Nintendo could be called stealing to fan games, but Nintendo can be taking inspiration, and that’s basically like making there fan base part of the community
Nintendo is definitely shady and petty but I’m guessing the reason they DMCA’d the Mario Royale game is that they were already planning Mario 35

About the Mario and Peach age gap joke... Peach is not 16 and Mario is not 35, Nintendo has stated that they are both roughly the same age (somewhere around 25 years old, the exact age was not given). The reason searching Peach's age gives you 16 as an answer is because that is how long ago the game Super Princess Peach released.

Actually about this. The creator of mario royal changed everything the assets the levels the music. He called it DMCA Royal. Nintendo sent him another DMCA Take Down. And my question is for what? Do you own the platformer genre in an 8 bit format nintendo? No

It's still distribution of a carbon copy? To be clear, free mods are not unlawful at all. Providing a mod and providing a modded game are not the same thing.

Ikegami Tsushinki programmed the game and developed the boards, not Nintendo.

May be their property but I feel they do owe compensation to the ones who created the new idea. Don't steal, just "ask nicely" to take down then work to make it more 'official'.
It would be horrible if you could own the copyright of the idea of "many players playing at the same time in game X" and "a remake of game X". Nintendo shouldn't be considered stealing these ideas, because these ideas are so broad and generic that these could easily be made up independently.
honestly, if Mr. Miyamoto really did that Argonaut Games, i respect his hustle. like, "hey remember that idea you pitched to us? yeah that's OUR idea now. smell ya later SUCKERS!"
Not really trying to defend anything even though this sounds like it, but Nintendo only really goes after things that are trying to monetize using their IPs, use their ips for nefarious purposes (scams, illegal activity, etc), or else go after things that resembles something that are planning to release in the future. Happened to the metroid fan game, happened to smash bros, happened to Mario royal.
You'd actually be surprised on how many things actually infringe on Nintendo's IPs that they are fully aware exists, but choose not to do anything since they dont fall into any of the above categories and wont affect them financially. In a way you can kind of use this as a way to guage what Nintendo is working on.
That said, they are pretty scummy in how they do get things removed, usually waiting until its almost complete and then pulling the rug out, wasting countless days/weeks/months/year of work. A lot of the time the timing looks very suspicious but they are working on quite a bit, just the jp mentality to never leak things before they are released makes it worse then it seems. ;/
I didn't see any Mario fangames that do that, besides most of Mario fan games are gone, so your point is kinda bad ngl

They say Donkey Kong was originally supposed to be a Popeye game, and to this day the plot of Mario games is the plot of a Popeye cartoon :
Mario (Popeye) and Bowser (Bluto) fighting over Peach (Olive Oyl)
So had that cartoon not exist, Nintendo would've been so different, or not even a thing at all
I think nintendo, or at least game freak, canceled Pixelmon for a bit and then a couple years later released that weird block one on the switch and phone, some Pixelmator servers are still up though so I don't know
That's pretty much exactly what happened they relwased I think it's called Pokemon quest or sumthin, tho now you can still find Pixelmon and various variations. And at least the legit pokegame was free.

You forget that the entire idea of the switch isn't Nintendo's. I remember seeing somewhere that the idea came from sega in the 90s, but when I actually looked for it, I instead found the Watara Supervision, which could connect to a tv using a link cable, and was created in 1992. There was also the Neo Geo X, which had a docking port to connect to the tv as well, and came out in 2012, during the awful Wii U phase of Nintendo. The switch was in 2017. The point is, it's pointless to say that the switch is innovative, or that Nintendo came up with the idea. No matter how much they pretend it's their own invention, it's been done before. Plus, I don't think it would take 30 years for someone to have the bright idea of a handheld game system being able to plug into a tv so you can play on it, that would be outright ridiculous. PEOPLE HAVE AN IMAGINATION.
also, Mario Royale is already back up, which seems to have happened after Nintendo took down Mario 35

Just to be clear, Nintendo does not have any legal right to take down free mods. They do not get to tell people what to do with things after purchase. Anybody can modify what they personally own. Only distributing unapproved copies or unapproved commercial use is unlawful. If the Mario Royale thing was just a way to modify a copy of the original game that would have been fine. It was a browser game so they were providing unapproved copies (that are also modded), not mods themselves.

So Peach could probably be in her mid twenties or early thirties
Also, Nintendo only shuts down fan games that are remakes or uses the same level/levels from one of their games. That was why Mario Royale, DMCA Royale, AM2R, and Super Mario 64 HD were taken down and not games like Super Mario Bros. X, Super Mario Flashback, and Super Smash Flash.
and of course the legendary Super Mario Crossover.
@@Oturan20 Speaking of SMB Crossover, they copied the original Super Mario Bros. for the NES along with the Lost Levels and Special Versions for Japan and South Korea, yet Nintendo let them get away with it. Lucky spiffs.
@@mohamedmukassabi6749 Before the death of Flash, the 3rd version had practically every character from the big names, and more! You could even use the Konami Code to unlock all the cheats. Having water physics everywhere makes it weird and the bouncy pits. I unfortunately can't remember the exact route to take in 8-4.

2:38: Finally, someone agrees with me on this. I know of another fangame they didn’t take down: Mario Forever, which also has a level editor type thing called Mario Worker, which came out long before Super Mario Maker. If Nintendo took down Mario Forever and Mario Worker, people would flip out when Nintendo was found out about taking down an old popular fangame, just to make their own level editor type game. Besides, Nintendo mostly goes against fangames made for profit.
