    "Mr. Kohberger is prepared to provide further detail in an ex parte’ hearing with the court." This sounds like the defense's version of a grand jury. Only Mr. Kohberger, the defense attorneys, and the judge. I would love to see this take place.

      @eneryma Me too 😊! I like that he reminds everyone in the beginning, “if you didn’t already hit the like button, stop and do it now”. Some people mean to hit it, but forget to do so after the video. I’ve said this before, but I really don’t understand how Peter doesn’t have triple the subscribers.       Also the state could still charge a witness. And so the witness doesn't change her story, the defense doesn't produce their alibi yet. They wait for the cross examination.

      I went straight to the commentary section priorly without watching the end of the video, but now...wow, exactly my thought - shocked here too. If the judge accept that, he should demand, as a condiction, the presence of the prosecution as well, or providing them a transcription of that.

    The thing is, he _was_ driving around in his car that night. We can see in the PCA that he drove around and around that neighborhood 3 or 4 times. There’s a big loop that he kept driving around King Rd before he finally did the 3-point turn and then parked by the house. And then he took that circuitous rout home.
    So this “alibi” is kind of useless imo. Both can be true. He could have been driving around that night by himself _and_ went in the house for 20 minutes and murdered the 4 students like the state says happened.
    This alibi and the state’s theory are not mutually exclusive. But a real alibi should be. “I was here so I _couldn’t have been_ there.” Unless they’re going to prove that he was driving somewhere else, nowhere near the King Rd house this alibi doesn’t help him.

      I didn't think PD had his license plate #? Did they finally prove it was his car, and not just a white Elantra '13-'15? There's another Elantra in the same area around the same time, do they have that license plate #? That video of the 1st vehicle acts like it's looking for something, but all the drive-bys don't show anything different about the house, parking lot. Lights around the front door were not on, and no lights visible from that front view. The DDash delivery was made there as a drop off, no contact w/occupants. So, why would the perp(BK) continue w/so many passes? Plenty of places to park along the side of that house, and all drive-bys don't show any outside activities at the time of them. The other vehicle looks like it's hiding, waiting to meet or pick up someone, and it's just nearly visible there's a person (s) moving in its vicinity.

    I ran recovery/tow truck all around that area. You don't need to turn off phone if outside Moscow. Cell towers are extremely spotty aka mountains/valleys. I personally ran a 2nd phone (sprint) just for that area, the spotty towers have different carriers. There are dead spots along the main Hwy to boot. Can't drive main roads long without popping a tower. Sure can hit up back roads, lake/river/scenic area. Zero cell. Made a good living 7 day work weeks, fetching peeps/vehicles out and about for a drive. If headed east of Moscow, counted on no cell

      Lol nope they can check the phone for that and have already. It was otf, not going in and out of service. Plus what you're saying is it went out of service for the whole hour during the murders and then just randomly popped back on at his house again. Come on lets use our heads here ppl

      Admittedly I use phone 24/7 for work/dispatch/customer. My phone has shut down for every reason consivatable. Including sliding across dash & out the window. Norm for me to shut off for all known reasons. Only to mysteriously turn on when I got home. Or I simply plugged it in to charge/ check messages. I shall claim for the record, I off,ed no one during those many/many times. 3rd gen N Idaho, 4th gen has arrived. We not only want the purps we want the right one/ones don't care about the name attached

    I had a feeling that’s where this was headed! A couple reasons:
    1. They were being really wishy-washy about this whole alibi thing, clearly buying themselves time (IMO)
    2. Up until now, they had made such a huge fuss about the Elantra in their other motions- questioning the credibility and training of the officers who identified it, discrepancy in the year, etc.
    I completely agree with you that they have at this point exhausted every potential way to poke a hole in the prosecution’s ability to place BK in the car at those specific times. They are conceding the ability to argue it wasn’t him driving, it wasn’t his car, he wasn’t in the car, etc. I think they have been going over all of those options tirelessly as they delayed producing an alibi.
    When confronted with the fact that they have to concede it was him in the car at those times, that they couldn’t question any of that, the only option would be to make that work for them. Hence, the state proves it was him driving the car at those times, and the defense says “the state has just proved he drives around in his car at night. There he is, in his car, driving around, and look how often he does this! Clearly its a habit!”
    But I think this was not Plan B, not Plan C, but Plan Z - worst case scenario, admit that’s him in the car and use it as an alibi. My response to that is Rut Row!!!
    Also, I don’t know if you happened to catch any of Melly’s hearing today, but a friend of ours made a cameo appearance! Here’s a hint: his first name is Mark and his last name rhymes with “Smeiglarsh”

