  • The man suing Gwyneth Paltrow over a 2016 skiing collision at an upscale Utah resort told a jury Monday that the actor-turned-lifestyle influencer crashed into him from behind and sent him “absolutely flying.”
    “All I saw was a whole lot of snow. And I didn’t see the sky, but I was flying,” said Terry Sanderson, a 76-year-old retired optometrist, calling the impact “a serious smack.”
    That’s the opposite of what Paltrow testified, and the jury has heard dueling narratives as the trial enters its second week. Paltrow said Sanderson was uphill and hit her from behind. He’s suing her for more than $300,000, claiming she skied recklessly and that he has permanent brain damage from the crash that altered his personality.

      Think about it, if you ran over a homeless person are you going to sue them? You could but you can't get blood from a turnip. If you get hurt in an accident you would like to be compensated in some way. If they person that harms you had money that is a good thing. If they are a hobo with zero then you get screwed. Why would you sue a hobo if they have nothing to give?

    Who sues someone for colliding on a ski mtn? You SKI at your own risk… I have a problem believing a 115 lb woman could do all that damage to his body. She wasn’t skiing fast, it was an accident. I don’t understand this whole thing! If I were a judge, I’d throw the whole case out.

      Always stay in control, and be able to stop or avoid other people or objects.
      People ahead of you have the right of way. It is your responsibility to avoid them.
      You must not stop where you obstruct a trail, or where you are not visible from above.
      Whenever starting downhill or merging into a trail, look uphill and yield to others.
      If the skier or snowboarder that hit you violated any of these guidelines, that can be good evidence of negligence.
      Sorry kid but you do not get to make up the rules of the road. You probably also say "Who sues people if I run them over drunk driving?" If you are the drunk then sure you would want to be able to run over people with no police, jail or law suites. Same thing with skiing if you are reckless putting other people in danger because of your antics that is on you. Don't ski if you intend to be reckless and put others in danger. Stay off the slopes.

    So - the way I see it: Paltrow had the Right of Way! It's like this guy went out of his way to collide with her! Her must have been realizing dollar signs.

      What dollars? its been 7 years and all he has is time spent with Doctors, lawyer bills etc. Don't think he has seen a red cent from this case and its a paltry 300k not worth it.

      Because if that is what you think I would have to dispute your conclusion. It's not about the $300,000. It's about the veracity of the claim but she is responsible for the accident.

      For him to be seeing dollar signs before the Collision he would have had to have identified her beforehand. Correct?
      It's probably more likely that he lost his concentration and collided with her. She was tracking a fairly narrow line going down slope. The testimony and the animation support this. He on the other hand was talking from one side of the run to the other. So he was going fairly quickly because he started behind her and then caught up. As he was skiing from the left to the right on a collision course with Paltrow he was going to the pretty good clip and probably got distracted with the amount of traffic.

      Fierysaint1 no lanes on the open slopes, it’s your job as a skier to avoid the people in front of you.
      Same applies when you set off from the side of the slopes, ski instructors drill you in classes to look up before you set off so you don’t wipe someone needlessly.

      In this scenario it seems like he was trying to get around the other skier, but they kept moving to the right and then GP who was moving left, cut right and closed the gap and he didn't have anywhere to go.

    I really hope the jury is capable of using proper critical thinking skills, cause this needs to be found in Paltrow's favor. This guy's story is so easy to pick apart. He doesn't remember what happened. You can tell he's going by what he and his friends/family/attorneys have fed to him. He couldn't remember quite a bit. Claims he saw her, then didn't see her. Even the details of how each was skiing down this hill at that time support that he was the reckless one.

      Exactly... She doesn't have eyes in the back of her head. Sanderson was coming from behind. He needed to avoid her. Its clear to me that they collided and that was that, both made an unexpected swerve but this was an accident. Not malicious. Sanderson is pressing a lawsuit years later for millions to prove a point perhaps.

    OK, JUDGE, PLEASE THRIW THIS RIDICULOUS CASE OUT OF COURT. If everyone who collided with each other on the ski slopes sued, then no one would be skiing at all. PLEASE, I'M SURE GWYNETH HAS BETTER THINGS TO DO!

      Wreakless skiing is enough of a issue for states to have their own laws specifically for the act.
      Utah municipal code 8-2-8 specifically states that when skiing wreaklessly that results in injury the injured party can seek damages making the up hill skier liable for injury of others. .
      For a judge to throw this out would be unjust as the injured party has every right to do so.

    Are you kidding me? This is the first time I have ever heard about this and this is what is happeneing? Comp sims of two people colliding on a trail and its on trial!!?? For those of you who ski is this something you would acually do? Pursue a legal case against another skier for an acual accident? Nobody looked out of control or was sking recklessly the mountain said too bad. Apon purchase of this lift ticket you will not hold them liable for injuries sustained while using their trails. But then found out who they hit. Somebody is looking for a paycheck. This is the dumbest thing Ive ever seen. Now we cant even ride without worring about fragile little money grubbing pos’s waiting for a slippin jimmy moment.

