    Dr. Jones is very passionate about his job. Reason he likes to explain a lot. He’s also a very sweet man. I live in SD and he’s very well respected here. He helps a lot of people from infants to adults and to students and fellow colleagues.

      @@trailrider7046 I deleted the previous answer as the defense just rested. The prosecution is not ready so they will restart the trial in 12 days with their witnesses.

      This seems to be only happening on Law & Crime network, other networks carrying this trial are not having the audio issue. I have my TV all the way up to 100 for the volume and can't hear anything going on in the courtroom but the guy via ZOOM (or whatever he's using to testify) is blasting! Someone needs to fix this.

      10000% agree. TONS of people with FASD (I was in social services for a few years before I had to leave) and they did NOT go on killing sprees. Quit wasting tax dollars and get to the point of this already! These families have suffered enough because of this gross killer.

    Dr. Jones may seem a bit chatty for court but he's definitely a very intelligent man who has appeared to work so hard his whole life. This disorder like many others are never acknowledged enough for the Doctors and specialists who work so hard for us and the future of our children to understand what alcohol can actually do! I love his energy and intelligence and really think he needs to be treated more respectfully by the state. This Dr is not defending NC by any means you can tell he's actually intrigued to see all the actual legal documentation done over this young man's life because as a medical professional myself it's just something you don't see often or ever. Like he said it's the first time ever he's seen so much documentation. It blows my mind that with all the help the adoptive mom tried to get and all the trouble and behaviors he had over all these years it ended up so tragically! If just one person really perused his case and history this really probably could have been prevented somehow. Prayers continue for all the families involved. I do love this Judge and I could listen to this Dr's knowledge and stories through his lifetime over coffee ☕️ ❤️ !!! Prayers for the families once again 🙏 😢 💔

      NC also had many, many counselors, psychiatrists, etc. How on earth can anyone put together a cohesive linear accurate analysis? To much transference of information and varying reinterpretation of any tests or data on NC throughout. His condition was not identified early enough to give any forewarning as his diagnostic history is actually a fine mess.

As an educator of 30 plus years, 3 degrees, children of my own, I must disagree with this most lovely witness… he is so knowledgeable as a pediatrician, but his characterization of children with neuropsychological alcohol spectrum disorder, and the “stigmatization” of this diagnosis within the school system, is not current. Perhaps 30 years ago? Not now. Our schools, as well as our society, are melting pots of children of various backgrounds and “issues.” Yes, I’ve taught children as those he described in the regular classroom but I look back now at those children and not one, though some were severely “challenged” in the areas the Dr mentioned, have ended up being mass murderers.

    There is something going on with the AUDIO feed from the courtroom. I can barely here anything anyone is saying in the courtroom (I have my TV up as high as the volume will go) and can still barely here anything. This happened Monday and now has happened at Tuesday's hearing as well. Can someone please address this?

    The state, the defense, and the judge owe it to these families and the jurors to hash this out on their own time. The family has waited long enough for a decision on this. And when they are all over the place like this in front of the families i find it so disrespectful.

      I agree it's been a circus but the defense had to by law put on the best defense they can. but agreed the worst was the judge allowing the neighbor to run (or whatever you call that) in front of the jury, I couldn't believe the defense even requested it to be done.

    Watching the replay. The medical doctor is clearly an expert witness and though I am interested in his information about symptoms of FAS, I don’t understand why the court let this phase of the judicial process go for so many weeks with so much repetitive information.

      They're asking for death penalty. If he wasn't given chance to mitigate he would get an appeal and we would start over. There also never been trial like this, so don't know what you're comparing it to. If i sat in the jury box I would want to hear everything before sentencing someone to death/life in prison.

    Wow. The longest penalty phase of all times, at least the longest I can remember. Was any sociopath ever offered so much good will, so much attention throughout his life, including psychological evaluations, special supportive classes and supervision, teachers who sat with him in class just to monitor his behaviour etc. - not to mention wealthy adoptive parents who really cared about him. And now he has 5 lawyers fighting for him left and right and what do they allege: society failed this guy. No matter what the outcome will be, I doubt there will ever be an execution. There will be appeal after appeal, just more heartbreak for the families and survivors.