      Let's get to hard facts. The prosecution conceded his cell phone was off so they have no idea where he was at the time of the murders. All this ping data. Phone off and blurry video conjecture is nonsense by itself.
      The key to the trial is the DNA evidence and if it holds up in court.

    This is why it's wise to remain silent. The state has traffic camera and security camera footage of him leaving Pullman, and returning to his apartment. The problem is this; can the defense provide camera footage of Kohberger somewhere else either at the time of the murders, or far enough away that there was no way he could have arrived in time.

      Just something to add? Why would he go back to the crime scene later at 9:00a.m. or do so with a vehicle that could be stopped by LE, w/every single LE agent in that town and the entire area, at a 4-person murder house, taped off and humming w/very serious activity? How could he be sure everything in his vehicle, any scratch marks on his face, hand wouldn't be seen, or just stopped and investigated, since not only LE know very well some killers do return to the scene of their crimes, that it would be on tape, if the crime scene was being properly isolated and protected?
      He spent time driving around, but in the dark. But now so confident in his cleanup job, his appearance, he turns up BELIEVING that those fools HAD TO HAVE CALLED LE long before 8:00a.m.since he saw FROZEN girl slam her bedroom door!? (Or, as some think didn't, and HE didn't hear her yelling out to be quiet while attacking those girls over her head...??!)
      If it was in any way humorous, and it isn't, I might say in spite of that, these people who have jumped all over this oddball are not thinking very logically. Ascribing him w/the foresight the most successful psychic couldn't conjure. How did he know DM didn't call LE, how did he know he wouldn't be stopped at the yellow tape blocking off the street in both directions? Did he really think the safest way to get away from the crime scene was to hum around the countryside with his knife and all that blood evidence in his vehicle, on his clothes? So, he takes care of the "evidence" in the dark, can he be sure he didn't leave anything behind on his "supposed stops" along that trail? What chances would he be taking to screw up by driving around? So, if it can be looked at as something the guy who could pull off those complicated horror scenes and get away, can it be scene as the same guy who would show up 5 hrs later confident he didn't make any mistakes at all anywhere other than, um, LOSE the knife sheath in the first place in the house he attacked?
      The alibi only appears weak if it has to adjust and expand to fit anything new the prosecutor can throw at it. It says to me the State doesn't have much else. And BK knows they don't. A simple and clever alibi the prosecutor has to start with, but has to end up with him knowing the girls, being rejected and therefore murderous, fast and proficient enough w/a Ka bar to end those poor young people in a 3-fl. house at the time of a DDash delivery, in less time it takes to just drive by the house THREE Xs and no one (except BF where delivery was made?) asleep or alone then get away w/o bringing any other evidence to his vehicle, apt.or his parents house.(And zero marks of struggle on him?)

      @@nomadscavenger It says to me the State doesn't have much else. no they have much more the google stuff and all of the social media information remember they can use the google maps as another way for evidence to show that he was near the king road home and they can use other Social media information to prove that he has contacts with the victims and the weapon the knife and they got receipts of his too An evidence log released Thursday shows knives, a cell phone, black gloves, black masks, laptops, and dark colored clothes and shoes were found at Bryan Kohberger's parent's Pennsylvania home where he was arrested. plus that Laptop got lots of INFORMATION TOO A NUMBER of items including a black glove and a pillow with "reddish brown" stains were recovered from Bryan Kohberger's home after his arrest, a newly unveiled search warrant has revealed. reddish brown stains=blood Investigators also claimed a Walmart receipt, a dust container from a vacuum, possible hairs, mattress covers, and a computer tower inside Kohberger's Pullman, Washington, apartment. Among the items allegedly seized during the search were multiple strands of hair, a computer tower, a disposable black glove, and a pillow with a “reddish/brown stain” on it, according to USA Today.
      Investigators said they also seized an Amazon Fire TV stick, mattress covers, the dust container from a vacuum cleaner, and purchase receipts from Marshalls and Walmart. all of that can and will be USED AGAINST HIM!!!!!!!!!!!

