    As a surveyor, if he measured the centerline over to easement at the corners of property there is an iron rod with a cap on it which indicates the property line. Easy proof

      In mass all property lines ether have 1 of 2 things, a steal rod with an orange tip or a block of stone roughly about 6" x 6". That's how as a landscaper I know that I'm cutting the correct lawn and not doing both neighbors to ether side. In this situation it seem the state doesn't even know there own laws lmao

      ...if you have a metal detector? Those rods are commonly sunk down, otherwise they are a mowing hazard. The ones I'm aware of are a few inches down, and completely undetectable by sight.

    Once upon a time (less than 20 years) an Officer would be close to 45-50 years of age with over 20 years on to make Sergeant- if not 33 like mine was when I came on. He would have given whoever called on you a public ass chewing for wasting our time, apologized, and boogied onto an actual crime in progress.
    Kudos to the kind soul who brought out the water.

    Having worked in a communications company construction and engineering department I can tell you this. If the church owns to the center of the road you are trespassing. It is still there property. The ROW is only for you to travel across that property, not stop, not protest. The 25’ ROW from the center line of the road is for maintenance, expansion, water runoff, and utilities. It has nothing to do with you as an individual who is traveling the road. If the state, county, or city owns
    a strip of land that the road is built on, that is public land and you can be on public property as long as the municipality has no ordinance against it.

    You were in the 'right-of-way' and the police should have never let themselves get involved. The utility poles are the strongest indication of city/county 'rights' and the church has 'NO' say so in that area.
    I live in TN and a church is going in directly across from my house. Right now I've got all activity stopped due to the 'Ordinances'! It's ashamed that the Building Inspector doesn't know all the laws.
    My property is key to the church and without having access they have no where for the water to go. It's a swamp across the street. The right away is on my side and I have told the city they can dig all they want to supply the drainage. Won't work though because of utilities -- they need to go down on our property 200' to the creek. Ain't going to happen!
    People might say that I'm bitter -- yep! My belief is that I don't have to go to a 'funeral home to die' and I don't have to go to a 'church to be saved'! I am a ministers daughter!!

    Take II, again I live in Roberson Co, Tn and I was arrested as I tried to re-enter the court house after a break. I was there only because I was given a subpoena to testify only. It was late and I had wife's car that she needed to go to work as she was on call. I told the bailiffs I needed to leave and they said no. They took my subpoena and put it in his pocket. I told him to give it back,and I needed to go. They asked my name as I walked out to my car to call my wife. She still didn't need the car yet so I went back in and as I put my keys,wallet,breath spray back in the same basket as before. I was alone and was not talking to anyone but was arrested for Disorderly Conduct. The Corrupt Pig that arrested me was Keith Reeves as he arrested me he dislocated my shoulder,and left black bruises underneath my are as he walked me strait through the courtroom. I did NOTHING at all to deserve this type of corruption placed on me.Robertson County, Tn is a Corrupt place to live and I have Hated cops every since.

    Easements and Right-Of-Ways allow whomever is named in the document, the right to access or use the defined property for the purposes that will be defined in detail in the document. The land in question is still owned by the property owner, only the uses described in the document, describing the allowance, are available to the entity obtaining this ability to use the land. The Easement or Right-Of-Way documents will also be added to the Land Title, and are often accompanied by a survey plan, if the land in question is not easily defined by description, (ie: The outermost 20 feet of both sides of Road Plan XXX LL). Usually for Utilities, gas lines, etc.

    You need to go to the Tennessee Department of Transportation. They have detailed highway maps that show the Highway Right of Way. These are open to the public. Just go to the local DOT Office and ask for the particular section of highway. A map will usually cost a few dollars for a copy.
    There are also Monuments in the ground that are the physical evidence of this right of way. There are dozens per mile. Usually they are about 4" square concrete.
    Furthermore, the Tax Collectors office also has detailed maps that you can research yourself. These are called cadastral plats and are open to the public
    Next time get the proper maps. These maps are all prepared by Licensed Professional Surveyors. You can also look up the Deed that Transfers to the State or County the property and that deed will define the use.
    All Highway Rights of Way are public taxpayer property. State Highway numbers and ramps are not controlled by the County. Federal Highway numbers and ramps are not controlled or owned by the State.
    Do not trespass on Railroad right of way. They have their own police and they are federal and they will cite you.

    Utility poles are always on the edge of the public easement. This cop didn't want to write you a trespass citation because he knew it would be thrown out of court and you could sue the deputy personally as well as the sheriff's office and DA for violating your civil rights. Which you should still do, since you were told to go under the threat of arrest!