      Exactly. we should be making the families a priority but I guess that's our faulty justice system. Four years!!! All those supports...many don't even get those and now we're supposed to have sympathy for this monster that not enough was done? Ok. Honestly, just put him out of his and everyone's misery already. He's caused enough life long trauma to others.

      That's how it works in death penalty cases. If you don't like it, this would have been resolved months ago if there was no death penalty on the table. Having it on the table ensures that this case takes far longer to resolve and if he is sentenced to death, it will be decades more. If he's sentenced to life in prison, we can all forget about him, he'll rot in prison and we can turn our thoughts to the bereaved victims who can finally focus on healing and recovering as much as they can.

      I’m only interested because my mom is a alcoholic and she drank with me but I was born in 68 but my problems are nothing like this case . I don’t have a hurtful bone in my body Im actually totally different. He is a sociopath 100% but I’m not sure where that comes from genes or environment.

    The best part of watching this is when the State cross examines the Defense"s witnesses, and either poke holes in the witnesses testimony and/or make excellent points to refute the Defense's goal of underhandedy getting information in. The State prosecution has an awesome team.

      Does your job include making a decision about whether a man should live or die? I suspect it’s pretty harrowing for the jurors, witnesses, lawyers, gallery and even the judge.

    I've been watching live trial for quite some time now and I've NEVER, EVER seen and heard such a sleazy, disrespectful, pathetic and more DESPERATEE defense team in my whole life. They are 100% taking advantage of the Judge

    1:00:45 I'm not sure there's a direct "malingering test" as the lawyer refers to, since having such a specific test to predict a certain behavior is impossible. Maybe he knows that and is attempting to capitalize off it.

    Dr. Jones put a great deal of emphasis on the meconium-stained amniotic fluid. My first child went about a week over his due date and, me being a new mom, had a longer than necessary labor. The doctor finally resorted to forceps and vacuum extraction to get him delivered. He had aspirated some meconium at birth and had an initial APGAR score of about six, as I recall. The delivery team used a bulb syringe and maybe a little oxygen therapy. At five minutes his APGAR was nine, I think. My son has just graduated from a nearby university and is now a graduate student at that university. He is a calm, well-balanced individual. Meconium-staining is NOT a definitive factor for any sort of mental or emotional issues later in life.

    I hate it when lawyers try to trip up professional medics or professionals and then have to back down and say on more than one occasion I stand corrected. You look pathetic and I’ll prepared. You would think these poor buggers were on trial and the aggressive and undermining behaviour or trying to undermine is clutching at straws. Stick to the bloody evidence and stop trying to derail with poor ill thought through argument and attempting to undermine professionals whatever side they are witnessing for. I despair watching this. No wonder the parents of the victims have thinned out.

    For all who are saying the prosecution is simply out for blood…..pay attention to how poorly the defense witnesses have been educated and prepared for this case.

      I'd too be out for blood if I were the prosecution. They are fighting for 34 victims and their families, and since their state has the DP, they must go for it. I don't think the defense experts are ill-prepared though, they just don't have a defense. No matter which FASDs they claim he has, the bottom line is that his executive functions and coordination work just fine.

    Gotta love how the prosecution insists on using POINTER FINGER. I can ALWAYS tell with words they use what narrative they want to push discreetly. It’s all a mind game. It’s to discreetly place things in the minds of the jurors. I love how the specialist caught on and corrected everytime.

      @@HereComesKarma I support the defense 100%. The death penalty is a ridiculous concept and like something from the Middle Ages. At some point in the future when the death penalty is gone, people will look back at those governments that put people to death in the same way that we look back at those who said that people were depression or low IQ were 'lunatics' and locked them away in an asylum.
      Thankfully the death penalty will most definitely be gone at some point. States are finding it more and more difficult to find legal ways of murdering people.

      The dude pled guilty. The facts are facts..this should have been finished long ago. I agree ..long drawn out ..each is being paid by state and we keep hearing the same questions asked in different ways. If it's on the record..dont draw it out.     This is so sad.
    Not a popular opinion I guess, but is there any justice to the tragic loss of so many lives by pursuing the death of other?
    The system failed in so many ways. Cruz was clearly a terrible child who shouldn’t have been in a normal school or allowed to own a gun, expelled and left alone after so many cries for help from those around him. Death penalty has been shown not to be a deterrent…
    I really think the only hungry to kill are from the prosecution… Their interventions seem very violent to me.

