is reversed: new, less legitimate lawsuits are now piggybacking off of her story to make their case seem more legitimate. I’m so glad I started working at McDonald’s AFTER the coffee lawsuit. One day I worked a morning shift and was switching an empty coffee pot with a full, FRESH brewed one and ever so gently accidentally tapped them against each other. The full pot shattered and drenched hot, fresh coffee all over me. I was fine, it just hurt a little, but I dread to think what would’ve happened if the coffee was as hot as the lady’s 😭😭

Crap, I just realized the coffee they serve at the hotel I work at is heated to 200°F. Our coffee is hotter than the coffee that permanently disfigured Stella Leibeck. And most of the people who drink our coffee, are elderly people often confined to wheelchairs. It’s a lawsuit waiting to happen.

@@2nukitv218 Not as problematic as a drivethrough. Liquids in a car have a much higher chance of spilling, whereas coffee in a hotel can stay still on a table, unless there's an earthquake. Either way, you can just wait for a bit before serving the coffee so that it gets slightly colder.

The bit about chicken: fried chicken has to be cooked at a really high temp in oil in order for the meat inside to cook and the breading to basically flash-cook hot and crispy. Typically if you’re making standard fried chicken you’ll cook it somewhere around 350 in hot oil at much quicker time for chicken nuggets in particular. The nuggets can possibly be really hot enough to burn the skin if they’re fresh and they served the nuggets very quickly.
I second this, I work at KFC & our fryers for fries, popcorn, & patties are at a constant 350, and our pressure fryers heat to 330 - 360 (the chicken in these is cooked for around 15 minutes, aside from tenders, which are cooked for 4:20) when the chicken comes out of the fryer it has to be a minimum internal temperature of 185 or we have to throw it out. It usually reaches 200 or a little above.
It's likely also that liquid burns more easily at lower temps, too. But I don't think a 200+°F nugget stuck to a toddler's skin for *2 MINUTES* would've only caused a 2nd degree burn.

At worst, a small amount of oil would soak in, but it wouldn't be the same as spilling the equivalent temperature in fluid on yourself
I got 2nd degree burns on my hands and wrists when I was like 7 or 8 from losing balance while on a mini trampoline which resulted in me grabbing onto the nearest object, an (unknowingly) still-hot grill, for like not even 10 seconds, and recently I've gotten small 2nd degree burns on my arms while accidentally bumping into a hot oven door (twice lmao) while working in a kitchen and the contact lasted not even a second. I have scars from both of these events too. a CHICKEN NUGGET burning a child to the same extent as getting burns from a hot grill or hot oven door is a very wild thought.
Idk I work in fast food, hot food probably wouldn't even have to be fresh from the frier to cause damage if it was pressed against your skin for over 2 minutes like in this case. Which I personally think the food wasn't fresh because I feel like fresh chicken would do much more damage.
As a Parent, it should be common sense to check your child's food if they're a certain age. Specifically for reasons like this. The mom should have checked the temperature before hand, instead of just giving her daughter the meal. I was a manager for McDonald’s for 3 years, recently quit a couple weeks ago. At 10:00 everyday we do something called “change over” to get everything ready for lunch by 10:30. Part of that process is temping out the product and making sure it’s not under/overcooked. At my particular McDonald’s the frying vats were set at 350 degrees and the nuggets cook for 3:30. When those nuggets are fresh and you put the pyrometer in within a minute of them coming out, they can be pretty hot, ranging from 190-205 degrees, so I could maybe see this happening if her nuggets were straight from the fryer. That being said tho, they’ll cool down to a warm enough temp not to cause damage within 5 minutes, that’s why we have 2 trays, if one runs out you drop some more and when they come up you can put them in the cabinet and let them cool down while also staying warm enough to be enjoyable.
Probably for the same reason all the freezer section nuggets I've ever bought at the Supermarket say "let stand for 5 minute before consuming" because you want to internal temperature of at least 165F to lower to none scalding temps

