  • At the heart of the FBI’s investigation into former President Donald Trump is the handling of government documents - including classified documents.
    When the FBI searched his Mar-a-Lago home in August, they found numerous top secret materials. Some were labeled as sensitive information, which means they are supposed to only be viewed and stored in very secure facilities.
    Trump argues he declassified the material while he was President, but there’s no written record of it. If the President declassifies something - but doesn’t document it - is it really classified?
    WSJ explains the government’s classification and declassification process and what authority the President has - and doesn’t have.

      They don't need to file paperwork to declassify documents. It's an informal process that requires zero consultation with any other entity and requires zero paperwork.

    For most of what was recovered in the search, Top Secret & TS-SCI documents, the answer is no. For the rest, yes, provided the legal procedures are followed, which don't appear so.
    He knows he is toast. That is why he is attacking his accusers. That is what he has always done, even before entering politics.

      the President is the apex of classification. The entire classification system exists with the president at the very tip of the pyramid. All intelligence agencies exist to provide the President with information in the PDB. The President can snap his fingers and declassify any document he wants for any reason they want and no one has to sign off on it because no one is above the President. If Biden wanted to declassify all Area 51 documents there is no general or no group of people form the FBI, CIA, DNI, NSA or whatever agency that can stop him.

      @@bigbrotherisasob The documents belong to the original classifiers (US military, CIA, FBI and so on), presidential records generated between Jan 20 2017 to Jan 20 2021 go to the National Archives per PRA, only Trump's personal files (personal letters, communications with his personal lawyers, (not white house lawyers), family go with trump)

    Literally does not matter if any of the documents were classified or not, that's besides the point. They were not his to take. He broke several laws by doing so, that is a fact. He is not above the law. If I had taken any classified material home with me during my time in the Navy I would've been arrested, thrown in the brig, and charged accordingly. If we are truly a nation of laws, then he must be held to the same standard.

      Ok smarty, what are the contents of the documents specifically? How does classification of documents work? What is protocol? Are all documents considered classified until the president declassified them? Some of these documents could be very meaningless stuff that are automatically classified as secret. I believe the content is going to eventually come out, and it’s going to be nothing really important. Will people that jumped up and down pointing finger at trump apologize for jumping the gun, or will they be good little minions and focus on the next shiny object the media dangles in front of them. The media and democrats have been 100% wrong about trump, as every allegation has fallen flat, yet the minions that support the establishment keep believing the media. That is basically just how ignorant some people are in this country. They will believe anything they hear and become outraged over it, and when it pans out to be nothing, they will forget it, and move on to the next fairytale.

      Since the law only says Government documents and not classified Government documents, Trump having them in his possession became illegal from 1/20/2021 when Trump became a private citizen.

Every past President has done that. But all of the rules and precedents are different now because it's Trump and they hate him.

    So the POTUS says something is declassified this means that he has to do all the work himself? It seems like there would probably be someone else that would do the rest of the work.     The biggest concern is not why Trump took the secret classified documents but rather what happened to them during their time at Mar-a-Lago and where are the contents of the empty folders? Were they copied by Trump? And/or were they photographed by agents of countries hostile to us?

    There is no documentation that he declassfied the documents that were at Mar-A-Lago. Hypothetically, even if he did, he can´t just take them without permission from the National Archives according to the 1978 Presidential Records Act.

All documents are treated and assumed to be at their classification level until someone in informed they're not classified anymore. Any President can literally point to a entire warehouse at Area 51 and say every document in this secret warehouse is now declassified and that's the end of it.

    WSJ, WP, CNN, MSNBC, PBS, FOX all should ask access to the declassified documents list and also for the declassified documents. This will clear things up.     Second POTUS has absolute classification and declassification authority, if he says it’s TS then it’s TS and if he says release it to the public the it’s released, PERIOD.

      The 2009 executive order directs the head of the department or agency that originally deemed information classified to oversee declassification reviews, and it sets some standards for them.
      The executive branch has regulations laying out the process that should be followed, such as a requirement to make sure that other agencies and departments with an interest in the secret are consulted. There are also procedures for the removal of classification markings on documents.

    At a 101 level, the US intelligence system is built on the military (sometimes known as the DoD) intelligence and the non-military (sometimes known in difference) intelligence. Both are commonly known as the IC -- the intelligence community-- managed by the NDI, the national director of intelligence, and supervised by the Congressional committee on the intelligence and the WH presidential instructions.... Well, people can ignore the rest of how the complexity in the priority set by the IC chain of command is. How the IC talks among each other at the diff level of classified, for an example how FEMA can get tbe DoD intelligence info or data for its field humanity-reliefs ops, or how military cross-talks to the non-military. Which community is assigned to collect the US domestic intelligence geospatial data without infringement of the Constitutional rights, etc and etc. One thing we all know for sure that no one can be above the laws of the land, except donald trump?!?!! or some abusing top government's people.
    Now, FBI is part of the IC but has nothing to do with the classified DoD methodology or vice because of no money for it.
    The classified is easy to go up, but not that easy to go down without the IC scrutinized and approved. Even the WH presidential order! For example, Barrack Obama decided to declassify the old priority list of US nuclear targets around the globe... It took more than 12 months to come up with the declassified that could be released to the public and the media. But the declassified did not cover every original thing because the sanitation or scrubbing process was to either change or redact the list by each IC member. The FBI is no god of the IC but follows the NDI instructions and the rules of IC membership.
    Trump knows the IC rules. And he knows he is in the losing end, so he comes with his old dog-trick of blamimg somebody behind the murky rules. He only wants to be like Kim J Un for the U.S by keeping his secret talks in doc to his endearing NK friend, mr Un!!
