This topic is so interesting to me because it shows a devide between the law and the morals of most people. A fan remake/remaster, be it of a game, movie or whatever, is copyright infringement and, in this case, Nintendo has the legal right to strike down every such project that violates their IP. But on the moral side; Do we want the games of many childhood memories be legally inaccessible except for the company that created them long ago and now doesn't give a shit about them, their history and legacy? Do we want the preservation of such things by third parties to be illegal? I don't think many people would say yes.
With AM2R I can kind of understand it as they were working on an actual remake of metroid 2 and didn't want the game to lose sales due to the fan project as they were released within a year of each other. Does it suck they took legal action? Yes. Can we do anything about? Not really since it's their IP I do hope some day we can get more fan mods without having to worry about Nintendo taking them down as some mods breathe new life into some series

One really big fan project that I remember was Pokemon Brick Bronze on Roblox. One of the biggest games on Roblox in 2015-2018. Nintendo took the game down but the developers made a new game called Loomian Legacy.
It’s unfortunate that pbb got taken down.LL is a great game but has suffered a content drought and only recently had started to show that they’re working on the game. But, who can blame them for their demotivation when they worked for pbb for years and got taken down by Nintendo
Was looking for someone to talk about PBB and LL. LL still remains as one of my favourite games of all time. I've made a bunch of fan art, plus the PVP scene is very fun. Can't wait for the Halloween Event later today! (Also, I have a PVP Green Halloween Ikazune. It might be Pure Nimble, but I couldn't care less. :D)
And this isn’t even the most insulting move that Nintendo has ever made, it’s infuriating that a company that I thought valued fun and the community now only values themselves more than anything. Their games prints money and they lose nothing if a fan game is out there, but they still take it down which makes absolutely no sense. If it ain’t monetary value, then what is it?
Another pokemon fan game was pokemon brick bronze on Roblox. It was very popular until it was taken down in a mass ban wave of Nintendo games on Roblox. After its deletion, It was remade and rebranded as loomian legacy, but it isn't as popular anymore.
Loomian Legacy is practically dead. Even Armenti and LuckyHD know it. Oh, nevermind. I went onto to Roblox to see how many players it has and it has 1.2k. It's been having around 500-600 recently, so that's good. Plus, it'll probably go up to 4-10k since the Halloween Event comes out later today.
Another notable one is Pokémon Prism, cause that was a ROM patch, which technically *isn't* illegal. Worst part about that is that it was taken down like, a week before the full game was scheduled to release (Except for post-game I think), which was just salt in the wound, especially since that project at that point had been worked on for... 8 years I think? :/
Nintendo is marketed as a family friendly lovable company, an image that they could further enhance if only they didnt shut down fan made stuff like this.
@@bowldawg4394what? Mario 35 was just supposed to be like Tetris 99, with the only thing similar to Mario 35 and Mario Royale was the “battle Royale” theming
There was actually a pretty big Pokémon fangame that was made entirely on Roblox, called Pokémon Brick Bronze. If I remember correctly, it included every Pokémon, rather than skipping out on over half of the previous games’ (albeit using 2D sprites), basically a Pokémon game that reflected on everything they had done prior, and the game, to the point I managed to reach awhile back, was really well made for the platform. Anyhoo it got the axe, kinda understandable, but plenty of people were, and still are mad.
every time i see DMCA Royale i always think "Haha that's Infringio" _(Still have the first sprite I made for him lol, fun fact, his shirt was originally blue and most of the palette comes from a Level UP mario sprite remake haha)_ I'm *really* hoping that Nintendo turns over a new leaf when it comes to fangames, but I wouldn't say "Don't make fangames, it isn't worth it" as even though there's been takedowns I still see a bunch of fangames around. I just wanna play more Mario lol, cool video! :D
12:47 About that, Mario Royale has been resurrected about a year or two ago, and the team behind it have been working on a Deluxe version of it alongside a remake of the original. While Mario Royale Deluxe is not playable just yet, Royale Remake is playable and available publicly.
what we learnt from this if you're making a fangame, stay anonymous, release it to multiple websites through a chain of people and accounts, keep back-ups spread everywhere.
Nintendo is like that one really mean and strict parent who takes everything away from you and gives you cheap food but then gives you real nice cookies and then randomly be really kind to you
Honestly surprised you didn't mention Slippi during the Melee segment, though it's still being played without an official DMCA/C&D. But it's still a good video
I like these new types of videos from T3rr0r, if you want to do them instead of the funnier, more satirical previous ones, than do as you want. But the more important thing is that you managed to pull it off *well* . These more informative, researched, and analytical videos actually mesh decently well with the editing, mostly because it's decently consistent. I think it'd be better to either tone down the editing for moments without jokes, or make more jokes and add more meme editing. It's a bit off, but still much better than other TH-camrs, example L.S. Mark. He always made analytical, more serious videos, however, his editing has devolved from being professional throughout rather than using random, incoherent memes while he's talking about something he'd want to take seriously. I think it's nice you kept the GettyImages and meme sound effects which you always used, however, I just want you to make sure the editing of your videos is consistent and funny, along with lining up with what you say. Mostly just because it's kind of immersion breaking and your channel is still great. Keep up the good work, man. Excited for your new videos and I hope the editing just gets a little better.

