    I remember when I was a youngster I would go camping. I didn’t realize I was trespassing until an owner approached my friends and I. He was nice about it. He said that he appreciated that we bagged our trash to take with us. That’s when I learned about trespassing.

    I had a problem with someone from out of state hunting on the land I had bought. I had a logging company clear cut the trees to make room to build my house and put in gardens. The logging company cut down trees that had permanently attached hunting stands, and pile them into a slash pile for burning. The hunter showed up one day, afterwards, cut the chain on the gate I had installed, and ignored the No Hunting / No Trespassing signs that were on the gate, and surrounding posts.
    I recorded him on high definition cameras and his vehicle license plate.
    When he saw his expensive hunting stands were gone, he was furious. He looked up my tax information and contacted me, demanding that I return the stands or pay for them. I told him I had video of him breaking and entering my gate and property. I had turned in his photo of his face and license plate to the sheriff’s department and formally filed Trespassing and Breaking and Entering charges against him. Afterwards my camera was stolen, and someone tore down my Trespassing signs. But I didn't have evidence he did it. I put up a couple signs just inside my gate that said, "VEHICLE DISABLING DEVICES ARE EMPLOYED ON THIS PROPERTY." That stopped all of the trespassers from driving onto my property. They didn't want flat tires.

    I'd remove the stand and the camera. I'd throw the camera away, and would chain the stand to a tree next to the road with a "For Sale" sign on it. If he shows up and tries to claim it, call the police then and there.

    My grandparents bought 40 acres on the Sacramento River back in 1964. He constructed a sturdy dock to fish off of. It was at a dead end road but people used to drive there in the middle of the night and cross the fence lines to use his dock. He actually didn't mind until they climbed on his horses one night and tried cowboy wild riding them. His 20 year old foundation mare miscarried her foal. He put up No Tress passing signs after that. People got angry at him for that!

      its not all liberals ... alot of conservatives as well ... in my area i have more problems with conservatives then liberals ... but thats because liberals are non existant here ! its just people who dont give a fuck and think they are entitled to use your land for free

    I confiscated a treestand i found on my parents property and there was no trespassing signs up already the owner of my stand showed up one day demanding his stand back I told him no you want it back you'll have buy it back the price is a hundred dollars. he got pissed and said I'll be back with the sheriff. next day he showed up with the sheriff my dad was home and the guy says your son says if I want my stand back I have to pay for it and he tells my dad if I didn't hand it over he'll press charges for theft. I came outside and told the sheriff there are no trespassing signs in back where the stand was. the sheriff looked at the guy and said well you want your stand back you'll have to buy it back cause possession is 9/10th of the law. the guy got pissed and said keep the stand and left. a week later I sold it to a friend for fifty lol

      Foust,good story --amazing people have the gall to trespass and make demands like he did..If anyone today has any property at all it is a full time job just keeping trespassers off it.The signs should be enough.

      That's the way it works when trespassers put up stuff on private property. Should have waited for him to bring in his camper for the weekend.

      @@captinbeyond yes it is. In total I've run 5 people off my mom and dad's property none had permission to be there at all. Two of them tried to say they had permission i said prove it they couldn't prove it i told them don't come back.

    Had the same problem. I took a sheet of paper and wrote "private property, if I find it here again, it's mine" and taped it to the camera and to the stand. Following week they were gone, never to return.

    They passed legislation In PA that you cannot sue landowner if you get injured,etc while hunting on theirproperty....imagine that,,, common sense laws???? So insurance is no longer an issue....Thank god many properties now open to hunt. WITH PERMISSION of course

    You are correct on that, the camera is yours. I had a similar problem with a guy who would not stop crossing over two rows of barbed wire fence to set traps on Private Property. I was gone out of state for a few years, when I came back and seen he started doing it again, I started taking them. He called me on the phone and said he was just trying to get something to eat, I told him to go to MacDonalds not MyPlace.

    Same problem here in Oklahoma we have been fighting it for years we catch them on camera and have the sheriff talk to them every year but it never seems to help

    Exactly what I would do. I was verbally saying "Take that game cam" as I watched. Similar thing happened here a couple years ago. We live down a ridge with another across from us, one day I happened to notice a climbing stand on the other ridge...facing our house and less than 100 yds away! Climbing stand = Gone, in my possession.

    Same situation I am in here in VA. Have no idea how to make it right though as property is an hour from where I live. Hunters mostly trespassing and having the balls to confront me when I was hiking the land one day. They called the sheriff and he came out then left when I said I was the land owner. Yet the trespassing continues with 7, yes seven new blinds and 3 tree stands. I guess I have a lot of deer on my land.

      Game warden needs to put your place on his monitored rounds. Here in WA poaching ANYTHING on your land is an offence equaling jail time. We had kids poaching out of the lake with our trout farm. Lake totally on our 500+ acres.
      They were dealt with and the word got out.
      Game warden was consulted first and gave legal rights. So strongly advise you bring game warden in on it. They make money on fines for poachers.

