- Florida man faces trial for a catastrophic school shooting, but before he does, he must face jurors for a battery case. Prosecutors say that’s Parkland School Shooter, 23, on footage rushing a Broward County jail guard in November 2018. Jury selection is scheduled to start Tuesday, Oct. 5 at 9:30 a.m. ET. Opening statements are scheduled for Oct. 18.
The Shooter is the person facing 17 counts of first-degree murder, and 17 counts of attempted first-degree murder for opening fire at Marjory Stoneman Douglas High School in Broward County, Florida on Valentine’s Day 2018. Then 19, he was a former student there. While awaiting trial at the Broward County Jail, he attacked one of the guards, say, prosecutors. In the Nov. 13, 2018 incident, the guard told him not to drag his sandals on the floor, prosecutors said. The Shooter flipped him off, and, as clear from the video, rushed him and struck him. He initially had the upper hand, but the guard regained control, and The Shooter eventually gave up.
17 people died in the high school shooting: 14-year-old student Alyssa Alhadeff, 35-year-old teacher Scott Beigel, 14-year-old student Martin Duque Anguiano, 17-year-old student Nicholas Dworet, 37-year-old assistant football coach Aaron Feis, 14-year-old student Jaime Guttenberg, 49-year-old athletic director Christopher Hixon, 15-year-old student Luke Hoyer, 14-year-old student Cara Loughran, 14-year-old student Gina Montalto, 17-year-old student Joaquin Oliver, 14-year-old student Alaina Petty, 18-year-old student Meadow Pollack, 17-year-old student Helena Ramsay, 14-year-old student Alexander Schachter, 16-year-old student Carmen Schentrup, and 15-year-old student Peter Wang.
Officials arrested The Shooter shortly after. Interview footage showed him insisting a voice in his head told him to carry out the shooting. He called it the “Demon.”
“Personally, I think you’re using the demon as an excuse,” said Broward County Sheriff’s Detective John Curcio.
The Shooter’s defense has not disputed that he is responsible. They have been trying to save him from the death penalty.

Doctors are required by law (depending on the state)to keep patient records for ten years. I wonder if it’s the same with schools/teachers.
I can’t imagine trying to teach with NC behaving as reported. I feel terrible for this teacherr. NC belonged in an institution. Smh.
When we have students with behavior plans, we have to keep records.
Many people say that Cruz was failed by the system. One thing I cannot understand is why the parents of the other children in NC's classes didn't DEMAND he be removed seeing he was vile, disruptive, perverted and violent. Why weren't the other kids protected by the school and their families? If the teacher was scared, imagine them!
I agree if the parents were told by their children they should have insisted something be done. The teacher wanted him transferred to a more helpful school (don’t even think that would have mattered).
Unfortunately it doesn’t work that way. I am sure the parents of his classmates where told by their children what was happening. They could have complained all day everyday to the administrators and demanded action, but it would not have mattered. The response would have been that NC has rights as a student also, that they had a legal requirement to all of the students etc. It’s possible that their child/student would have been assigned another teacher for that class, but not likely. It’s very unfortunate.

I know many ppl are commenting on judge today. Not being disagreeable, but I've watched all of this and I tend to think she was justified. This defense team has disrespected the process and told this judge to pound sand more than once. If they couldn't identify the line before now then she had no choice but to draw it for them!!

I love this judge. The vitriol comes from the women-hating crowd who would be fine with all of the decisions she has made IF SHE WERE A MAN. She has had to endure not only judgement of her legal ability, but of her makeup, her hair, her expressions and lots of other inappropriate things. No one EVER makes those comments about male judges. When they're stern, men are "aggressive and tough", women do the very same thing and they are "b***hes and unqualified". She's doing an amazing job and deserves every accolade for putting the defence in their place and for her care and consideration of the families and the jury, who have seen things they will never forget. Glad the Judge told the clown show to knock off the bs. They are out of control. What is the deal with their lack of preparation. Their actions and constant movements are a security issue. In addition who knows what Cruz could be grabbing pen, paperclip, etc. I saw him grab something from the attorney to his right. At least that's what it looked like.

Although Cruz had a right to an education (like every school student), that right was not being met in an appropriate setting. Many school administrators are former teachers and when they get a managerial post their educational principles goflying out of the window.

In this case, I believe it was the school system. Teachers and Counselors told the school that he didn’t need to be there.

