They will ask for salary proof of 12 months generally from the previous 15 months to prove the same. The key line to read in the policy statement is "In addition to this, if the applicant earns more than the minimum salary threshold then the individual would be eligible to make an application". Also definitely there will be a clause to ICT people in switching to PBS. Assume if they apply that ICT people can apply for PBS then the companies who bring ICT candidates to UK will be in soup as all will be switching to PBS with job offer as soon they enter UK.
Yes, that's exactly what happened last time too. ICT Employees switched to tier 1 without the cooling off period. However last time , the crucial difference was Tier 2 ICT employees were allowed to get ILR after 5 years. So many indian companies were able to retain their employees as they anyway got their ILR after 5 years in UK without having to switch to PBS. And after 5 yeas of being in UK most people used to quit their Indian employer and find a UK job. It's common. Indian companies are prepared for this.
Mate I would like to correct one point, I dont think a person will be awarded Points based on Home country salary from where he is applying from . Those salary thresholds are for the people who has job offer in Uk with mentioned Salary. So it is nothing to do with what you earn in India or a matter of fact in any country.

Hello Anand, In the ukgov website on point based system they have mentioned as belowStudents and specialist occupations 20. Students will be covered by the points-based system. They will achieve the required points if they can demonstrate that they have an offer from an approved educational institution, speak English and are able to support themselves during their studies in the UK. Please explain this because they have stated that students are directly eligible like that
Gautham, if you are able to meet the 70 points criteria like anyone else then students will certainly get it. The trick is the salary. Students may not get points for the salary as they won't be working in university or even if they did part time they may not earn that much. So then you are trading points based on PhD and other things. So the easier option is the 2 years PSW visa and then during that time get the PBS
I see this is just the extension of existing tier 2 general. For new PBS system or existing tier 2 you need job offer. This is critical. Forget about salary criteria from India or UK. Also for those who are hoping that ICT can switch to this visa without cooling good luck. My personal bet is that won't be the case. Even if it counts you need another 5 years for ILR as the current tenure in ICT won't count for ILR. You can oly go for long residency 10 years. In short PBS is rebranded tier 2 including EU countries.

Too early to start looking now Kannan. Full details of the PBS is not published yet. This is the initial policy statement. Also they have not officially confirmed the cooling off period for ICT till now. So we should wait till that.

Karthick, I think it will be similar to how they stopped tier 1 or HSMP for e.g. when they stopped it all people who had come into UK already through tier 1 continued to be in the tier 1 programme till they got their ILR. So anyone who is already on tier 2 general should have an option to continue or move to PBS.

Premalatha, I don't think there is any Age bar. last time when they had points based system, they have a minimal (5 points) for age for people under 30, but even then I didn't need that 5 points to come to UK.

I have spoken about it in today's video ozone063. I think there will be more PBS sponsors than the tier 2 sponsors. So switching jobs should become easier in my opinion

I know it is a lot of additional effort for me to create content in English and Tamil and it is tiring to make the same content twice at times as the shooting and editing of a 20 minute video can take more than 2-3 hours. But it is a question of satisfaction. Even though the tamil population who are aspiring to come to UK would know enough english, there are still people who are not proficient enough, especially the dependant spouses who may not be comfortable with English and they may be able to better understand instead of being in dark. Hema, Since it is an immigration path visa, like tier 2 general and tier 1 , there should be an option for having 5 to 6 years visa after which you can get the ILR. And from what I understand, this should make it easier to switch jobs as long as the new employer has sponsorship license.

It is a new route. With regards to the ICT cooling off period, This hasn't been fully confirmed. They said more updates will be confirmed soon. However this is what happened during the last points based system. Tier 2 ICT were able to switch the points based Tier 1 visa without the 12 month cooling off period. So I assume it will be the same.

Yes Vasudevan, last time also people were able to move from ICT to tier 1 without much restriction. We will get a lot more streamlined version of the details soon. But I assume there would not be any problems.

That's interesting, most of the people who voted for Brexit had a feeling of job insecurities as neighbouring European gets more of the jobs that British-residents deserve, but it seem now without RLMT, employers can offer jobs to anyone as long a potential employee has qualifying skills, experiences and meet the salary scale by achieving 70 points. I have a feeling most of the middle-eastern workers easily can achieve them.

