If the act is itself unlawful he cannot take recourse of mistake of fact . In R vs Prince a person was prosecuted for abducting girl below the age of 16 years under the belief that she was 18 ,
As the act ie (abduction) itself is an offence under 361 . He wasn't allowed to take plea of mistake of fact and accordingly prosecuted.