Your explanations are straight forward, understandable, easy enough to remember and repeat in conversation, and a resource that I think is unequaled on youtube! Haven't watched this vid yet, but wanted to make that comment first, just to add to all those who appreciate your work so much! I actually feel like I know what I'm talking about after checking in whichever video may be the most recent in any case, and the other couple of Lawyers in the firm are wonderful as well! (Who doesn't love George?) What a wonderful Dad, Grand Dad, and attorney! Thank you so much for all you do for those of us plugged into The Lawyer you know!

    Thank you Peter for continuing to cover this case and explain all of these court documents to those of us without a legal background. I have learned so much about the legal process here in the States from your videos. Perhaps it is because of the gag orders, but there is so much about the case against BK as well as what information the defense has that the public isn’t aware of and we won’t be made aware of until this case goes to trial.

    Lots of serial killers had a habit of going for long drives late at night. They were out trolling for victims. So not exactly an alibi that screams "I'm innocent!"

    What I’m hearing with this statement is “we haven’t produced an alibi b/c he doesn’t have one [that can be corroborated].
    And “we’re not cooperating b/c the state chose a secret grand jury over a preliminary hearing.”

      I guess we all have the right to try every technicality as a defense. IMO, that tact does make it seem like no reasonable defense exists. But, technicalities DO frequently bring retrial or success on appeal.

Being a student and having experience in court especially a death penalty case is completely different. He may understand their strategy and be able to ask his lawyers intellectual questions more than lay people would but he's not running his defense.

    same here. Driving around at night is not unusual. get a clear head, get away from the noise, think about stuff in a relaxing way without being bothered. I get it. Used to do it all the time when I was young - and I grew up in Idaho.

      @TJ-so9xo Believe me, I'm educated on missing and murdered people. I'm an MMIWG advocate (Missing,Murdered,Indigenous,Women,Girls)people are murdered and go missing at all different hours. A majority of cases just don't get this kind of coverage to know that. A ton of crime happens at night,don't get me wrong, but it's not unusual at all for people to take drives at night. Especially in college towns and small towns in our area. It happens all the time.

      @@katmeltwm8694 I agree that people get abducted all hours. There are way too many missing people and obviously way too many get away with being the perpetrator. It is not normal to go for a drive in the middle of the night. Its odd as hell. If you know someone who does this check their trunk! Driving isn't relaxing, you have to be alert and pay close attention too what you're doing especially at night. It's odd behavior that makes no sense.

      ⁠@@kidmac1514unfortunately he is driving while it turns off and turns on. Therefore if it died he had a charger. He doesn’t plug it in right away and turn it on even though he could and that is what any rational person would do he keeps it off for hours even though he didn’t have to keep it off. What’s worse is when he decided to finally turn on his phone even though he could of turned in on at anytime it just happens to be when on his drive he is just out of Moscow :).

    I think this alibi he's given makes a lot of sense given what we know, assuming they literally can't prove with video or phone data that he went inside ... if you can get jurors to think about the sheath getting there another way and has nothing to do with the murder weapon, because as far as we know now, they don't have the weapon, it's possible. There is very little public evidence and given what we know now, I'm not convinced and for sure waiting to decide until trial.

      the affidavit admitted cell phone pings pinged his phone at times when he wasn’t there. It’s not reliable. This alibi is why Khoberger said he looked forward to being exonerated. They thought they would have a preliminary hearing to bring it up and the prosecutors did this in secret, behind defense back. Not ok.