Priya, when you switch from tier 2 ICT to another visa like tier 2 general or tier 1 exceptional talent, you are eligible for the ILR , but only after the minimum years required in that visa (for e.g. in tier 2 general you have to spend another 5 years). So even if you were in the country for 4 years for e.g. in tier 2 ICT, that doesn't count towards the ILR today and will have to establish another 5 years in the PBS I would assume. Hope this helps.

It is a "intra company transfer" . So you may need a new job offer for a UK Entity. 3. This is also unclear. Tik Tok this rule is from Jan 2021. If your sponsor has already started processing then it's good for you now rather than to compete with a larger crowd at a later date.
Anna, I'm getting job offers here in UK (while on dependant visa) but no company is willing to give work permit, now with this PBS is it okay I take up job without any work permit and still can I gain citizenship after 5 yrs of working here ?
Roshni, take up the job offer. No company will give you work permit to start with. But once (dependants specially) you start working and after a few months, the company will recognize the value of the person and to retain them longer they will sponsor work permit . But not at the outset. Also if you start working now and your salary goes above 25k £ in a year, then you can easily get the PBS visa. And yes the PBS visa should give you ILR in 5 years and Citizenship in 6 years.

Senthil, this is again unclear at this point. However, when some moves from Tier 2 ICT to Tier 1 Exceptional talent today (without the 12 month cooling off period), it is the comparable option. And in that they have to serve 5 years again in tier 1 to get ILR. So i think it will be like that.

Ranjith, this should work in conjunction with the PSW visa which is now 2 years. So you finish PG, you get 2 years to find a job and work and in that 2 years you make sure your salary goes above 25k in UK.

If you read the MAC Guide, previous points based system details , and then read this policy statement you can understand it is an evaluation criteria to determine whether you are skilled or not. They will ask for salary proof of 12 months generally from the previous 15 months to prove the same. The key line to read in the policy statement is "In addition to this, if the applicant earns more than the minimum salary threshold then the individual would be eligible to make an application". So you should already be earning this minimum salary threshold. I have also explained this in my English version which I have just posted

Also definitely there will be a clause to ICT people in switching to PBS. Assume if they apply that ICT people can apply for PBS then the companies who bring ICT candidates to UK will be in soup as all will be switching to PBS with job offer as soon they enter UK.
Yes, that's exactly what happened last time too. ICT Employees switched to tier 1 without the cooling off period. However last time , the crucial difference was Tier 2 ICT employees were allowed to get ILR after 5 years. So many indian companies were able to retain their employees as they anyway got their ILR after 5 years in UK without having to switch to PBS. And after 5 yeas of being in UK most people used to quit their Indian employer and find a UK job. It's common. Indian companies are prepared for this.
Mate I would like to correct one point, I dont think a person will be awarded Points based on Home country salary from where he is applying from . Those salary thresholds are for the people who has job offer in Uk with mentioned Salary. So it is nothing to do with what you earn in India or a matter of fact in any country.

Also this is exactly what they did in the last Points Based System. You needed to show 12 months salary from your Indian salary.

Gautham, if you are able to meet the 70 points criteria like anyone else then students will certainly get it. The trick is the salary. Students may not get points for the salary as they won't be working in university or even if they did part time they may not earn that much. So then you are trading points based on PhD and other things. So the easier option is the 2 years PSW visa and then during that time get the PBS

I see this is just the extension of existing tier 2 general. For new PBS system or existing tier 2 you need job offer. This is critical. Forget about salary criteria from India or UK. Also for those who are hoping that ICT can switch to this visa without cooling good luck. My personal bet is that won't be the case. Even if it counts you need another 5 years for ILR as the current tenure in ICT won't count for ILR. You can oly go for long residency 10 years. In short PBS is rebranded tier 2 including EU countries.

Too early to start looking now Kannan. Full details of the PBS is not published yet. This is the initial policy statement. Also they have not officially confirmed the cooling off period for ICT till now. So we should wait till that.

hi anna, i have a doubt in point based system, if they introduce tier 2 points based system effective from jan 1st 2021 means did they removed current tier 2 general visas completely, (i.e) its is an replace instead of tier 2 general
Karthick, I think it will be similar to how they stopped tier 1 or HSMP for e.g. when they stopped it all people who had come into UK already through tier 1 continued to be in the tier 1 programme till they got their ILR. So anyone who is already on tier 2 general should have an option to continue or move to PBS.