I cannot believe the failings in identifying this defendants obvious problems and his potential dangerous actions during his childhood. Except for this teacher. I think something seriously bad was bound to happen following the bereavement he suffered too.
He was failed, as were his victims. This is just horrific and tragic.
I don't find that these Lawyers repect the Court and this judge. She is a very smart , and being very fair.
The judge has failed to control her courtroom for several weeks. The mess is her responsibility. I have a feeling the higher-ups in the Florida judiciary told her to sort it out. She's a joke.
When you have a team of attorneys that size. How are you supposed to communicate between one another if you cant turn around and ask them a question when the person the judge asked doesn't have the answer..? Serious question because I would assume they each practice a specialty correct?
Those notes and assignments of his that they showed are disturbing. He was without a doubt jeopardizing the safety of classroom and was for sure acting the same way in other classes. He should have been removed from the school for several of his outburst and behavior. It is not normal for a kid to yell out I want to kill. The courts should have been involved to make sure he received serious behavior and mental health counseling.

It’s a team of attorneys, just like the state has a team of attorneys. This is a very big case with a lot of information, so much that it would take a team.
Two of defence lawyers are simply NC’s wrangles.
The fact that this child was allowed to remain in the classroom with these behaviors is unreal to me. It is no wonder his behavior escalated to such violence. All of the signs were there and the documents presented here are seriously disturbing!

How is the three-way call between witness Vesey and the 2 lawyers, one being an assistant prosecutor, Jeff Marko, not considered to be witness tampering?
Florida Statute Section 914.22(1)
As Marko explained, he called the ATTORNEY for the witness, or the person who represented himself as the attorney, and that is not improper. The attorney chose to put the other guy on the phone. Still not improper. The alleged comments made about it being bad for the district were made by the other attorney, not Marko. Also not improper.
NC was OBVIOUSLY very disturbed and this should have addressed in a much stronger manner. While all children have a right to an education there’s no room for this described behavior in a mainstream classroom.

If what the principal said is true, than THAT is outrageous. Telling a witness that he's worried about his testimony hurting the state because of their failings is ludicrous and witness tampering. I'm not sure why the principal would make that up. He has no reason to.

How is it that the gunman is able to sit day in and day out without being disruptive? Because he can manage himself and has self control..therefore the death penalty should be imposed. The principal should be upset with the atty that put him on a 3-way, not the asst. prosecutor. That atty should rethink his life choices when he is more concerned about "appearences" for the school, instead of the families who were affected by these heinous acts from the monster.

Facts and after the ordeal yesterday with his neighbour wanting to make a movie about him, if he lives that opens the door to that. Like jodi arias after what she did right now is fine in prison and apparently in a relationship with an inmate. No way this guy should be in prison where they still get access to interviews/phones and possibly things like satellite tv for an hour or something.
He is older… and if you watch, he is often talking to his attorneys. There is a reason why they switch spots with him. He just didn’t grow out of having all the disabilities he has. He is still a special needs person who has committed a heinous crime.
Remember that he’s four years older than he was at the time of the shooting, and at least eight years older than the time they are describing when he was being disruptive in school. In the intervening period he has also presumably received counselling, therapy, and medication.
@@andrewjkm1 he was getting all of those services as a child too. His began to see a psych when he was three and got medicated when he was six, until he was 18. Off and on with various medications.
Prayers to the teachers who had to put up with a kid like that they don't sign up for this. They need better pay. Why didn't the other parents say anything to the teacher.. God bless the families prayers .

I feel so bad for the teacher and the students having to deal with this awful kid everyday and getting slowdown on their activities. A teacher can't control a kid like this by herself, she needed the parents to step down and control him at home.

I feel the adoptive parent should have reported him to foster care or said she didn't want him any more because he was too problematic. She also should had never let him go to this school. She should have put him in a special program school for kids with these issues

The 8th grade teacher has no skill in dealing with students such as NC. Him being in a general education classroom without individual support was a very, very bad decision on part of the school district. He was put into an environment where he would have no chance of being successful, that coupled with his behavioral issues is just toxic environment.
That’s literally what she said. It’s not her fault he was placed there. She sought help.
Even if a teacher has specific training in behavioral issues, his disturbing fixations and behavior indicate to me that he wouldn’t have truly benefitted from any interventions they could offer. You can’t fix someone who is deranged like this.

A very unpopular opinion, but, not only was NC failed by society as a whole… His parents, and family failed him too. He should have immediately been taken out of this environment … the first time he showed disturbing attitudes. Not be in a school environment what so ever. And this was 8th grade. The school system failed. He needed more help then they could provide.