    I just googled about the black box requirements and it seems that all American cars built since 2014 are required to have a black box. Does that include ELANTRA’s? If it does then they should already have the Black Box, so maybe the defense is trying to force the prosecutor to turn over that information & maybe that’s what they are waiting for and are afraid of…

    The defense can say thier client was driving around or in his car parked somewhere twiddling his thumbs. Regardless, the state should provide information in a timely manner to avoid the defense from filing unnecessary motions delaying the process.

    One way imho, L/E used to help identify his specific vehicle on cameras, etc? At the time, he had his home PA plates on the car. NO FRONT plate. They were switched out & registered to his WA address after. In WA &/or ID, etc. both plates are required, not so.. with his original PA plates. Makes it much easier to pick his specific Elantra out, to add to support of the pings, gps on car etc.

    It appears the defense hopes to dispute the prosecution's evidence; i.e., that was not his car, he was driving around but was not in the house, sheath stolen or something. Defense can dispute the Event Data Recorder (EDR) data. Sadly, a lot of this back-and-forth seems like a game. I am stunned by the ex parte' note. If he has a witness to swear he was with them, shouldn't the prosecution be notified rather than wasting all the time disproving his whereabouts?

    Wow. I dont believe challenging the state's experts on what the cameras show and what his cell phone activity (and lack of, when it was powered off) means, qualifies as "offering an alibi".
    It is simply an everyday part of preparing a defense. He admits he was driving his vehicle at around that time, and is not offering evidence that he was somewhere else or was witnessed somewhere else.
    Simply disputing the prosecution evidence is markedly different than offering a claim of where you supposedly were at the time the crimes occurred.

      The cameras showed nothing. It doesn’t show Khoberger driving that car because the windows were tinted. Khobergers Elantra doesn’t have tinted windows. Look at the footage. This case is bogus. Idaho police wrongly accused two other men of murder based on DNA evidence. One in 1996 in teen murder and rape of Abbie Dodge. One just released after 20 years. They are withholding discovery because they messed up. They are incompetent, and were also found guilty of planting evidence in the past, by Khobergers lawyer no less!!!

      Yet another person who has no common sense. law Enforcements statement that a knife sheath was found next to/partially under Maddie's body is a lie. Use your critical thinking skills if the knife sheath was honestly found next to/under Maddie then Maddie's DNA would 💯 percent be on the sheath to. It is impossible that only Bryan's DNA was found on the sheath. The sheath was found laying in Maddie's blood. Blood is DNA. Therefore, Maddie's DNA & Bryan's would have had to been found for that claim to be even possible.

    Hi
    I looked up some cases with ex parte hearings, and in most cases that i read about, they were not allowed.
    But i found a few that were, and the reasoning interesting, and in alot of cases the request was for smilar reasons.
    Those being cases where the defendant was an indigent, therefore requiring funds to hire and pay for expert investigative assistance, similar to what the state had used.
    The ex parte being asked for so that the defense did not have to disclose they wanted these funds for these reasons, because the state would most likely object and would then know what the defense was up to.
    In most cases the ex parte hearing was not allowed, but the funds were approved. In a few cases though, the assistance was not ample, and the requests for additional funds were denied. These cases were appealed all the way to the Supreme Court where they ruled, that although the indigent person was entitled to an appropriate defense, that anything up and above reasonable expenses was denied on the basis that an indigent person could not expect to be afforded assistance matching that of other defendants with the ability to pay for their defense, and therefore additional experts, witnesses, etc because of their financial ability to do so.
    Whewwww! Ok that was a paraphrased mouthful and i hope it made sense and was helpful to anyone wondering about ex parte hearings. 😂

      No one needs to convince u he is innocent... There is a PRESUMPTION of innocence in this country. It is solely the States responsibility and burden to PROVE guilt.... People seem to forget there is no burden to prove innocence

    hi Peter, I love your channel we learn so much from you.
    I remember in the beginning of this case it was stated by BKs neighbor that he often vacuuming his apt late at night, He often went running late at night, stated by a friend. It could be concluded that BK was a night owl or insomniac.
    I too suffer from insomnia. I worked 2 nd and 3 rd shift for many many years. I too in my late 20s would often go food shopping very late at night often 2 or 3 am. I have also been known to go for late drives by myself just to get out of the house when I couldnt sleep.
    IMO it is totally plausible that BK was out driving around on the 12th into the 13th.
    Also your mention of traffic cams. They need a clear pic of plate or his face in that car.hen you turn it back on , bingo, there is an add for that.
    Black box will tell the truth.
    Ex parte He must be confident.
    I thought they were not going to use the DNA in the Trial. So doesnt that mean that the DNA part of the PCA should not be exposed in court. Also my feeling re the sheath may have been contaminated in the lab. At that point they had his family tree. Also how is only his dna on the sheath when it was in Maddys bed with her and Kaley, and was it under? or next to body?