Premalatha, I don't think there is any Age bar. last time when they had points based system, they have a minimal (5 points) for age for people under 30, but even then I didn't need that 5 points to come to UK.

I have spoken about it in today's video ozone063. I think there will be more PBS sponsors than the tier 2 sponsors. So switching jobs should become easier in my opinion

I know it is a lot of additional effort for me to create content in English and Tamil and it is tiring to make the same content twice at times as the shooting and editing of a 20 minute video can take more than 2-3 hours. But it is a question of satisfaction. Even though the tamil population who are aspiring to come to UK would know enough english, there are still people who are not proficient enough, especially the dependant spouses who may not be comfortable with English and they may be able to better understand instead of being in dark. Hema, Since it is an immigration path visa, like tier 2 general and tier 1 , there should be an option for having 5 to 6 years visa after which you can get the ILR. And from what I understand, this should make it easier to switch jobs as long as the new employer has sponsorship license.

It is a new route. With regards to the ICT cooling off period, This hasn't been fully confirmed. They said more updates will be confirmed soon. However this is what happened during the last points based system. Tier 2 ICT were able to switch the points based Tier 1 visa without the 12 month cooling off period. So I assume it will be the same.

Yes Vasudevan, last time also people were able to move from ICT to tier 1 without much restriction. We will get a lot more streamlined version of the details soon. But I assume there would not be any problems.

That's interesting, most of the people who voted for Brexit had a feeling of job insecurities as neighbouring European gets more of the jobs that British-residents deserve, but it seem now without RLMT, employers can offer jobs to anyone as long a potential employee has qualifying skills, experiences and meet the salary scale by achieving 70 points. I have a feeling most of the middle-eastern workers easily can achieve them.

My husband has Tier 2 ICT which expires on Mar 2022.But we came to India Oct 2018 in search of sponsorship to transfer Tier 2 General..Our cooling off period got over by last year and still we didn’t find any genuine sponsors..Can we be eligible for applying ILR if we go by same Tier 2 ICT and transfer our visa to point based system Visa?? Priya, when you switch from tier 2 ICT to another visa like tier 2 general or tier 1 exceptional talent, you are eligible for the ILR , but only after the minimum years required in that visa (for e.g. in tier 2 general you have to spend another 5 years). So even if you were in the country for 4 years for e.g. in tier 2 ICT, that doesn't count towards the ILR today and will have to establish another 5 years in the PBS I would assume. Hope this helps.

Priya , that's the expectation. Although it has not been confirmed yet by Home Office. Last time when they brought Points based system(HSMP) the ICT people were able to switch without the cooling off period.

2. I don't think so as the ICT is not a job offer. It is a "intra company transfer" . So you may need a new job offer for a UK Entity.
3. This is also unclear. However, I assume like last time you should be able to work with any company as the visa in your name not tied to the company. The job offer is only an eligibility criteria.

Tik Tok this rule is from Jan 2021. If your sponsor has already started processing then it's good for you now rather than to compete with a larger crowd at a later date.

Roshni, take up the job offer. No company will give you work permit to start with. But once (dependants specially) you start working and after a few months, the company will recognize the value of the person and to retain them longer they will sponsor work permit . But not at the outset. Also if you start working now and your salary goes above 25k £ in a year, then you can easily get the PBS visa. And yes the PBS visa should give you ILR in 5 years and Citizenship in 6 years.

Employee need to pay to use the NHS. All work visas need to pay. And for all dependents as well.

Senthil, this is again unclear at this point. However, when some moves from Tier 2 ICT to Tier 1 Exceptional talent today (without the 12 month cooling off period), it is the comparable option. And in that they have to serve 5 years again in tier 1 to get ILR. So i think it will be like that.

Ranjith, this should work in conjunction with the PSW visa which is now 2 years. So you finish PG, you get 2 years to find a job and work and in that 2 years you make sure your salary goes above 25k in UK.
