He's not only messaged me, but he messaged my girlfriend, had people message me and her, showed up at my house WHEN I NEVER TOLD HER WHERE I LIVED, and when he was messaging me he kept threatening me saying "he'll see me soon" and I'm freaking out because what if the judge believes him over me?!
Ya know... None of these help you if youve actually DONE something. So for example with myself i struggle with CPTSD, ive got ADHD and get heaps of ruminating thoughts from OCD. I had my partner say something that triggered me in a deep emotional way and i hit them, not with aggressive intent but rather emotionally and it dislodged a tooth. She didnt put the order on me, she was very shooken up and shocked cause it never happened before but what raises my odds of winning when im going against the police that put it on me?
At the risk of getting flamed by petitioners who show up here (and assuming that this is in CA)… Are you dealing with a criminal case or DVRO? If DVRO, you have a few options: (1) hire a lawyer to come to an agreement with her to extend the case for a certain amount of time and then dismiss it, providing that you don’t contact her (this saves you from having the restraining order on your record); (2) hire a lawyer to cross-examine, object, etc. (just because something happened doesn’t mean it can be proven in court); (3) same as 2, but represent yourself and focus on objections. Keep in mind that the standard for DVROs in CA is whether a restraining order is needed to prevent future DV, so if this was a one time thing, that’s in your favor (but yes a bit tough if it was a severe enough situation). If it’s a criminal case, you have many options, including seeking mental health diversion or mental health treatment in exchange for a dismissal. Be prepared to get evaluated and to agree to whatever treatment is recommended.