    I think its total CYA, Kohburger frequently liked to take drives late at night... They're trying to cover the night of the crimes AND all the other times he was driving around 1122 King before the crimes. Interesting that he stopped going on those twilight cruises after the murders? 🙄

      I mean even an innocent person might stop driving by an area brutal murders happened. Everyone even innocent people would know that driving there near the murders at night would make them look highly suspicious.
      It's important to not let biases play a part in thinking. It leads to innocent people going to prison.
      I can think of two cases where bias and false preconceived notions played a huge part.
      One a man came home and claimed to find his mother stabbed to death. Just a brutal crime scene. Over a hundred stab wounds. He claimed it was a mysterious black man who was hitch hiking that he just happened to run into. Just happened to occur in the very same time frame his mother was brutally stabbed over a hundred times. He claimed any evidence of him at the crime scene was just because he went in there after the murder.
      At trial they shredded his credibility. The scumbag was sent to prison for life. They obviously pointed out that only someone who knew the mother would stab someone that many times. That it was certainly a crime of passion and in no way just some random black man the man claims to have seen hitch hiking.
      Years later the man who actually did it confessed. It turned out to be exactly how the man said it happened. His real story was just so bad and so unbelievable that no one believed him. Especially not the jury.
      A similar thing happened in the first Pamm Hupp murder. Her husband just happened to have a true story so unbelievable that the police, the prosecutor, the judge and the jury didn't believe him. He was sent to prison for a murder everyone now knows he didn't commit.
      Still at the time everyone was sure it was him. Now it's impossible to get justice for his wife. They can't try Pam Hupp for that murder because with the previous trial she'd have a ready made beyond a reasonable doubt defense.
      Two cases where people were happy to send innocent people to prison just because the real story was unbelievable.
      The last person found guilty of murdering someone who was actually still alive in this country was similar.
      I think it was in Oklahoma. A man and his friend were in the area. The man's friend got a woman pregnant and decided to flee down to Mexico to get away from the shotgun wedding.
      He gave all his stuff and clothes to his friend. People saw this guy with the other man's stuff and found it and his story real suspicious. They tried to find his missing friend but couldn't.
      Eventually everyone determined his story was bullshit. They tried him for the murder of his friend. Even without the body they managed to convict him and sentence him to death.
      A short time after his friend was hung the "murdered" man showed up asking questions. Like why the hell they tried and sentenced to death his friend over a murder that obviously didn't happen.
      There's 3 perfect examples of why it's important to not let bias play into your thinking. Bias easily leads people astray from the truth. Leads people to believe the evidence is greater against someone than it really is.
      Kohburger might be guilty. He might be innocent. It's best to wait to hear the actual evidence before deciding.

The white Elantra info was not put out for weeks after the murders, Dec 5 - 8 I think. While you might not go down King Street anymore even if it (a dead end street/ weird) was repeatedly /coincidentally part of your routine nightly drive, you would still go for your "routine midnight cruise" if that was your habit???? IMO, as a single woman who actually did used to like going for a drive when I couldn't sleep, put on my favorite tunes and enjoy the scenery in the moonlight, on small highways not residential streets (🤔 I always got a large coffee at a drive-thru though/?=alibi/? 😁), If something terrible had happened on a location that I always drove through/near, I think my curiosity would have drawn me to take the drive to see if I had noticed "that" home before? Had I noticed "the party house"? If I didn't have the curiosity or interest, I still would have driven the route that I enjoyed (with doors locked/as always and mace on the passenger seat, if not picked up a boiling cup of Tea w/my coffee🤷🏼‍♀️) I would have thought it was better to have more 👀 in the area for the safety of the students that were still there. Probably would have invested in a good dashcam too. But then again, I know I'M INNOCENT!
      I'm not wanting to come off condescending, I just think the Alibi he chose, given the facts we know, is very telling. I'd guess LE/the state not only has proof that it was HIS Elantra but also HIM driving it!!!