    If someone runs into the back of your car who's at fault? The person rear ending you 100% of the time. If he ran into her back, pay her the dollar you owe her.

      It looks to me as if Gwyneth wanted to be where her children were, went for it but didn’t see Sanderson coming or if she did, it was too late. Sanderson suffered broken ribs and his head hit the ground. He should be the one properly compensated.

      Sanderson in his testimony said he was passing her and said passing on your left. He then said he didn’t see her in his peripheral vision and it had been awhile so he turned his skis and hit her from the back.
      That’s why his vision was so important during the trial.
      He may have been passing but he did not pass.
      Instead he was beside her at best.
      It came down to his being blind in one eye and did not see how close she was, did not pass her and she was slightly in front of him giving her the right a way in the mountain.
      It also explains how he hit her from behind and not her hitting him from behind.
      The doctors testified that his injuries were that if someone who got hit from the front and not from the back.
      That also makes him the person in the back.
      She does not deny that she caused him injury.
      When they hit they fell to the side and back.
      Sanderson fell to his side Paltrow fell backwards and landed on him. When she did that’s when his ribs broke.
      Again consistent with someone who was behind her and not in front.

    Sanderson was behind making large radius turns from one side of the course to the other. Paltrow made small radius turns remaining on the right side of the course the entire time. Sanderson went from the left side and skied to the right side right at her. He clearly is at fault.

    This is insanity…. What lawyer takes this case and then pushes it all the way to trial. The minute the insurance completes didn’t pay out I would have walked away from this case.

    If this is how it happened - she was on one side of the slope and he on the other side, she was in the right.
    She stayed in her area and he was all over the slope.
    Meaning he was not in control.
    She stayed in her zone.
    He took more without any regard to whomever was on the slope.
    She was still a head of him. He had the responsibility to watch out for her not the other way around.
    You do not ski looking up the hill and seeing what’s behind you.
    The people behind you have to look at for you.
    So if this is his version,
    He was in the wrong.

    Does anybody noticed that is very clear that - based on the animation - Mr. Anderson was forced to move into Mrs. Paltrow because the woman in green got in his way? If Mr. Anderson doesn't change course he would of still crash with the woman in green.

    I actually find this animation and the Physics experts commentary fascinating, It would be interesting if they could animate Sanderson version of events and have a different physics expert talk about the plausibility, it’ll be interesting to compare

      I don't know if the plaintiffs having their own animation would help them. The defendants animation demonstrates that Sanderson had to have been skiing at a much higher velocity then Paltrow. And that he was definitely behind her well before before the Collision.
      Paltrow was skiing along a narrow line. Tight zig zags down the slope. Sanderson on the other hand was crossing from one side of the run to the other. He had to been travelling quite fast over so much more distance to catch up to her.
      The way I see it that really undermines his contention that she hit him from behind.

      Phil Wyles it’s called traversing across the slopes, it’s taught to you by ski instructors as speed control.
      Someone doing short quick turns will catch up and even overtake skiers that are traversing across a further distance.

      Yes it's true, if two people start at the beginning of the Run with one traversing from one side to the other and the other going in a straight line, if they're travelling at exactly the same rate of speed the person going in the straight line will get to the bottom first.

    How did this case make it to court? All ski resorts state that the person further down the ski run has right-of-way. The video re-enactment displays him behind her. No matter how close the timing brings these two skiers together, it was his inability to make evasive maneuvers to avoid a collision.
    The only reason I’m responding to this is because the same thing happened to me. Some jackass ran up the back of my skis causing me to fall forward. Thirty years of contact sports trained me to roll my shoulder but I still ended up dislocating my right shoulder (splitting the glenoid cavity). That’s the bone cavity with which the humerous sets in. That’s two months of healing after surgery and four months of rehab.
    Sorry Gwen. Now that I see the facts I understand you’re 100% right to behave the way you did. This guy is just another parasite.

      Used literally "ALL the time" in cases such as this.
      Especially car accidents where there are only eye witnesses.
      This is a valid and usefull way for everyone to comment on how things went down. The doctors lawyers will have a chance to refute this evidence.

    I fully believe that people are only believing Paltrow because its literally Paltrow and they obviously love her. A literal doctor even said on the stand: "If he ran into her, he wouldn't have gotten these injuries." They showed his injuries within the court, she obviously ran into him, he cannot dictate if there's someone behind him because when you Skii you have to focus on what's Infront of you and not what's behind you. Paltrow legit said he was the one that ran into her, he is saying she ran into him. She is literally lying on the stand.

