The concept is a tad bit complicated...let me try to explain. Solicitation of sex is illegal in India. Considering all interpretations or precedents available it essentially means, if I have to boil it down to a simple example, if a person approaches a prostitute and says have sex with me and I'll give you Rs. 1000, it is not illegal. If the prostitute agreed and dies the act and gets paid, no illegal act has been committed. However, it a prostitute approaches a person and says you can have sex with me and in return you'll have to pay me Rs. 1000, then that will be considered as soliciting and that will be punishable by law. . Now, consider the 1st example, where the person approaches the prostitute, if the prostitute agrees to the proposal and gets involved in sexual intercourse and gets paid then there is no illegal act committed, as I said, but as soon as she/he makes a counter-offer i.e. tries to bargain it'll again come under the scope of prostitution and will be punishable and that is why I said negotiation for the price of sex will be punishable technical that too only at the end of the prostitute not the client/customer. I hope now the concept is a bit more clear. . . . . . P.S: Here's something intersting, if a person approaches a woman and offers her money in exchange of having sex, and the woman decides to complain about such act to the police, it'll be punishable under section 354 of the IPC (Outraging a woman's modesty) .

But who is there to complain against them? neither the sex workers nor the customers have the awareness to challenge the arrest in the face of it saying it is illegal. In any case, the police make these arrests to maybe get some money out of the arrestees and then let them go without slapping any charge against them. Customers are arrested on charge of solicitation. However more than legal arrests, in such raids its more about harrasment. People don't want their name s to be involved in cases related to this and hence are willing to pay hefty bribe to go scot free...