    So basically defense wants him to get off on a mere technicality? It’s a challenge for defense as well as him and I do believe it’s all a game he is playing from the start to see if he can get away with this. He studied carefully beforehand imo. Let’s get to the trial..we will see the truth. If it’s that simple to make an excuse for everything this case will never go to trial.

    Another attorney said this is because Idaho has the alibi piece because it saves the state money so that if a defendant has a alibi that can be shown by proof it saves the state money and time. Can you imagine that they go to trial and all the sudden the defense says “oh he was at his friends, and his friends will verify this”. That would be a waste of everyone’s time and money.

    The defense doesn't need anything from the state to prove Kohberger's alibi. He knows where he was driving. Go to places of business along the route he was driving and ask to see security footage.

    It makes no sense that anyone would allow themselves to be jailed and keep a true alibi secret. If I had an alibi and was arrested, I would reveal that alibi immediately.       Now, put yourself in his shoes.
      You often drive around at night, alone because you can't sleep. Nights are usually pretty often less crowded. It's quiet and you're just chilling for long enough that now you know when you get home you have a better shot at falling asleep..
      So, here we are. Now you've been arrested. You KNOW the law, you know ain't no way cops just gets to a different state and says "you're under arrest for 4 murders" and they just think of you as a potential suspect.
      You are #1 suspect. And they have worked on this for a month. And it lead to you!
      Why do you know YOU are number 1?
      The cops came to arrest him.
      Not question him. He wasn't called in by the local police to answer a few questions.
      He was arrested.
      Now. You know you need a lawyer, because.. well.. it was over a month ago, what the fuck was I doing WHEN? Oh yeah, right. I was alone.. driving.. no witnesses..
      What would you HONESTLY do?
      You think the cops would believe your sob story about driving around in the middle of the night, alone, where you phone happened to ping in the area and your DNA is there and you were innocent?
      Ha.. YOU don’t even believe it as a layman.
      You don't think BK knows cops have probably heard every shitty excuse "innocent" people have made up?
      And do remember.. every word you do tell the cops as your alibi, has to be accurate. Especially when dealing with being alone in the middle of the night. Because "you have the right to remain silent. Everything you say can and WILL be used against you in a court of law."
      So tell me..
      How are you going to convince them that you are innocent? Would you remember what street you drove down first? Second, third, fourth, fifth when you stopped at the gas station?🧐 if you fuck up the order in telling them your alibi.. YOU LIED! And that will in fact be used against you in court.
      How are you going to convince the whole damn world that you are innocent, and you were just driving around in your car alone that night? And that you may not have a fucking clue how your DNA was transfered to the sheath?

      You do all realise that BK rental agreement for Steptoe Apartments went into effect from August 1st. His mother posted on Facebook July 27th, possibly the 28th, but one of those dates definitely - a farewell and good luck in WA to her son BK.
      Information released with regards to BK guilt, has his phone pinging in Moscow in the months of Jul -Nov. 12 pings in 12 weeks, with one of them occurring within HOURS of his arrival in WA. Some will say he was stalking from day one. I think he was more likely becoming familiar with his new surroundings. If his mum's post is to be believed.. BK arrived in WA 2/3 days prior to him receiving apartment keys, he may have slept in a hotel in the area. We just don't know this yet. But to say he was stalking the address as far back as July is laughable.