This trial is only happening because THEY want the death penalty. I do t agree with the death penalty. This person CLEARLY had and has issues. Everyone failed him. He did a HORRENDOUS act he killed innocent young people. He deserves punishment but not death. Why kill him? What good does that do? He’s already in jail and will stay there until end of life. He will not harm other innocent people ever again.

    Mr Satz and mr Secore are complete opposites.
    I liked the doc's "lecture", it's interresting, but maybe not always relevant to the questions asked. You can tell he teaches. And nice that he does not charge for anything. However, it is sloppy not to have read any of the prison records. They are often quite informative for experts.
    And again, Lynda tried and got Nik help and wanted to give him more help bc she knew that adhd was the wrong diagnosis.

      She is a pretty woman, I think she knows that, but I think she was definitely the wrong choice for this trial. It is apparent, and she has said herself she is not knowledgeable about many things. She should probably be in civil court, cases that involve debtor warrants and such. I am sure the victims families feel let down.

      @@jenylyn72 I think it's a case of lacking experience rather than ability.I've read that this is her first DP case. Mass shooters are often shot by law enforcement at the scene so a mass shooter coming to court is a bit unusual. Then there's Cruz's complex and tragic backstory which started when he was conceived. Many things went wrong in his life; his adoptive parents were unsuitable for a child with his needs and ailments; his schooling was a mess.... We'll never know whether the right interventions would have prevented the shooting from taking place but there should be measures put in place to ensure a child with a backstory similar to Cruz will not only be offered the necessary help but steps are taken to ensure it's taken up.

    Sorry, but bad day for defense. I am confused, are parents stigmatized or relieved when diagnosis is made.
    Lynda didn't hide it, I wouldn't introduce my child as "This is my adoptive son, his mother was an addict during pregnancy". It's accessible in his records and he was her son...
    I don't see the defenceless boy they're describing. He obviously can do research, remembers which bullets go with ar15, has great hand eye coordination, has fine motor skills to reload several times, work in order, run away and disguise, bully only selected people etc....
    We heard professionals testify diagnosis made no difference as treatment is based on symptoms. You're also talking almost 20 years of progress in special needs. Obviously, things are different now.

    Death penalty it’s a pretty easy choice if you ask most people. Dude killed 17 innocent people and injured another 17. Not to mention tried to taze correctional office so that’s like 35-36 counts there should be no trail over this and definitely shouldn’t last this long.

    The defense did a poor job of prepping their witnesses. They should have been informed about the prosecution's research and documentation so that they would not appear "ignorant" or uninformed about the defendant's actions. The various doctors' opinions would carry more authority if the jury didn't hear them admitting to how much they didn't know about his actions.

    In the end, nobody wins in this case. So many lives changed so drastically, so many people were injured and killed. Sadly, however, as someone raising twins with FAS, I do understand this disorder and the attempt by the defense. One thing that I am waiting for, and fear will not happen, is this. People with FASD's may be identified, but the typical forms of treatment, therapy and educational services provided in this country are NOT FASD INFORMED, and so are not the effective treatment modalities. Yes, NC got tons of services, but they did not address his cognitive and learning difficulties in ways for him to then learn more, have better and different supports to then be more successful. This is so common for our children. Everyone sees their behaviors as willful purposeful and premeditated, when actually they are cognitively impaired, and then punished for their difficulties. After years and years of feeling this way, getting therapies adnauseum, feeling so different, but not having those difficulties addressed in an FASD informed way...........these individuals with an FASD loose all hope, become depressed, angry, and start heading in unsafe directions. MOST will not become school shooters, but they are so misunderstood. We really need systems change in this country re FASD.

      Kristen - I have watched this entire trial from Australia, and agree with everything you and Dr Jones have said. In my own experience and understanding, most counsellors/therapists/providers are NOT trauma-informed in any way at all! Whilst feeling nothing but compassion for the tragic loss forced upon everyone in that community, one only has to read through the comments on this post alone to feel the HUGE stigma spoken of by Dr Jones and the unwillingness to try to comprehend the whole picture. No amount of diagnosis and support is going to ever be effective if it is the wrong (or missing) diagnosis. As an adoptive mother, I wish you well with your dear children.

