    Honestly anyone going through a disciplinary process, just resign with immediate effect and play the mental health card. If they hold you to your notice, tell your GP that you're having severe depression, low mood and stress and tell them to give you a sick note. They'll give you for a week, so every week call your GP and get them to extend your sick note until your notice period ends. As soon as you're told you're under investigation, go off sick with a doctor's note and attempt to resign with immediate effect. And like I said if they hold you to your notice period, remain offsick during the whole notice period and get the occupational health to testify that you're unfit to attend any formal proceedings like investigation meeting and disciplinary hearings. Keep longing this out till your notice period ends or they change their mind to let you resign with immediate effect. They surely would let you if you're not able to fulfill your notice period due to mental health. Most companies just give your dates of employment and your job titles which keeps your record clean.

    Thanks for the video! Just wanted to add that if you're under 2 years, they can dismiss you on the spot without disciplinary process. I think you briefly mentioned it in the video but I just wanted to make it a bit more clear you don't have any rights until you have 2 year service unless it's a protected characteristics.
    Also wanted to add that they might not give you investigation documents so you would need to do a subject access request so that they provide you with the documents they relied on to make a decision. This normally takes one month. They will try to drag it out as much as possible so that you can't take them to court because you need to do it within 3 months minus one day.
    In some cases decisions are already made before even listening to your case so you need to be very careful and think what you say in the meeting. The disciplinary meetings are normally not for you to defend your case it is for your employer to collect evidence to make sure you don't take them to court.
    I think it's a big misconception that you can take your employer to the employment tribunal if the disciplinary process was not fair. It doesn't need to be fair unless you have more that 2 years service and you claim breach of contract which usually is a tiny amount of compensation considering how stressful going to the court is. Best advice is to do anything your employer wants you to do, if you don't want to do it, leave and find another job.

      Yeah I mentioned it briefly because as you clearly know it's lot to unpack. How the process runs will depend on your employer and the stance they take. Some will just do it as a tick box exercise whereas others (like myself in my company) will genuinely want to see out the process because some accusations are baseless or more down to poor line management more than anything.

    If you had conduct with your line manger over unlawful deduction. Followed by verbally agreed that you can take an additional day off but the next thing you know was you get rota back in at the last minute if that still class as unlawful deduction of pay? So, you then don't show up for the shift that wasn't agreed and end up trying to confront them then the net thing you get is that he tells you it's end of conversation and that an independent to review and investigate the conduct but the independent that's reviewing the conduct are good friends with the line manager at work and great friends outside of work it this class as an independent?

    I was told in my DH that I was not allowed to talk about the inconsistencies of the statements, I was only allowed to answer if I did the accusation.

    Hi, if I feel discrimination at work and having disciplinary hearings and different treatment, can I record disciplinary meeting with my phone only to have evidence against them. can I do that ? thanks.

    Can they suck you if you been on sick, but you’ve been in work and you’ve had seven final warnings finals, but if you fall ill and they put you on a 12 month probation, I’ve got Union? involved and also got a letter of the Doctor stating the chance to sort my mates out

    Thank you for this very informative video. I appreciate you sharing. I am going through this now. I was first placed on a suspension and was told that HR was going to investigate the allegation and I would hear back within 24-48 hours and at that time I would be able to share my side. I was never contacted. No evidence was presented to me and 6 days later I received a call from the GM telling me I was terminated. I reached out to HR and associate relations and no one have reached out to me about it. I was never given any disciplinary coaching or write ups prior nor was I given the termination paper to view and sign.

      Too bad this was 4 months ago, next time make sure you raise a grievance, if they don't deal with it properly appeal it and, worse case scenario, contact ACAS for help. Best of luck in the future.

    I am a cna I was given a verbal warning today because the nurse on my unit took 4 hours to give a patient they medication after I tould her many times the patient wanted they medication… I did not sign off on the warning at all I did my job also cna we don’t pass medication….anything possible I can do about this subject?

    I just asked Sams club why did they send me home and I asked for paperwork. They refused me paperwork and told me to leave and sent me home early. They told me I can’t return to work because someone told them I was stressed so they are sending me home. That’s illegal.
    They said someone will call you in two days. Isn’t that illegal, I asked for paperwork and they refused to give me it.

    Hi, will I be able to resign (preferably with immediate effect or even by serving notice) after the investigation and before the disciplinary meeting? Could there be any risks in doing this? I fear that if I do it with immediate effect, they won't accept it and I could breach the contract. On the other hand, if I give the 1 month notice, I fear that the disciplinary will still go ahead? This is a poorly paid call centre job, (outsourcing company), and the allegation is call avoidance. Any advice would be highly appreciated. Thanks a lot.

      You can resign at any point. It’s unlikely they will make you go through with the disciplinary process. They could do but given the allegation, it’s not likely. They may even agree to pay your notice and you not work it but if not, you can offer to waive your notice.

They suspended me last Wednesday and on Friday was informed the "investigation" concluded and told to expect the disciplinary letter on Monday (which was yesterday). It's a WFH job. That letter hasn't come through and yesterday I was on the verge of e-mailing my notice through to HR department, but I thought I'd seek some guidance first. Based on what you've said, I think I should hand in my notice today. I really want this to be over so I can move on.

    Thanks for the video. I am the only black dude at my work place and I have been Scheduled for a disciplinary meeting on Tuesday, I’ll be 2 years with the company in less than 3months. They’ve handed me the list of mis conduct and I know they have a point as to what complains they are on about. But trust me they white guys did worse mistakes.
    Anyways, I do not have any trade union or companion to follow me to the meeting what do you suggest I do please.

    If you are in the middle of the process let’s say about to have a formal meeting could you move to another company ? Would they still give you references ?

      It depends on the circumstances, legally they have to confirm you have worked there and the duration. If it's a good or bad reference, it depends if you were in the wrong