    Remove the stand take the camera and set some cams up to catch them and press charges. We removed 6 stands from our land. Gets expensive when they have to buy stands every month

    take the camera for safe keeping. but leave a note on the deer stand that you have it and he can have it back once he removes all trace of his tresspass. You could even off to "arrange" to have a sheriff deputy or the county game warden hold the property 'for safe keeping'.

    Take all their stuff and haul it to the recycling center. You could do like the cops do here in our area when they find somebody`s marijuana patch in the woods. They leave a sign that says "To whom it may concern, your crop has been confiscated by the blank blank township police dept. If you would like it back, please report it stolen to us and we will see what action can be taken to arrange free room and board for you at the county jail." It`s funny, they never have anyone show up to claim it.

I always ask for permission before I hunt private property. 95 percent of the time I get the no answer. it's people like this guy that make the no answers keep coming. sorry you have to put up with this crap. just please don't think we all are like him. hope you keep him out. if you can't hang some nooses from the trees with scare crows in them. haa haaaaaaaa that will scare him. dang if I would hunt a spot with that in the woods.

      +Scott Cozart There is a bad apple in every crowd ya know - we have no issue with people who ask in fact we welcome it - its nice to help folks out like that... 99% of the hunters around here are respectful but like I said theres always a bad apple:) This guy was told not to hunt back there anymore the previous yr since my aunt bought the property - he is just a prick lol

    Been fighting same battle for 15 yrs. I'm up to 3 confiscated nice deer stands (which I sold), 1 confiscated corn feeder (which i'm still using), 2 confiscated trail cams (which i sold). Amazing the disrespect people have for private property!
    P.S. How much $ did u get for the stand?

    First off Good Luck!! Thats a tough one to deal with. If a guy is willing to put up his "own" things on someone else property with out permission, you would think he would be prepared for it to be "confiscated". And to get kicked out or worst if caught. But with these types of guys thats never the case!! Like I said before good luck and be careful!!!

    Last night at 1am I heard dogs in the woods just behind the house in our 20 acres of woods. It went on til past 8 in the morning and I heard dog whistles too. I called the hunting wardens office 3 times and they refuse to help and I called the fulton county sheriff twice and they refuse to help. In all what they said last night was I needed to catch the dogs and read their collars for names or shoot them. A world without law is what gepp Arkansas and fulton county Arkansas is.Having been threatened twice by the hunters to better not kill the dogs or else I don't know what to do. If I buy a gun and protect my land I am not sure what will happen to myself or my 84 year old mom . The two of us live here on our 40 acre farm.

      In Gepp Arkansas the hunting dogs r allowed to run on everyones property and as they call it "train". So they can be sold to other hunters. And in this area the hunting dogs r for the most part in my opinion under fed. This area does not abide by hunting seasons.

      around here they breed and train dogs to sell for hunting. It is plain nasty seeing puppies running the roads and hills. I hear about the owners losing dogs frequently. For me its not being comfortable with this culture in the Ozarks. Still cleaning up the garbage the previous family just threw around this farm. Threw not because they cant afford to go to a junk yard but just because if u cant burn it u just toss it in the woods. I live in a third world country here in gepp Arkansas.

    Maybe your ant still gave him permission to hunt there. As a hunter myself I would not leave my tree stand and trail camera in a property that I’m not allowed to hunt. Those stuffs are expensive

    I own two vacant commercial properties next to rail road tracks. I have dealt with transients and squatters. Transients Are mostly men who are too tired or intoxicated to move on for the moment. Squatters are truly frightening. The speed with wich they move them in and you out is scary. They also use materials found in your yard to build barricades to try to keep you and others out. I believe they lay somewhere between scizophrenics and hoarders.

    First of all, is the border properly and clearly posted and maked?? If not you may not have a legal recourse against the tresspasser, as in pressing charges. You can verbally tell him to "stay the hell out", but a certified or registerd letter stating to "stay the hell out" will be valid in a court of law, should tresspassing charges be warranted in the future. As far, the game cameras and ladder stands I've found on my land, placed there by tresspassers, I have removed them and in their place stapled a note sealed in a zip lock bag, addressed to Mr. Tresspasser, where he could find the stand and or camera, at the Sheriff's sub station. If it is not claimed within a certain time period it belongs to me, but if they do show to claim it, they are issued an official tresspassing warning from the Sheriff's office.

      Yep its all clearly marked and he has been given a letter directly from me...:) He did remove everything but 2 weeks ago I was back out there and he made a shelter aka blind out of black plastic... My Aunt is working on legal matters:)

      In Montana most people attempt to clearly mark their borders - especially before hunting seasons. However, legal burden rests on each hunter, traveler, &etc to know where they shouldn’t be.

      They simply remove the signs or shoot them when placed high. It is their responsibility to know where they are. The law in most states favors the landowners . When hunters purchase hunting licenses and receive the states hunting regulations it states you must have wriiten permission to access private properties. Any trespassing is on them

    Wisconsin. Nrthern part. Thats the area where the vietnamese from MPLS went over the state line and moved in on a hunting stand. Somebody ended up dead over that one didnt they? Over by Hudson. Be careful deer hunters have guns these days :)

    I would've loaded that stand chock full of tannerite and wrapped it around the tree it was attached to with a single 5.56rd. Let him come back and find what's left if he's willing to walk passed the land mines signs on the property line. No shit, that's what I would've done.