A couple of things I thought of- the kid was probably in a carseat in the backseat. The mom probably glanced back and didn't see the nugget because it was under the seatbelt. A 2 year old baby is going to have much more delicate skin than an adult or even a teen. That said, it's on the parent to monitor the kid and it's probably not a good idea to give food to kids who can't clearly tell you if there's a problem. The kid could've just as easily choked and the mother not notice until it's too late. Would she have blamed the restaurant for that?
The kid wouldn't have been screaming in pain if she were choking. They tend to be very vocal about injuries.
When I worked at a place frying chicken, it was normal for the chicken to be 185 in the coldest area and 215 in the hottest areas, but the time letting the oil drain off of it was plenty to get it down to a temp that wasnt dangerously hot. Also I have left chicken in the fat fryer and forgot about it, it doesnt liquify, it crystalizes, turning into something so hard no mortal could attempt to bite into it.

I've gotten first degree burns on my elbow and hand. Very mild, but they still hurt (and were itchy when they were healing.) I can't even begin to imagine how painful third-degree burns on your crotch must be.

I work in the kitchen at a CFA and the fryers cook at around 325 degrees. Chicken comes out around 180-190. It sits in the fryer for 3-4:30, depending on if it's nuggets, strips, or fillets.
As a Dad of 2 kids (age 5 and 3) my kids will drop their nuggets on their laps all the time and never whined about it being too hot usually, and whenever my kids do drop something hot on them sometimes I react fast swiping it off, I’ve even taught them to react and now they get it off themselves. I hate that parenting is being pushed on companies now. People will have kids but they don’t want to be parents
What I don’t understand is why she didn’t blow on the food first. I always do that.
The child is autistic and was 4 years old when the situation occurred. She got the burns because the 160-degree to 200-degree chicken nugget was trapped between the seatbelt and leg, and she still has scars from the event in the present. I recommend you look at the pictures to understand better because the way Charlie explains them doesn't do the burns justice. The woman was also driving while her two children in the back received their happy meals. You could ask why the sibling in the back didn't help their sister, but maybe they didn't know what was happening and would only let the mother get the chicken nugget out. Plus the mom was driving on top of it, so by the time her daughter started screaming because of the burn, she didn't have anywhere to truly pull over for two minutes. It's likely a situation of the franchise owner potentially crunching workers and having them cut corners to get food out faster. So the oil in this case likely wasn't shaken off or the chicken nuggets weren't sat for the allotted time they were supposed to.

I've gotten 3rd degree burns from a burning paper plate, and had skin graft surgery, it's a serious injury. Having worked in food service, fried chicken absolutely does come out of the fryer with an internal temperature of 200+. But also the time it takes to throw in a sandwich/box, serve, and then be eaten by the customer, should be more than enough time for the temperature to drop

What unfortunately happened is that the mother probably intentionally let her daughter get burned (not even like threw the nugget herself, but like in a "see what you did? I hope you learn your lesson" kind of way), and now is suing just to get Mcdonald's to settle because she knows she might as well take advantage of her kid's real injury.
That’s what I think, because it just seems so absurd and unrealistic that for over 2 minutes a normal mother would just ignore her child in pain
I can chime in on this!! I work at Pizza Hut, and sometimes our wings come out around 200 depending on the heat of the oil(cause we have a set cooking time). But for this to have happened, that shit had to come out of the fryer, be bagged, handed to her, and she gave it straight to a toddler. This is a case of bad parenting. Case closed in my mind.

If food is handed to a customer while still at a temperature that is actively dangerous to touch, much less eat, that is definitely the fault of the restaurant.

As a former manager at McDonalds I temped thousands of nuggets and they were always between 190ish and 200ish STRAIGHT out of the fryer. So unless they pulled the nuggets out with tongs and immediately started tossing them at the daughters legs theses no way they were above 190. Even then I’ve bit straight into fresh nuggets and started breathing fire like a dragon but I recovered 20 seconds later because it was no longer in my mouth. This sounds more like parental negligence than anything.
parental negligence doesnt suddenly make a nugget scalding hot, tho. Shedidn't do that, the fast food chain did
@@TheGlassAddiction the child is a child and doesn't know any better. The patient should know how it's cooked and that it could be hot. If McDonald's gave them a hot cup of coffee and you handed it to the child and they spilled it and burned them it would be the parents fault. They shouldn't have let them handle it. Nothing would have been wrong with just waiting till they got home either way.