    I didn't know about how some states make the def give their alibi at the beginning. That's why lyk is the ONLY channel I have ever joined, and it took me a long time to do that lol. I'm very frugal lol unlike many others lol.
    As a biology teacher, I don't think most people know that "touch dna" is invisible and as such I think it would be very hard to plant, especially as single source dna.
    I also wonder WHERE they would get his touch dna in order to plant it in the 1st place?
    To me the touch dna is pretty compelling, given all that would have to happen to plant it.
    On the other hand, I wouldn't put it past cops to plant evidence for someone they think ("know" in THEIR mind) to make their suspicions more believable. We see that all the time when they lie in their police reports. It's the same kind of thing.
    Just in case, though, I hope the state has more compelling evidence to give us in order to overcome the planted dna theory.
    I hope that this guy is truly guilty because I would hate to think that this guy is innocent and has had to go through all of this and have his innocentlife destroyed. I know how strong confirmation bias is in the minds of cops.
    I hate how adversarial our system is. It will be a good day when the goal of everybody involved, including lawyers, is to get the truth instead of winning their case. I know I will never see it, but that would be a good day if it ever DID happen 😮

    I still have a problem with the roommate who said she saw him, heard noise and didn’t call police until almost noon. If the neighbors ring camera picked up noise and she didn’t, doesn’t add up.

      Don't forget that the 2 girls had been out drinking until nearly 2 am--and came home by Uber. I believe it was common for there to be some use of marijuana and some illicit street drugs at that house. The girl who did not call police for 11 hours was probably drunk and/or high when she went to bed, did not want to get in trouble for drinking/drugs, her roommates often had visitors unknown to her, and she probably slept until NOON!

      Defense team has to play along with defendant, or else they get fired. Anne knows the law and is playing those cards very well. They had no real alibi. so they came up with this weak one. And Anne challenged the grand jury use of probable cause versus beyond reasonable doubt. That change has existed for 150 years. Ex parte is an attempt to tell judge the defense plans and why they keep complaining about the prosecution and slow response in turning over its evidence. BK wants the technical details cause he thinks he's an expert and can convince a jury of how bogus it is. State should comply and move along and stop messing about. They either got the goods or don't. I lean towards they do. But I do expect defense team may get fired. Because BK has serious issues.

    Another lawyer was saying he's never seen an alibi actually work in a trial. Reason being, if the alibi was actuallyi solid, it wouldn't have gone all the way to trial in the first place. That it would be presented to the DA sooner. Made sense the way he explained it.

      They never brought the beastie in for questioning, isn't that saying something? He never had a little sit down with a "good cop/bad cop" interview. Straight to an arrest before the Grand Jury got their notes transcribed/copied. Why would he bother, wouldn't you want to see what was presented to the GJ, esp. if guilty and knowing they found that cussed sheath? Even if not guilty, a true but slim alibi like the one he's going with wouldn't be enough for LE to say, okay you're off the hook, you can get back to yo studies. He had over 5weeks to take care of details if he's the one. If he isn't and was familiar with the reputation of the house and those pretty girls but just curious and realizing he wasn't in their league for one second, but liked that quiet route for other reasons as well, IT STILL doesn't matter. Is there now a doubt he wasn't the mad-dog rampaging, and expert killer but someone else who had to get the job done on the 13th of November for some unknown reason?

    🤔Continue to wonder about why a grand jury was chosen instead of a preliminary hearing, it seems that the grand jury process tends to lean in favor of the prosecution as the defense is not given the opportunity to speak. Just thinking…

    I missed the live 😕 … this case 🙈 I think everyone needs to calm down and wait for the evidence that is presented during trial. The speculation is sending everyone in loops- he’s in custody for a reason. Period. However, we ALL need to wait and see what’s presented … but if police detain a vehicle in the LISK case from a decade ago, looking for evidence & found nothing in Kohberger‘s… absolutely nothing in his auto, it makes everything so confusing.

    Why is this case more complicated than it needs be? People are out there making something very simple very hard.
    Rememebr the facts we know and that will help in the long run.
    Also remember that the burden of proof is reasonable doubt.

    If they wait to trial to present the alibi, the state won't have proper time to investigate and produce an effective cross examination. That's the whole purpose of requesting it before trial.

    I am intrigued by BK’s offer for the ex partè hearing. I think it’s akin to the State’s emergency, secret Grand Jury hearing. I hope Judge Judge entertains the request.