the selling merch thing is completely understandable to strike down, since that’s making money off of THEIR copyright, however the mods and fan games being struck down is stupid. the whole striking down stuff like this is to protect their assets, since not protecting it enough can it get taken away legally. even then, they’re doing way too much. sega is a prime example of what’s best for the fans, letting them run wild, even if sonic has been rather lackluster in the games department the past few years.
Since the Garry’s mod accusation of Nintendo suing Valve Not to mention Nintendo is one of the biggest gaming company ever made and still disrespecting fans to this day

Sega is often overshadowed by Nintendo despite being many times more friendly to their users even going as far as hiring a fan to work on an official game.

A few months back, Nintendo DMCA'd the Metroid Prime 2D fangame as well. They had released a demo of the game and my god it looked BEAUTIFUL. I don't know if it's still being developed in the shadows but damn it's sad that Nintendo does not like to support fangames when they in most case would not get financially hurt. Who knows when they will be like Sega and see that people actually do this because they love their franchises and make fangames out of that love.

I'm very surprised that Nintendo didn't nuke Mother 3's fan translation despite being aware or atleast knowledge it's existence like they did it on purpose, hhhhhhmmmmm... Speaking of Mother 3, there was a fangame of Mother 4 but they made it something original instead and changed the title to "Oddity", because they're afraid if Nintendo nukes them just like AM2R fangame but some similarities are still there like the graphics and PSI powers just renaming it "ESP". Too bad it's not released yet, just the trailer.

Nintendo is currently the "Apple" of consoles. I can prove it in six points. As these traits overlap with Apple as well. 1) "Unique" quirky design philosophy to the detriment of performance or usability (Drift drift drift, hardware lagging behind on an ancient NVIDIA tablet GPU due to their insistence on the form factor. Took two revisions to make a stand that wasn't total garbage.) And when called out on it? Gaslight the consumer! Joycon drift isn't real! Ignore those class actions! Also you have phones don't you? Don't you know VOIP on the same console you're playing the game on is hard?! WHAT DO YOU MEAN THE PSP DID IT A DECADE PRIOR?! 2) Almost intentionally spiteful consumer relations (Each E-shop being it's own walled garden that doesn't carry over to the next series of consoles and handhelds fundamentally stripping you of what you paid for and saying "Buy it again" without actually offering it again. Complete ignoring of consumer desire or requests.) 3) Nothing drops in price, ever. Because dropping prices would "Damage" your perceived value. IE: Any first or second party game will be full retail price until the heat death of the universe on store shelves. Switch still full price despite the fact every single part on it is just about a legacy bulk buy holdover component by now. 4) Overbearingly Litigious, Sue detractors, sue fans, sue people who work with you, sue people who work against you, sue everyone! Also write up some more bizarre draconian TOS while we're at it! 5) False perception of an underdog despite being one of the most profitable in the market. 6) Fingers in too many pies, when you're already doing too little to address and support your core market and first party hardware and software. (Themeparks! Movies! Lego sets! Smartphone games! Labo in schools! )