    The expert witnesses for the defense are some of the best I've seen in trials, very solid work in that regard. Often lawyers would only strive to find an expert who would have an opinion benefitial to their client and it always shows. This here feels much more like a natural progression of their case, I really like it.

In my opinion he should get life in prison without the possibility of parole. He could be used to help us prevent these tragic school shootings. I live near uvalde and I have a friend that lives in uvalde and grew up there with her family. Everyone in that town knew that that man was a troublemaker. He had been in trouble with the law multiple times. The people of uvalde are really upset with the man that sold him those guns in the uvalde gun shop knowing full well how dangerous he was! We need to raise the age to buy an assault rifle to 21. I feel strongly about this because at the age of 18 your record is expunged unless you got charged as an adult. It was only a matter of time before he committed another felony in fact there was a warrant out for his arrest at the time of the shooting. Everyone in law enforcement in that town and those that participated that day need to be fired! That back door was broken and it wouldn't lock so it didn't have anything to do with a rock placed in it it had to do with poor funding for a School located in an area with a lot of poverty.
      I want to learn how to prevent school shootings and if that means putting Nicholas Cruz in prison for life then I'm okay with that.

    This trial has convinced me that psychology, behavioral therapy, and case management are not effective. They have become nothing more than assistance in finding excuses for bad behavior. Bring back accountability.

      What draws you to that conclusion? Because it's very clear the killer have behavioural issues, deficits and impairments. Should he have received ongoing, proper support for his needs, throughout childhood it's very likely he may not have done what he did. it does not absolve him of his crime, having these issues caused by his worthless mother, but it's a contributing factor and cannot be ignored.
      Psychology and therapy is indeed effective when used appropriately. Like any treatment, if used ineffectively it has repercussions.

His adoptive mother and his brother were seen and spoken with during this entire period. His problems were witnessed and reported by every teacher he ever had and their reports were ignored. Any one who knew him at Marjory Stoneman Douglas called him the "next school shooter." How is it that the professional idiots missed it but 15 year olds had him pegged? Coddling and medicating him did not work. He clearly knew right from wrong and deserves a swift execution.

      Gosh that's depressing to see. It feels like they have had 9,000 witnesses. I can't believe they have 54 more. It seems excessive.

Part of my education and 3 degrees are in “psycho babble.” Everybody “blames” everybody but the person who did the mass murder and he could care less! He got what he wanted … to kill and be famous! And he WANTS the death penalty. Please, please, somebody give it to him!!!! (No I have never been an advocate of the death penalty. Until now.)

      I have to say I don’t care for the defense (surely FLA can beat this?) and love the state’s attorneys, but I don’t think either of them have been “mean” to a witness. The judge has done a great job under very bad circumstances… just my opinion.

    It’s interesting because they are talking about fetal alcohol signs in children. Nik is an adult. So he has grown up and learnt more about how to control his “tamper tantrums”
    They should be comparing Nik as a child to fetal alcohol children and also to compare Nik now as an adult to other fetal children grown up. Including hallmark characteristic’s. Nik as a kid looks so abnormal as an adult not so much. All of this is interesting also for future studies and cases.

      The brain is irreversibly damaged with fetal alcohol syndrome. It’s not like the grow out of it. And it effects everyone differently. By no means am I making any excuses, but I have 2 children who’s mother drank while pregnant and many people have told me that while they seem fine now, there will likely be things that come out long term.

      He's been doing this throughout the whole trial. He only pays attention when it benefits him. He mostly connects with the girl to his left, not much to the one on his right. Body language seems he doesnt care much for her.

    I still think addict mothers should not be ALLOWED to carry through a pregnancy if they can't stay sober! They should be in some locked-up facility for 9 months, so the baby can be born healthy and then given to adoption. Otherwise, sorry to say this, either forced abortion OR forcibly tying up their tubes. Heavily addicted women should *never* be allowed bear children! Trouble breeds trouble, and then we have these dangerous half-imbecils causing harm and problems to the society.

    But for the court to say something it’s by law right... so by law says or according to law but by saying according which means According to means 'as reported by' or 'as stated by' and refers to an opinion which is not the speaker's opinion. By Law means a regulation made by a local authority or corporation. By law the court says the state was required to videotape because the count can only say it if it’s the law so why are they arguing about don’t say law because “according” to law don’t sound legit right am I wrong !