      But in most cases the easement is owned by private owners that the city has acquired the easement to put a street through or where a sidewalk is actually abutting a street and the land owner actually has fee simple ownership but has either granted or sold an easement.
      All public easements are granted for the use of the public. And the city does not own them. Nor do they have territorial jurisdiction over them.

And as long as I stay out of, or off of territory or other property owned by or subject to the exclusive jurisdiction of the United States of America. Then the Statutes, coded, rules, regs, public policies ETC. Of the act of 1871 and of the "States of_______________. do not apply to me.
      The District of Columbia Organic Act of 1871 still only applies to territory or other property owned by or subject to the exclusive jurisdiction of the United States of America.
      And to the voluntary servitude second class citizens that are subject to the jurisdiction thereof the United States.

    There is a "fourth" option here that should have been played out. Demand a written trespass warning. If the property owner was trespassing you their name would appear (or at least the name of the church). This carries no fine but provides written proof they illegally trespassed you from the right of way. And the cop would have to justify it in court when you file the lawsuit.

The gentleman was protesting and the police insisted he move from public property and he has every right to protest on public property...Dave insinuated that his hobby was insisting his rights be honored by officers! I think demanding your rights is NOT a hobby, but your duty as an American citizen. And the comment of "pack yo' sh*t and leave" was refering to any communist who believe we should all be sheep and just follow blindly while our rights were being trampled on! Especially when he was protesting against abortion, witch kills innocent lives, so yeah.....you can call me NASTY all ya want!     Personally, I thought the Officer was professional in the way he handled the situation. A lot of officers would have just put the cuffs on you and took you to jail. One thing I believe I heard the officer say was that the church maintained the ground they were standing on. Maintaining the property doesn't mean that you OWN the property.

    I’m the result of my mom being raped at 14 by a 22 yr old man that just arrived home from Vietnam in late 1971.
    Thankfully, Roe vs Wade wasn’t around until 1973. I was born in May 1972.
    My grandmother wanted to force my mom to get an illegal abortion at a small town doctor’s office in Cross Plains, Tennessee. Mom ran away from home to avoid this. She later returned when enough time had passed that she was too far along in her pregnancy that the corrupt “doctor” wouldn’t do the abortion. I was born at 26 weeks. Very premature weighing just over 2 pounds. I thank God for my life and for giving my mom strength at 14 yrs old to fight for my life.
    Later in life when I was 7ish, my mom was pistol whipped when I was a kid . This pistol whipping caused cysts that eventually caused an aneurysm that took her life in 2007.
    I miss you momma.

    this video seems to be using the terms property lines, right-of-ways, and easements interchangeably. They are different things. you would need to actually find out where the property lines are at by getting the information from the county. since there is a road (assuming it is a public road) you are likely standing in a right of way there. you can't be trespassing in a right of way, that's why the right of way is there. doesn't matter if the property owner has to maintain that land up to the edge of the street, that's pretty standard, that doesn't make it their land.

      The only reason he didn't challenge is because he knew he would get arrested. Probably beat on the way and while being booked in, held for 2-3 weeks before seeing a judge, have extra charges of resisting arrest to explain the beating they gave him and nothing happen to the scum cops that were responsible.

    This Is exactly the reason I don't attend a church on a regular basis. Why would ANY church to say the least, want him to leave when he's obviously fighting a great cause? If anything, the church should be supporting him 100% no doubt. If I recall, the bible I read says, and I quote, "thall shalt not kill". So this young man knows what he's doing and he's well within his rights to be there. He's 35 ft from the property line therefore, the charges would be dismissed anyways. Churches these days. Nothing but a bunch of hypocrites. Hypocrisy at it's finest...

    I wish people would converse like adults instead of interrupting all the time. One person speaks and makes his case while the other person remains silent, then the other person does the same. It's not complicated.
    Besides, legal issues are NEVER settled on the side of the road, so this interaction was largely a waste of time. Take it to court. That's why it's there.