As I always say: Sega does what Nintendon't: Allow you to make games inspired by their source material, and allow you to listen to their music.
Actually i think they made their own remake of metriod 2 to fuck with the people who made the fanmade version
@@casecyrus2500 I don't think so constantly they expanded the lore and we got metroid dread plus I don't wanna see the series die so I'm happy they made the remake and it did well if it means taking down a remake to keep the series going I'll happily take that as dread was a fantastic game and probably wouldn't have been possible if the remake didn't do too well
@@Mysticshosh42 except if other companies like sega and valve have shown fan games can exist or even be sold alongside official products so its more than possible to leave the fan game alone and still make the official game
Fan games are practically free marketing to the official products so they would make the official franchises even more popular.
@@Goldfire345 then you remember this is Nintendo and they'd rather take down fan projects rather than endorse

T3rr0r your videos are really good and I'm really liking them so far and I hope you don't go insane
You know what they says you either love your fan games, or you’re Nintendo
One really big fan project that I remember was Pokemon Brick Bronze on Roblox. One of the biggest games on Roblox in 2015-2018. Nintendo took the game down but the developers made a new game called Loomian Legacy.
It’s unfortunate that pbb got taken down.LL is a great game but has suffered a content drought and only recently had started to show that they’re working on the game. But, who can blame them for their demotivation when they worked for pbb for years and got taken down by Nintendo
To be fair they were making actual money off of the game so I don’t blame Nintendo in that specific instance
@@loona2n It’s crazy seeing a multi-billionaire company go insane over losing like
a couple grand, they should’ve gotten the rights to that game
@@loona2n they even required you to buy xp share.
Imagine if nintendo literally hired someone to take down fan games
they do they have lawyers
This really shows how sega and Scott care about their fans
SEGA is on the other extreme, were they care so little about their franchises that they let fans do the work for them
I will forever stand that Scott is the best game dev to ever exist, and not just in game making
I guess Sega Does what NintenDon't
@@taiyakiemu Pokemon brick bronze was literally illegal.

Rip To These Fangames :(
i mean theyre not even gone you can still play them
Another notable one is Pokémon Prism, cause that was a ROM patch, which technically *isn't* illegal. Worst part about that is that it was taken down like, a week before the full game was scheduled to release (Except for post-game I think), which was just salt in the wound, especially since that project at that point had been worked on for... 8 years I think? :/
The solution: Dont make a nintendo fangame. Make a sega one.
It feels like they only take down these fangames not to lose any money, but to remove competition similar to what happened to Mario Royale and AM2R.
Nintendo is marketed as a family friendly lovable company, an image that they could further enhance if only they didnt shut down fan made stuff like this.

Literally what happened with the mario royale game 💀
Anyhoo it got the axe, kinda understandable, but plenty of people were, and still are mad.
every time i see DMCA Royale i always think "Haha that's Infringio" _(Still have the first sprite I made for him lol, fun fact, his shirt was originally blue and most of the palette comes from a Level UP mario sprite remake haha)_
I'm *really* hoping that Nintendo turns over a new leaf when it comes to fangames, but I wouldn't say "Don't make fangames, it isn't worth it" as even though there's been takedowns I still see a bunch of fangames around. I just wanna play more Mario lol, cool video! :D
Every vidoe just keeps better, and you are faster at making them, thank you
i love how mario royale rebranded into dmca royale lmfao
12:47 About that, Mario Royale has been resurrected about a year or two ago, and the team behind it have been working on a Deluxe version of it alongside a remake of the original. While Mario Royale Deluxe is not playable just yet, Royale Remake is playable and available publicly.

what we learnt from this
if you're making a fangame, stay anonymous, release it to multiple websites through a chain of people and accounts, keep back-ups spread everywhere.
Nintendo is like that one really mean and strict parent who takes everything away from you and gives you cheap food but then gives you real nice cookies and then randomly be really kind to you
randomly be kind? lmao
Maybe not kind but gives you amazing stuff
Hi T3rr0r, thank you for feeding us more videos.
Thanks T3rr0r for making some quality content

Valve: oh you modded one of our games that’s so cool let’s put it on the steam store and help get you recognized
Nintendo: you modded one of our games oh here’s what you owe us in lost sales we’ll be taking down your game and we’re suing you
This is likely why Mario Multiverse is still in it's closed beta status.
Nintendo, how could you?! How could you do this to us?!

this is to the point where if you randomize your pokemon game the pokemon company will not work with you.

