    Sir many of them say the right to vote is a legal right as it is mention in the representation of people Act 1951 can you please explain why it is known as a constitutional right

    • @LEGALLIFE
      @LEGALLIFE  3 ปีที่แล้ว +1

      Article 326 of the Constitution guarantees the right to vote to every citizen above the age of 18. Further, Section 62 of the Representation of Peoples Act (RoPA), 1951 states that every person who is in the electoral roll of that constituency will be entitled to vote. Thus, the Constitution and the RoPA make it clear that every individual above the age of 18.
      That's why I think it is a constitutional right.

    Isn't Right to Information an implicit Fundamental Right under Article 19 & Article 21? So is it a fundamental right or not?

    • @LEGALLIFE
      @LEGALLIFE  3 ปีที่แล้ว +2

      The right to information is a legal right granted to the citizens by virtue of the Right to Information Act, 2005.
      However, the right can be argued to have its origin in the right to freedom of speech and expression [Article 19(1)(a), Indian Constitution], which is a fundamental right.
      Hence right to information can be said to a fundamental right.
