    You have pointed out the precise nature of the problem. Judges make lofty statements but these issues remain as orphans and quite a few individuals find themselves in a Catch22 situation. The vast majority of citizens carry on with their daily life, undisturbed and unaware of these issues. I hope this article will be a gentle reminder to the sacred institution called the judiciary, to rise and perform it's primary role of upholding our constitution and citizens' rights to life and liberty.

    The Supreme Court of India totally failed its people by its indifference in most of the important cases i.e., ED cases, CBI cases, IT cases, PMLA, Hindenburg case, Rafael case, Sanjiv Bhat cases. It follows BJP/RSS dictates.

    Thanks to the "Wire" for this video. It looks like some Judges have very conscious effect of political repurcissions, on many judgements, which may look coloured due to certain circumstances. When circumstances change, they conveniently change their stance. Thus causing confusion in the minds of many advocates, or rather, making room for different interepretations. Jai Hind !

    Judges seem to be fuelled by this innate desire to provide this sort of vigilante-esque justice, without nipping the problem at an institutional level, something which an institution of SC’s standing demands. They want to be batman, but don’t want to fight the joker.

  • @shantanusapru
    @shantanusapru 3 หลายเดือนก่อน +2

    Excellent, informative video!!
    It is historical fact that authoritarians have always gained (& retained) power through the use/abuse of the judiciary; by controlling the courts...be it in fascist Italy, Nazi Germany, or modern day Trump's/MAGA's USA...
    Just like in the Emergency of the 1970s, the judiciary was not just a mute spectator but an active participant, today too, the judiciary is not just an innocent by-stander, but an active participant in the backsliding of democracy...
    The judges' words vs actions have huge, glaring discrepancies, and the hypocrisy is plain to be seen by one & all...
    And just as history has condemned the pusillanimity of the Judiciary in that era's Emergency, I am sure history shall equally harshly judge the craven timorousness of today's Judiciary in this modern day 'Emergency-lite'...perhaps even more so, cuz we had the lessons from the first one, and apparently followed Georg Hegel's maxim: "The only thing we learn from history is that we learn nothing from history."

    What you narrating is absolutely right and every conscious citizen can sense it abundantly. Not only in this CJI's time but for quite some time we are noticing the massive deterioration in the standard of the judiciary , servility to to rapacious executive being it's most abominable feature. It is time not only to narrate facts of brazenness and indifference bordering on putting the constitution to a joke, but time has come to seriously think about the remedy for this dysfunctional justice system that is going downhill with passing time.

    What is actually the use of SC or the lower courts if it cannot protect its innocent citizens and ensures justice as per guaranteed by the Constitution. People have completely lost faith in the judiciary. What is preventing the SC in reigning up the ED, CBI and IT. Who has became a rogue and not a mandated law agencies. If the SC cannot do that it doesn't have any moral right to hold offices.

    CJI isn't very different from Modi or BJP, Hindutva allies, speaking too much here and there but doing what and how he likes, probably fearing the consequences, of course either doesn't feel the pain or didn't have courage, I don't sense this CJI or previous CJIs who transferred the case to coming judges, it seems everyone is passing the bucks to others or being silence is best practice.
    We are living in drama and jumla era, where Modi or Bhagwat is supreme, even if they are dumb but who cares, when judiciary is failing and falling apart.

    It proves that no man is fit enough to dispense Justice. There might be some judges who are known for honesty and integrity but justice doesn’t end there. Anyone who is entrusted with power and duties and responsibilities of upholding justice have to act even when they see injustice done to someone. All judges I would request to study the justice system in Islam, if he or she is really committed to justice, before occupying the position of judges in the Courts.