@@YoOnly1Live Goofy ahh YOLO
the selling merch thing is completely understandable to strike down, since that’s making money off of THEIR copyright, however the mods and fan games being struck down is stupid. the whole striking down stuff like this is to protect their assets, since not protecting it enough can it get taken away legally. even then, they’re doing way too much. sega is a prime example of what’s best for the fans, letting them run wild, even if sonic has been rather lackluster in the games department the past few years.
Since the Garry’s mod accusation of Nintendo suing Valve Not to mention Nintendo is one of the biggest gaming company ever made and still disrespecting fans to this day
There was one banger fan game that was unfortunately never mentioned here: a Roblox made little number called, Pokemon - Brick Bronze. A nearly finished masterpiece that was struck down in it's prime and had potential like no other fangame that I have observed, so sad...

Nintendo has the right to take legal action against these fan games but the measures they take and the extremely harsh punishments are unnecessary. Sega is often overshadowed by Nintendo despite being many times more friendly to their users even going as far as hiring a fan to work on an official game.

okay my proposal is to rebrand project m.
This means making new character designs, dropping the Super Smash Bros name, and so on.
I say this because Nintendo simply doesn't trust us using their IP. That is the primary reason fan projects that have to do with Nintendo stuff like project m get shut down, but stuff like Sonic's Speed Course (a Kirby's Dream Course fan game, but using Sonic) doesn't.
Sega : "People want to remake sonic and their own mod? We SEGA are ready to give advice if asked"
Valve : "People want to make their own halo game? Sure go for it we VALUE even give some asset and source to make it happen"
Nintendo : "what!? Is that fat plumber italian guy in your video game?! Shut it down imediatly or suffer the LAW"
Kodaka: people want to make their own danganronpa sure we love to see a unique cast of characters (or a rewrite of a canon story) and a immersive story(not looking at you hdrh20aah) of a killing game

Who knows when they will be like Sega and see that people actually do this because they love their franchises and make fangames out of that love.

what's even worse is that they stopped the production of custom joy-cons in honor of a fan, but what's EVEN WORSE is that the proceeds of those joy-cons went to a mental health charity.
Honestly I hope Nintendo don't sue Luigibonus for this. He made Super Mario Construct and Yoshi's Fabrication Station and they are both amazing Super Mario Maker 2 inspired fangames. He also has a Discord server and I am one of the members.
Bro that 60 seconds song in the background hit me more than it should've.
If I was a game developer/had a game company would I would be completely fine with fan games if:
- the game it is based on an old game that isn't sold since years (I wouldn't be against piracy of the original games that I haven't sold since years to be begin with)
- the game is for free (donations are ok)
I’m afraid NOTHING can be done to stop it and well we just have to accept it regardless if we like it or not.
The way how they removed Mario battle royale just to make a worse version of it
Long live Project+, long live fans and their passion.
project + is a derivative of another game, so if people are making money off of it Nintendo should be able to sue.
Official nintendo games are thousands miles better. If you want to make a game but lack the skill and talent to do it, than do it in places actually allow it, like Roblox and Garry's MOD (for godsakes it even has MOD in their name)
@@guyjuprod Friendly reminder that *NOTHING* can stop legal action, the platforms can easily get rid of them if they recieve a DMCA Notice, and one of the games you mentioned (Roblox) does that, a lot.

I used to be friends with the guys over at pokemon smile, an Ifunny themed rom hack of pokemon firered. They released a demo and put it up on a website. While Nintendo now control’s the website and pokemon smile is no more, pokemon noon is the hack’s rebrand and its being officially headed up by someone else.
Man Pokémon uranium was such a cool idea
Nintendo is like the Krusty Krab. Even though the company has a greedy CEO, we're never hesitant to give him our money regardless of what he does.
Complete ignoring of consumer desire or requests.)
3) Nothing drops in price, ever.
Labo in schools! )
They also the "Disney" of video games.
I used to be a huge Nintendo fan, buying damn near every game they’d release, but seeing not only how they treat other companies, but their own fans/community, I couldn’t back them anymore. I still love their games, but they don’t put any of the care they used to in their newer titles (except BotW and Mario Odyssey). All their games now are plagued with no content for the $60 you paid for, but promises for “free content updates.”
P.S. I love you for using the bully soundtrack in your video, even if it was a little clip.