After all this evidence from a child, and after this amazing teacher took all these documents to the school principal, how on earth this kid continued regular education and attended high school?

His entire life, people have been trying to help him. He is so self-absorbed & so full of self-pity that all he saw was how hard done by he was & completely rejected the positive attention. He had help, he was loved & cared for, he just loves to be a victim. He can justify a lot then.

Honestly, the way that it supposed to work is that you’re actually supposed to give discovery and who your witnesses are and what they may be testifying to way before the trial starts. So it sounds like to me that this defense table decided they were just going to add something a little in and just now pop this up about this witness!

Yes, to act so outraged about a phone call is a bit strange and alleging "misconduct" just ludicrous since interviewing the other sides witnesses is common practice for the lawyers. I found it almost creepy that the principal was so shaken and felt they wanted to keep him from testifying, since nothing like that was said to him. He wasn't asked to change any testimony or skip it, had there been ANY of that, you bet it would have been used. Makes me think he had a personal agenda in testifying for the defense, in accordance to his beliefs. Which is ok. But he himself may have felt uneasy about it, thus the uncomfortable feeling. I didn't think he helped their cause much either, in cross he had to admit that Cruz could stop his behaviours when another adult was there to watch him.

Very sad what some teachers have to go through, especially for those that love their job and try to be good, understanding towards the students. Imagine going to work each day with a boy like that in your class. Never quite sure what will happen next, always in a tiny bit of fear, thankful every afternoon when things didn't escalate. Getting threatened, cursed, insulted, constantly provoked, ignored, screamed at, even sexually harrassed and still always having to stay calm, show confidence and act unafraid and friendly. I bet she shed a few tears over this in the school year 13/14. I can see why they spend all this money, work and soul on a long trial only and foremost to give a voice to the victims. Because even if he gets the dp, I don't think he will ever actually be executed. There will be so many appeals for years and years to come, new psychological research and this and that medical finding and he'll be totally insane after 10 years in prison, if only for the lack of attention or the meds they'll have to give him. Or he keeps up his behaviours and some other dude gets rid of him inside.

She did. She went above and beyond. I don’t think anyone took her seriously enough. She never stopped trying to get him help, or in to a more controlled, constructive school environment. I’m glad she logged everything. She should be suing the school as well as the school board for not listening to her. Clearly she was trying to warn anyone she could about NC. IMO.

I'm sick of the excuses. That sicko planned out and very thoughtfully executed his plan. I say death! I have a few disabled members of my family and the system did NOT fail him. The Judge should give that defence lawyer contempt of court she has been disruptive today.
What this kid did was inexcusable in every aspect. I know where I would stand if I was on the jury. I just can’t help feeling that this judge is very against the defense in her rulings. What concerns me is more appeals or verdict possibly being overturned as a result of a bias. Don’t get me wrong. He is the worst of the worst. The families don’t need this to go beyond the “normal” appeal process for death sentence

Why would you call her as a witness for the defense. His assignments show he wasn’t trying , didn’t care and he was punk. How does this help his case. He should have been kicked out of that school.
Sympathy, he was failed by the school system, the jury shouldn't fail him.

I constantly hear how kids are denied or otherwise prevented from a fraction of what NC received. Am I wrong? Again, no disrespect. I have the highest regard for teachers and was relieved (and slightly disappointed because he had wanted to be a teacher for almost his entire life) when my son decided the profession wasn't for him.

Quite interesting how NC is engaged in the defense case. He sure wasn't with the state case. It was like he was lost gazing stares and what not. To me this shows he had selective actions. He put on his demeanor by choice.
She was a great judge, had to endure the disrespect from the defense. Horrific that she had to resign due to defense complaints. She was extremely professional.

Listening to the teacher read her log of the defendants behaviors in her class is horrifying because I have gone to school with students that acted just like that and it is scary to think if they were capible or if they fantasized about shooting the high school we went to up

No one deserves to die or get murdered and no one deserves to continuously fall through the cracks of a broken system. It doesn’t make it right what happened but what if the shooter never meant to kill in his very sick and tortured mind and just wanted people to feel the pain and struggles that a sad tortured life he lives. It’s such a truly very sad storyline in both sides. This kid should have life behind bars no death. He’s been dead all his life without a life preserver.