      I'm actually not a fan and think she's not that good of an actress. That "literal doctor" on the stand is wrong, and was proven wrong by someone else on the stand. Skiing at that rate of speed and being an older man, any impact to the ground could absolutely break his ribs - and yes - I have years of medical experience to back it up. He literally said she was skiing distracted - so he did see her skiing. Then, he also said he didn't see her coming at him - so what is it - he saw her or didn't see her?! This guy has: 1. Contradicted himself in his own testimony. 2. Has medical records stating he suffered a concussion, which any medical expert will tell you affects memory surround the impact that caused the concussion. 3. Has shown memory issues on the stand, as well as his attorneys arguing that his memory has been greatly affected by this concussion. But, sure, he remembers everything - total BS.
      And, you're here with ZERO legitimate info to support why you think SHE is lying. You seem to base it only because she's famous. I think, with your bad opinion and terrible spelling errors, you're just an idiot.

      I still don't know why it can't be they ran into each other. Sanderson was coming from behind. He presumably saw Paltrow and didn't leave enough space. They are sliding downhill at a high velocity and unexpectedly swerved into one another. Neither had malicious intent. This should not have gone to trial- he has medical insurance and this was an unfortunate thing that happened to him, a risk he took that day by hitting the slopes with other people around. I have been watching this trial and thought both ways- Sanderson was in the right to sue for damages, Paltrow was in the right to defend herself, and I believe both parties are protecting themselves. Sanderson wants the payout for his own achievement and Paltrow wants this to go away and not be labeled at fault. You can say someone is stretching the truth to fit a narrative, however its clear they both were surprised at the moment of impact and handled it in different ways. The crash and Sanderson's lasting health issues is not Paltrow's longterm problem- she did what was necessary to report the event and get her own help. Not a legal matter in my opinion... And no, I'm not saying this because she's famous. I am being impartial.

    ...Most skiers, like me for 65 of 75 years, do not know the Ski Area Rule of "DOWNHILL SKIER HAS THE RIGHT OF WAY". All this $$$$$ court time when both stories without film prove he ran into UPHILL and BEHIND and BETWEEN HER LEGS, the primary evidence! Not a rich Star actor and an old guy scamming.

    This is a terrible presentation. I have seen other trials using animation and the attorney has control of playing the video and doing it more than once, even multiple times for the jury to absorb the visual. This is pretty bad for presentation and too brief to gather a real idea of the crash.

      People fall skiing all the time. You're focused on what you're doing. Even if people collide right in front of you, you are quickly skiing past them and you probably don't assume anyone was hurt. By the time you find out someone was hurt that day... you might vaguely remember seeing 2 people collide, but you have no idea if it's the same people you saw and you probably don't remember any details.

    It seems very strange it was hard to get from Terry's side of the case how he got up from the accident and who helped him up. You would think Terri's friend would help him out but he didn't and that was very odd to me. Terry said on the stand some man came on front of him and pulled him up to standing position and left. That seemed made up.

      So, he claims to have had a significant concussion. Just saying, from personal experience, this guy's memory of what happened directly before and after impact to his head would be very sketchy. I'm not going to believe he has any legitimate clarity of what happened. His own memory issues while on the stand, plus his attorneys trying to make that a supporting point to their injury claims just further supports that he really doesn't have good memory of what happened. I wouldn't be surprised if most of his "memories" of what happened are just suggestions that others have pumped into him to convince him to sue.

      The man was older and he suffered broken ribs as a result also he hit his head on the ground. Gwyneth’s testimony of him grunting, almost sexually assaulting her is over the top. For me who suffered the most in the accident should be fairly compensated. In the video it looks to me as if Gwyneth wanted to be where her children were and went for it and didn’t see Sanderson coming.

    Looks like everybody's opinion, and the jury's verdict s based primarily on the animation which is predicated only on Paltrow's version of the event, with the lesser impact being a negative opinion of the Doctor due to his travel and some really professional and effective lawyering by Paltrow's attorney. Paltrow's version maybe correct, but maybe not. I guess it does show the power of a visual, even if it is one sided.
    I have no idea who to believe, but it would have been instructive to compare equally well done animations of both versions. As the expert said, his analysis is based only on her version and the animation. Also, everybody dismisses his injury claims out of hand. Four broken ribs as significant injury and isn't just a little boo boo. They hurt and take time to heal, and an impact that broke ribs could also have been enough to cause other injuries.
    At this point it doesn't matter. Paltrow won, and at least one juror has explained their decision as based heavily on the bio mechanical engineers testimony and on the animation. I would have been more skeptical and would have had a hard time coming to a verdict, as there was a conflicting eye witness account and a he said, she said aspect.

    One article stated that BOTH of them were on a beginner slope. I take that as both are new to skiing and the complete process of being aware in a dynamic situation has not been learned yet. If I were the judge I would have sent them packing.