    If the hunter is stupid enough to ask you about it lie to him, as you owe him no respect, and then ask him why he is hunting on private property that he dont have permission to hunt on, and then notify the cops and game warden to report.

    Probably the correct thing to do is notify the cops and game warden. They will then ask if you posted the property as no hunting and no trespassing every 50 feet or so and blah blah blah. In the end nothing will come of it and you will be in the wrong anyway. The best thing to do is take the camera and dont forget the stand and ladder, and keep your mouth shut and dont post a vid on it.

    I do the same thing on my land. I take down their stand and leave on the ground with a note. If they get hurt or hurt someone else I am the one who has to pay.

    Should have had the police or game warden take down the camera to see if his picture was on it when he set it up. If marked no trespassing, he goes to jail.

    Post lminated signage where the camera and the stand USED TO BE ... Include a printout of any laws which may pertain and lif you REALLY want to get nasty, blast the camera and the stand with buck-shot and leave the spent shells at the foot of those trees.

    I would have called the local police department and game warden , any further trespassing then I make sure whoever it is never leaves the property again. A lot of us do clear cut dead timber , under brush and plant food plots to help wildlife as well as hunt. So when you trespass on my property not only are you breaking that law but your stealing from my food supply as I do not buy processed meat from retail outlets.

    We just remove the stands and cameras and leave them on the offending landowners line. If he puts them back they are simply "re-purposed".

    great find there bro, possession after all is 9/10ths of the law, id of grabbed the ladder and stand too, and wouldnt give it back. are there any NO TRESPASSING SIGNS UP? I know that doesnt matter being its private property, but if someone trespasses when theres signs posted, it'll show you what kind of person he really is and how to handle the situation..... TRESPASSERS WILL BE SHOT, ANY SURVIVORS WILL BE SHOT AGAIN!

    I would leave a note where the game camera is with my phone number if they want it back and then you can explain the problem to them. If the camera is just stolen and they are assholes (which is very likely) they might be tempted to do something bad on the land. Just a thought...

    that sounded bad. I dont have anything bad going on with the Vietnamese. It was just all over the news in Minneapolis and they were stressing the ethnicity of the shooter mainly because they were just starting to get a asian gang problem in the cities. Thats why I remember it

    I don't understand why people will do things they know are wrong and also do it so blatantly. It is almost as if they are thumbing their nose. Trespassing is a crime. If after the polite conversation, you continue to find evidence of his intrusion, I would definitely contact your local LEOs.     Take the camera, drop it off at the local police station as "lost and found," and when he comes to pick it up, you'll know who did it.

      He did receive all his stuff back and told to stay the hell out via letter hand delivered by me... He has been back since and made a blind out of black plastic which I torn down... I will rig it so NO one will hunt back there...:)

    I don't know bro, it would seem that if you have spoken to this person before, that maybe polite isn't working. maybe if this costs him some money he might learn that you're serious. the loss of an illegally placed game camera, and the cost of a lawyer for criminal trepass might be the answer. or just keep anything he leaves behind. he won't call the cops to report it. Then again some people just never learn.

    Criminal Trespass in the First Degree
    A.R.S. 13-1504 - Criminal Trespassing in the First Degree states:
    A person commits first degree criminal trespassing when an individual:
    Enters or remains on a residential structure unlawfully.Enters or remains in a fenced residential yard.Enters a residential yard and looks into the residential structure, violating the owner’s right to privacy.Enters or remains on real property that has mineral claim and intends to hold, work, or take minerals from the claim or lease.Enters or remains on a person’s property and burns, defaces, or manipulates a religious symbol without the owner’s permission.Enters or remains on a public services facility unlawfully.
    A person who violates paragraphs 1, 5, or 6 of the criminal code

    That's EXACTLY why it's so hard to get permission to hunt private property. It only takes one or two inconsiderate idiots to ruin it for everybody.

      jeff h posted or not you should respect the land owner. I've found it much easier to ask permission. the worst thing is they say no. once again it's all about respect and you ain't got none.

    I think what you are doing is bordering on theft. I know you said the property belongs to your Aunt and you don’t think anyone is allowed to hunt there. The law if fickled and sometimes is contrary to our common sense. The property (the land) and (the camera) does NOT belong to you. Just because it is owned by your Aunt, it is not yours because you are related! That’s is why I think this is borderline theft. If she was there and took it because she didn’t give anyone permission to hunt, that is acceptable by law.
    In this case call the sheriff or face the consequences of a pissed off tresspasser and possibly the district attorney

    I more than understand, but you have no authority to stop anyone on either property as you said you don't own it! Only the land owner or renter has that authority! So if you find a camera are you stealing? I would have just bagged the camera and left a note!