    Just another video of someone willing to stand up for their rights until they get told to leave......why even argue if you’re going to back down.     Universal Citation: TN Code § 39-14-405 (2014)
    (a) A person commits criminal trespass if the person enters or remains on property, or any portion of property, without the consent of the owner. Consent may be inferred in the case of property that is used for commercial activity available to the general public or in the case of other property when the owner has communicated the owner's intent that the property be open to the general public.
    (b) It is a defense to prosecution under this section that:
    (1) A person entered or remained on property that the person reasonably believed to be property for which the owner's consent to enter had been granted;
    (2) The person's conduct did not substantially interfere with the owner's use of the property; and
    (3) The person immediately left the property upon request.
    (c) The defenses to prosecution set out in subsection (b) shall not be applicable to a person violating this section if the property owner posts the property with signs that are visible at all major points of ingress to the property being posted and the signs are reasonably likely to come to the attention of a person entering the property.
    (d) For purposes of this section, "enter" means intrusion of the entire body or when a person causes an unmanned aircraft to enter that portion of the airspace above the owner's land not regulated as navigable airspace by the federal aviation administration.
    (e) Entering or remaining on railroad or utility right-of-way property by an adjoining landowner for usual and customary activities of the type defined in §§ 1-3-105(2)(A)(i) and (ii), (B) and (C) and 43-1-113(a), (b)(1)(A) and (B), (b)(2) and (b)(3) shall not be considered trespass under this section. This subsection (e) shall not apply if the railroad or utility right-of-way owner, by a personal communication or posting at the site by someone with either actual authority or apparent authority to act for the railroad or utility right-of-way owner, has communicated to the adjoining landowner that the activity is not permitted.
    (f) (1) The secretary of state shall establish a no trespass public notice list identifying employers in this state who have requested established private property rights to be recognized and recorded against a trespasser under subsection (a).
    (2) To be included on the list, an employer shall provide to the secretary of state copies of appropriate documents that establish the employer's private property rights, including the address and legal description of the property to which it has legal control. An employer that records its private property rights shall pay a recording fee as determined by the secretary of state.
    (3) Beginning January 15, 2015, and every January 15 and July 15 thereafter, the secretary of state shall:
    (A) Make the list available to the public in the office of the secretary of state and publish the list on the web site maintained by the secretary of state; and
    (B) Distribute the no trespass public notice list to every law enforcement agency in this state.
    (4) Publication of the no trespass public notice list as prescribed in subdivision (f)(3) establishes a presumption that members of the general public have notice of the establishment of private property rights of all employers and properties listed.
    (5) Each law enforcement agency in this state shall maintain the most recent no trespass public notice list received from the secretary of state for its use in responding to complaints of criminal trespass under subsection (a). If a property is identified on the list, the responding law enforcement officer:
    (A) Is not required to further establish an employer's property rights before taking action against a person committing criminal trespass; and
    (B) May take appropriate and lawful action against a person committing criminal trespass to have such person leave the property or cease blocking ingress to or egress from the property.
    (6) If the employer's property is listed on the no trespass public notice list, an owner may seek an expedited injunction to restrain repeated or continuing trespass.
    (7) This subsection (f) shall not affect or limit any existing rights of an owner whose property is not included on the no trespass public notice list.
    (g) Criminal trespass is a Class C misdemeanor.

    Right of way for larger streets can vary. The cop is wrong in stating it is 25 or 30 feet. In areas where there is a hillside or storm water structure to maintain , the right of way could bend around those areas. The state DOT has right of way maps for the larger roads. Also, individual survey plats shows the right of way line separating right of way from private property.

      The purpose of these audits is to determine how people in authority (real or otherwise) respond to citizens exercising their legal rights. In this case, the church usurped authority over a public right of way by preventing a citizen from being there, and the police compounded the problem by enforcing laws that didn't exist. This type of thing needs to be shown. If not, then rights are eroded and never regained.

    I dont know if U.S has this law, but most of the European countries has it.
    The freedom to roam, or "everyman's right", is the general public's right to access certain public or privately owned land for recreation and exercise. The right is sometimes called the right of public access to the wilderness or the "right to roam".
    That mean that you can be on a private property unless it is fenced, you can camp one night and you must leave the property next day and leave it as it was. you must take any garbage with you.

      Yep, I mow that spot of grass between the sidewalk and the curb in my city and that's not my property. However according to the law I am the one responsible for the upkeep because it's in front of my house, but I still can't trespass anyone off of it.

    I believe that statute says the centre of the Highway/Road, not the centre line, which are two different things. Because roads have multiple lanes, the markings on the road, may not display the physical centre, but merely the separation between the right hand and left hand lanes

    There seems to be some confusion regarding private property vs. public easement. Public easement is NOT ownership of the property. Public easement exists regardless of who owns it. It is not a 'one or the other' situation, it is commonly BOTH. A private party may own the land under a public sidewalk, but cannot forbid the public from walking on it. It is BOTH privately owned (taxes paid by the private owner), and accessible to the public.
    Trespass laws do not address public easement. To counter the simple reading of trespass law, you go to public easement case law, and explicit exemptions such as surveyors, etc.
    If the land in question is ACTUALLY NOT OWNED by a private party, you have a strong argument to put in front of a cop, have the plat map reference ready.
    If the land in question is actually owned privately (aside from the public easement), you need to have the easement case law on hand for the cop to check, otherwise you are going to lose arguing on the side of the road. If you rely on the cop doing your homework, be prepared to be cited or jailed. YOU have to have your documents ready to show.
