Ive been scammed by a different game store. I brought a sealed Tomodachi Life game and it said new. Opened it up and put in my 3DSXL and there was already a save file and level 50 miis

Back in June I bought a copy of Mario and Sonic at the London 2012 Olympic Games for the Wii from GameStop, saying it was in “perfect condition.” When I opened up the box, the disc had fingerprints all over the back of the disc and you guessed it, the game did not work at all! So I took the game back and ordered the game renewed off Amazon and the Amazon copy works just fine! So is GameStop scamming you? Yes! Yes they are!

Technically it is called false advertising, and if they say it is new and selling it advertising new and it is "not new" they can technically get into big trouble.
It is new, basically at GameStop we would take some games out of the case so we can put it on the wall for show.

@@ethanrios7414 I’m not defending them I’m just saying it’s technically new from the perspective of GameStop. And plus if there’s more than 1 copy of a new game you will get the sealed version. GameStop employees don’t go out of their way to give you the opened one.
@@ethanrios7414it’s new because the workers don’t do anything with it besides sleeve it and store it until it is sold (assuming we’re talking about a good worker), meaning it’s never been played and any inserts/DLC will be present.
Companies can sell returned products as new.
So i work at a GameStop so i can tell you how it works
We get online orders that we have to ship from the store and sometimes it the last copy of the game and that means that it has been opened to have the case out on the floor but the game it self has never been used before by anyone if it was in a white sleeve when you received the game the employee who shipped it was lazy because i make sure the disc is clean and i reseal the games before they ship
My new dm told me if we have one copy which is new left we are not allowed to send it out specifically because customers want new so they will be getting new. Basically people in store who purchase it get my last copy.
Every store and district seems to do things differently. The inconsistency is terrible. For example, I wanted to buy a used game but the game case was damaged so I asked to have it swapped with a nicer quality case such as one from a kids game that most gamers won’t even touch. The store clerk absolutely refused and said I will be reported. Whereas in every other store I’ve been to don’t have a problem doing that. So I refused to buy the game and he was ok with that. Months later I ended up speaking to their DM about it and he disagreed with the clerks refusal to complete that sale. Sadly, I never saw that game again.
@@FlipBoxStudio so I’ll tell you from experience of taking in a preowned game if the case is damaged when I receive it I immediately swap it out for a nicer one because I know nobody is going to want a cracked case. I am very thorough with my job and I always try everything I can to accommodate the customer, even if that means maybe breaking a few rules. Usually if I have to break the rules I get permission first. I question some other GameStop employees even at my own store. If this tells you anything after working one day of the week I almost had perfect sales numbers across the board. I give good numbers to make corporate happy while keeping every customer happy and getting regulars. Some people are not meant for customer service and that’s okay. Just hate that all the bad employees at GameStop over shadow the good ones like me.
Just speaking from previous experience as a former employee there and manager. The games that are often opened and sold as new are new. We are asked to open one copy of a game from shipment to display on the wall to show that that game is in stock. Not all customers ask if we have a game. The game is still considered new because no one actually played it. However, there is a Caviat. We were allowed to take a new game home if we signed them out. And then place back on the shelf as new. That's never bothered me because most employees took care of the games. Didn't leave any scratches, and you couldn't have it for more than 3 days. On top of that, it was expected that employees knew the games they were selling, and customers would be disappointed if we didn't know how the new game was. It was a necessary evil.
I was told by a gamestop employee, that the open box "new copy" is also used to allow the employees to basically "rent" the game. They can play it. But this was back before the switch came out.
Why before the switch? Wouldn’t it be easier to “rent” them then? Cuz before the switch all save data for Nintendo games was stored on cartridge. Now, the cart is just to start the 1.0 version of the game but the data is saved directly on the switch, you wouldn’t be able to “tell” if the game was used solely based on cartridge information

As someone who worked at gamestop I always understood this sentiment, I remember I spoke to my manager about it before and he agreed but there's nothing we could really do. Sometimes they provide display cases but this is usually for brand new launches and honestly usually for pre order promotions and to keep the shelves filled putting out empty cases and storing the disks/cartridges in the back just becomes necessary.

Just like electric sensors in cars you can tell if switch games are new or used, look at the gold plating on the pins, if there is a darker line in the center it’s used if the plating is a uniform gold it’s never been used
I can relate to this. One time, GameStop was doing this whole “buy a free game from this selection” thing (I think that’s what it was), my dad and I called GameStop to purchase the game I was interested in getting, which was Kirby’s epic yarn, and for some reason, we ended up paying for the game!! So yes, I can confirm that GameStop is scamming you with their “sales”
One thing that makes me upset, is Halle at one of the biggest stores I know here in Sweden used to have a Game stop and one time I almost got a concussion in a game stop, but that’s a story for another day but the game stop closed for some reason. I don’t know. My dad told me that game stop filed for bankruptcy but if it’s still exists now in America I don’t understand why I can’t find it here in Sweden.
The reason why is because GameStop no longer has sponsors or connections with company providing what the product since they stop letting pre-order in-game purchases be included / pre-order physical product

I worked at a toystore in the netherlands for a while. We did the same thing. So we could store the boxes on the shelf and put the cartridge in after people bought them. That said, i was never a fan of that and always bought my games somewhere where they were sealed.