If I fucking get a hot coffee from Starbucks and I accidentally spill it on my skin to the point that I have to go to the hospital, that's on Starbucks for serving me shit that's too hot. I certainly shouldn't be able to drink it right away if I'm getting higher degree burns. That's literally not on me, I haven't even done anything to alter the temperature of the coffee.
And then maybe in this case, I think the nuggets were wedged between a chair and the girl's back. That's still not enough here, the nuggets should still not be at the temperature to burn. The only heated contact would be the retainment of heat, so it's still on McD's for serving food that's too hot if it's giving 2nd degree burns without any prior tamperment to the temperature.
Yes, it is possible that the workers served ut out really hot. These are restaurant eorkers, even worse fast food restaurant workers, they're just trying to give out food and not thinking of much else. Maybe they had an oversight here. Maybe my mom should say different if this happened to her, but, I really am not blaming the workers for this. It happens, man.
And you didn't really say this, but I just feel like it. Sometimes you just can't differentiate between your child's/sibling's cries. I usually go check on them despite any crying because I have time, but my mother is sometimes to tired, especially in the car. I have like 2 siblings under 10, I see what goes on ib my house. So if a cause of negligence because of this one, it's genuinely really fucking minor.

when my sister and i were really little and we went through the wendy's drive thru my mom would never hand our food to us. sometimes if we were extra hungry she would hold individual french fries in front of the air vents to cool them off and then pass them back to us to pacify us, but we didn't get our whole meal til we got home. and even then she would tell us "be careful, it's hot, you need to blow on it first" and if we didn't listen and put hot nuggets in our mouths anyway, she would make us drink cool water immediately to quickly dissipate the heat. idk why anyone would hand their toddler fresh hot food while they were driving and unable to assist them.

I'm the dad of a 14-month-old and if a chicken nugget got lodged in my kid's leg and they were screaming about it my immediate reaction would be to pull over and help them, not finish driving home and let the chicken or whatever had hurt them continue to burn their skin. Absolutely a parenting issue.
No where in this did it say she finished driving home. And if the drive home was 2 minutes away from mcdonalds I'm sure she would have just made her wait to eat it until they were home. The mom could have been literally stuck on the highway with no where to turn or pull over or stop. Why are you acting like parents have control over absolutely everything?
As a mom to two kids, a toddler and a newborn. My toddler screams about every little damn thing. You have not even reached the terrible twos yet where they scream about legitimately everything.

Also- are you saying you cant tell the difference between your kids being rowdy and your kids being in genuine prolonged pain?? like, regardless of the reason, if a kid is screaming at that level (which i guarantee she was, its a 4 year old, they can usually talk well enough to explain at least that theyre in pain) you should pull over, or at the very least figure something out.

@@pughat5233 I have gotten 2nd degree burns quite frequently. I've melted the flesh off of my arm at the age of 7 when making fish sticks for my mom who had a torn rotor cuff.
I've also burnt myself on numerous bangers and nails heated by torches. No you don't always scream. You don't always cry.

I would like to say I am a parent of 2 kids. My first born is almost 2 years old. She eats nuggets like a pro. I don't drive and let her eat or anything, but I have a hard time believing this burn was just from a chicken nugget. It may have been inflicted by the mother for a scam to sue Mcy'ds. Sad stuff if that was what happened.

As someone who worked in fast food I do believe a chicken nugget can get that hot, but it's something that would only really happen during a lunch/dinner rush, or if you ordered like a hundred nuggets. I was usually the person to put together orders and I'd tend to tell people "hey, just so you know your nuggets/fries/chicken sandwich is very hot," but I'd never say it was a responsibility, it was a way to try and get people to calm themselves when they've been waiting in a busy drive-thru. Heck, I never got burned by anything working there, despite the time I got a batch of fries still dripping oil dumped on my hand.
Bottom line, any burn that child got was a result of that mother's negligence, and I think she's doing whatever she can to make it look like she's not a horrible parent