      The prosecution has an absolute right to choose a grand jury. There is no right to give an alibi defence to the judge alone without the prosecution present. The notice of intention is to give the details of the defence of alibi to the prosecution which includes where he was, when he was there, and what witnesses or other evidence he is using to confirm this alibi.

      I think it is totally inappropriate to allow the defendant to speak to the judge so that the judge will find in his favour but forbid the prosecution form knowing what was said. It is the epitome of hiding the ball.
      The judge shouldn’t know more than one side or the other about it directly relevant information. How can the prosecution argue their motion if they are being denied the information that that defence is using to argue it.
      It would only be akin to the Grant Jury hearing if the prosecution was provided with a transcript later.

      It’s nothing like the prosecution calling a Grand Jury. They called a GJ because Kohberger insisted on questioning the two surviving roommates, face-to-face. Prosecution therefore used their RIGHT to call the GJ in order to protect those girls. Quite rightly so. They are traumatized already and are under the services of a doctor, why allow them to be traumatized any more than they have to be? The trial itself will be hard enough.
      Kohberger gave a non-alibi because he wants to get out of jail.
      No similarities whatsoever.

      ​@@enigma_-_79It isn't just the lame excuses the "traumatized" non-victims had for not checking on the rest of their friends in that very quiet house. They were up at 8:00 a.m. and called their sorority before calling PD, and called their friends to come over at the same time. (Do you actually believe the dog wasn't very uncomfortable by 8:30 a.m.?) Many questions about those behaviors are still unanswered. Questions nobody wanted asked of those girls it seems.
      Would a preliminary hearing be curious about that kind of response to DM'S eyewitness account of the events in a house w/2 floors covered in blood? They didn't go upstairs? So how was it possible for DM to get to the 1st to BF w/o noticing THAT? Both girls got out of Dodge as far as possible for them. They fought coming back.
      One would hope for the REAL victims and their families that THEY would do everything in their power to HELP, no matter how f*$@#& "traumatized" they were WEEKS later. And there's the rub. LE was protecting them? You bet they were, and plenty others as well because questions about them and their behavior wouldn't be asked in GJ meetings. Those questions a defense lawyer at a preliminary hearing might ask, or a focussed trial juror, and if not answered w/a reasonable explanation, would be open to surmising. What the prosecutor/DA probably did do was DOWN PLAY any difficulty with some aspects of their behavior and let them slide before the GJ. So if they are protecting the one important witness from being asked QUESTIONS that could clinch the deal, maybe there's others that might indicate something is askew w/law enforcement/DA and the entire outfit, too? Hence, the possibility of a "planted sheath" idea making sense!

    I thought and thought about that paragraph about wanting an hearing with the judge and no state involved. This seems bery unfair to the state case . I know we need to insure the defendant has a fair trial but allowing a defendant to put a statement on the record and not allowing the state to question him ?????? It's the same if a witness testify without allowing the defendant to cross the witness...i hope the State brings this up

    Im fully on fence and open to either guilt or not depending on whats released at trial BUT...
    I have ptsd and severe anxiety and i dont sleep at all during the night and its become a seriously expensive habit of mine (fuel costs) to just get in car and drive around no where and everywhere during the night hours just to calm the stuff in my head. If im focused on driving im not focused on my triggers.
    In addition i learned at my group therapy that im not alone in this 9 outta 13 (10 outta 14 if you included me) in our group admit they just get in the car at night and drive because the quiet, dark, less stimulation and focus solely on driving does work for many of us in winding down the thoughts.
    Its actually recommended by many of our therapists to do this if we can or if you can safely sit outside in the dark and meditate if you cant focus on driving etc.
    I admit its been really good for many of us.

    As much as i understand many people think this isnt the norm and its a silly alibi ans no one would randomly drive at night for no reason...
    Have to say thats wrong. Its not necessarily the norm but its more common than we think.
    Putting that into context with...
    How many crimes are reported at night in the 60 mile radius i drive at night....i inagine its actually 100s...so i am drivinf past 100s of crimes being commited at the exact time im driving past.

    You all need to remember this is rural North Idaho. Not alot of traffic cameras. Some towns don't even have stop lights Let alone cameras. 😊