What it is is that you may be getting their last copy, the display copy. Yes it is basically open box, but it is new and the box will possibly be damaged, which should be explained to you by the cashier. I would know as I used to work at the strictest GS in Louisiana. Everything had to be done perfect for the customer’s benefit. The game isnt used. The box is basically.
Ight, i actually work at gamestop, so imma explain what the reason for this is. When we get nee games in, we always have yo take to game out and store it so we can display the case. The displayed case is sadly left to the mercy of customers, so thats why they're a little scuffed sometimes. As for being that way from an order, its because when you order anything online from gamestop, its not sent from a warehouse to you. We actually straight up send you the best quality copy we have on hand directly from the closest store, and if that copy happens to be the one that was on the floor, then it's likely in less than mint condition
In Hong Kong, whether the game is used or not, if the seal is removed, it’s considered used.
And the price of a used game is no different to a new sealed games.

This is common practise is some game stores. I work in GAME in the UK, and we "gut" one box (take the contents out) to use the box as a display copy on the store floor with the price sticker on it. It actually costs games companies more to sell new in comparison to pre-owned no I'm not sure why game stop would bother sending pre-owned copies instead, it's likely just gutted boxes from floor demos
Pretty sure in the DMCA or other media law any package that is opened is not new, and isn't supposed to be sold as new.
I literally bought one of those "clearance" ps3 games that they put in front of the counter. I git home and peeled off the stupid price tags to find that the "clearance" price was more expensive than the original price
The games that are open are "display" games. The games have never been played, and are resealed so you can return it before you open it.
Ever since I’ve went to GameStop every copy has been open box, you grab the empty case from the shelf and they give you either the cart or the disc after.

Brand new is sealed. If it's opened, call it open box and give us 10% discount on top of senior, student, etc discount
When Pokémon Scarlet and Violet came out, I went to GameStop to get one violet/scarlet copy, I bought a scarlet for around $85.99. But when I went to Costco for groceries, I found a v/s double pack with extra pokeballs for $100. And of course, I bought to double pack for $100. And I also gave the scarlet to my cousin. It was also near Christmas so that was my Christmas gift.
I just buy all my games on ebay.
I worked at game stop as a seasonal employee and while working there you can literally check out games and play them at home you would sign your name and the game you got and the date and would have to return it and they would do this even with new games. So be careful theyll open the seal and all and than play it try it out and than put it back and sell it as new.

Once the game is opened it’s not new. There was a copy write case on that in the early 00s when people would by disk based games, copy the disks and return the games. Once that factory seal is broken, it’s used.
I had an incident where i bought Lego Pirates of the Caribbean on Xbox 360 pre-owned and asked for a case. The worker gives me a case off the shelf with 'NEW' on it. The game didn't work and when i tried explaining it to another employee; he didn't want to hear it (Pre-owned game in a new case apparently means 'new' game)
I’ve had the exact opposite happen to me. I bought Like A Dragon: Infinite Wealth used at $40 and they gave me a brand new game

Hi actual GameStop employee here if you order a game and it’s not brand new when you order a game but it’s been open that’s because we probably used that game for display in our stores because we probably ran out of new copies of a certain game but you can always go to your near GameStop that you ordered your games from and asked him to swap out your game for a new copy if they have it

I had a weird experience at GameStop a while ago buying the Pokemon OLED Switch, I ordered it online for in store pick up, the girl was very suspicious of me and she was like(we’ve been having issues with people returning consoles and trying to scam us), and I was like “Well…I’m actually collecting the OLED consoles so I’m not going to be returning it, I actually want it”.
It was weird, like why would you be suspicious of someone buying a Switch? On the website? To the store? And she kept talking about it like I was in on this scam, even though this is the first I’m hearing about it. Very strange.
I once pre-ordered collector edition of a game and it came open, game but no case, and missing a plush it was supposed to come with. I call to complain about it and was given a new unopened collector edition while I was told to keep the open one I was originally sent.
As an employee at Gamestop I can say that corporate does not care. Sadly I wish I could make the deals more enticing and our trade values on certain games better.

I mean, it is pretty accurate. I had saved up once for mario oddesey and paid 80 dollars for a sealed copy, and what I got was a used copy. I am 10 now and just buy games from Costco or Walmart.
I've honestly never been scammed at a game stop, which is weird considering how common it seems to be, the last game I bought was an open box copy of Splatoon 3 for $11 off what I would have paid on the eshop or anywherr else so a deal not a scam, it may be different where I live though

For some reason, mine was actually fine. During the buy 1 get one free. I got xenoblade 3 and skyward sword HD, and both of them were brand new and skyward sword was the one I got for free. Kinda crazy but yeah it worked fine for me

I work at GameStop and we gut new games so they go on the shelves and the game is in our drawers. If you get an open box labels new, it’s most likely the last copy of that game left.

As someone who worked at GameStop for quite a bit, I can confirm, 9 times out of 10, they are brand new, except for the odd duckling that an idiot packs your order. The “open boxed” ones you have deemed, we call “gutted”. Which means we needed a case for display. They are unwrapped, placed in one of those disk sleeves, and never touched until someone buys the last copy of that game. When we sold new games, the only time someone would get a “gutted” copy, was when that was the very last of that game in the store. Which, if they wanted it sealed, we’d then refer them to another GS with more than one copy of that game.
That's... Insane. Luckily there are no Gamestops in Finland. And we have strong consumer protection anyways, this would never fly here.
True story: my mom got me just dance 2024 from gamestop, i opened it, no game card. They wouldn't let us return or replace it. I now have a just dance case with no game.

Note: If you get scammed like this, you might be able to chargeback them. Not only does the bank force the company to get your money back because you did not get the product you bought, you also keep the incorrect product.
Free games
If you were knowingly or negligently sold a damaged product with the hope that you'll just go "meh" and not return it, it's a scam. Accidents happen, but if they're this frequent, they're doing something wrong, and not fixing it is the scam.