OBVIOUSLY, someone can control their emotions at times, it’s the 0 to 100 impulsive behavior he explained. The 2 last witness begged for assistance and were ignored. Now they are traumatized and feel guilt because of this.
You seen the same thing when he attacked the prison guard. He was fine one second, then out of nowhere attacked him. I’ve seen many kids that were similar to Nik at my school. They do somewhaT comply at first but then they just keep repeating the offensives over and over again. He had 15 IN SCHOOL SUSPENSIONS. Is that not discipline? People like this don’t learn their lesson after the 1st time, nor the 15th time. Nik was FAILED by the system. So many red flags, but they simply ignored it.

I have 15 grandkids, and we are just a regular, typical family. No crazy religions, no over the top conspiracy theorists, not doomsday food storers or anything like that. Just a big huge awesome family. This kid, NC, is the very reason all my grandkids are homeschooled. They have a ton of interaction with other kids with co-ops, and play sports in the community. But my kids are not willing to take a chance on the public school systems with everything going on these days. School shootings, kids in horrible homes with their minds in the gutter and some with criminal intent, curriculum we just can't get on board with, and SO much more. My own kids were in public school, but our country has truly declined in a big way in the last 20 years, and I for one am very relieved my grandkids are in a safe and healthy environment day in and day out. God bless those who've been heavily impacted by this kids actions. May broken hearts heal over time and may the memories of the kids lost remain alive forever.
So true.Normal kids Cannot attend school and be safe in the society because of all this inclusive education - kids with mental or behavioural issue are forced on kids with no issues , which is dangerous.
After seeing the school work, and seeing NC's behavior, I'm convinced he had a learning problem and he felt so alone and bullied that it 100% affected his school work. He lived in hopelessness.
His behavior was a way to express himself in that he did not understand the work, nor able to complete it. Hindsight is always 20/20, but I'm convinced that that is what set off most of this kids' outbursts. He also exhibits poor impulse control, and was unable to regulate his emotions independently. Behavior is a form of communication. Sad.
@@tammys8709behavior is also a form of manipulation. He could sit there and focus on work when someone that was intimidating to him was watching. He purposefully chose to act out when they were not. He knew exactly what he was doing. Yes, he should have been in a special school, most definitely in some inpatient program for an extended time with education. Unfortunately, he was not. However, he was given a better start, well, since adoption, than most in his situation with bio mom. Is his bio mom partly to blame? Absolutely. Is he also to blame? Absolutely. He was able to control himself when he needed to and give answers to counselors they wanted to hear. He knew what he was doing, delayed or not, he knew.

Lawyers on both sides sound like they all just got out of law school. No proper etiquette, disorganized , abrasive, combative. I feel bad for the families and jury to have to deal with this circus sideshow. Judge should be happy this isn't as widely watched as the OJ trial. My God.

He was trying to get kicked out, and did everything to get kicked out and they just let him stay and gave him an IEP. Anyone I know from my school years would have been long gone after these drawings and comments and writing. Everyone was basically condoning his behavior. this was bond to happen and they all knew it and did nothing including the authorities. Cruz reminds me of those bullies who threw staples, gum, and spit wads in my hair in middle school and who probably have an IQ of triple negative 25. I see nothing but a bully when I look at Cruz. I feel bad for him to a (small) degree, but this mitigation evidence does not outweigh those factors justifying the death sentence. I can’t believe he was so disrespectful to this teacher. I can only assume that he learned some of this behavior from his brother.

This judge drives me nuts. The first time I watched this trial I only watched snippets and thought the defence was terrible but now that I’m watching the whole thing, it’s no wonder this judge “retired” right after this trial. Horrid behaviour. Takes a two hour lunch for herself but can’t give the defence 20 min to file a motion because it would delay things… lol.

Yep they mentioned he is on another trial day but I can't remember exactly what the meds were. I know one of the meds was a type of anti-psycholtic which is interesting

Looking at the logistics in this case, i am curious what the appeal process would look like. The judge is going great, however I can sense a lack of experience in death penalty case such as this one that is high profile is extremely concerning
He can appeal and if a higher court finds his rights were violated, his sentence could be commuted to life without parole. Either way it matters very little.
@@Jessi4JC yes however that is frustrating for the family of the victims, it might not matter to you but to people effected first hand is a whole another story. We in five ten years won’t be remembering this case but the families are! Also not to forget the amount of money spent on appeals and court proceedings, that why judges have to be careful

She was once a lawyer. She went to school for that. Look it up.

A women stated on oath I forget who she was I just remember her talking about how she calls Cruz about everyday or Cruz calls her, anyway she goes on about how childish he comes off to be. I wonder if it’s a new trait? Or if he’s always been childish in ways. I haven’t watched every trial. But can someone fill me in if this has been discussed/gone over yet? In court.
